37Pursuant to notice a telephone hearing was conducted on

129STATEMENT OF THE ISSUE
133Whether the Peti tioner, Micheline Verello, timely filed
141a Petition for Relief in connection with a claim filed with
152the Florida Commission on Human Relations.
158PRELIMINARY STATEMENT
160The Florida Commission on Human Relations transferred
167this case to the Division of Administrative Hearings on
176June 9, 2004. Accompanying the Petition for Relief were the
186Notice of Determination: No Cause, the Determination: No
194Cause, along with an amended Charge of Discrimination. The
203Initial Order was entered on June 10, 2004.
211Thereafte r, the Respondent, United States Cellular
218Corporation, filed a Motion to Dismiss. The motion alleged,
227in pertinent part, that the Petitioner, Micheline Verello, had
236failed to timely file the request for an administrative
245hearing and that, as such, her claim was barred as a matter of
258law.
259On July 14, 2004, the Petitioner filed a written response
269to the Motion to Dismiss along with an affidavit of Angie
280Henriksen. In substance, the response denied the petition was
289untimely. In substance, the affidavit sta ted the Petition for
299Relief was mailed to the Florida Commission on Human Relations
309on June 1, 2004.
313On July 16, 2004, a Notice of Telephone Conference was
323entered scheduling the conference call on the Motion to
332Dismiss. Both parties were afforded time to present argument
341on the motion.
344FINDINGS OF FACT
3471. On or about March 15, 2003, the Petitioner, Micheline
357Verello, submitted an Amended Employment Charge of
364Discrimination with the Florida Commission on Human Relations.
372Such complaint alleged that the Respondent, United States
380Cellular Corporation, had discriminated against the Petitioner
387in an employment action based upon the Petitioner's age.
3962. On April 21, 2004, the Florida Commission on Human
406Relations entered a Determination: No Cause regarding the
414Petitioner's claim. That determination set forth that there
422was "no reasonable cause to believe that an unlawful
431employment practice has occurred."
4353. The Notice of Determination: No Cause was also
444entered and mailed to the Petitioner on April 2 1, 2004. The
456notice provided, in pertinent part:
461PLEASE TAKE NOTICE that a Determination has
468been made on the above referenced complaint
475that there is no reasonable cause to
482believe that an unlawful employment
487practice has occurred. A copy of the
494Determination is attached.
497Complainant may request an administrative
502hearing by filing a PETITION FOR RELIEF
509within 35 days of the date of this NOTICE
518OF DETERMINATION: NO CAUSE.
522A Petition for Relief form is enclosed with
530Complainant's notice. It may be benef icial
537for Complainant to seek legal counsel prior
544to filing the petition.
548If the Complainant fails to request an
555administrative hearing with (sic) 35 days
561of the date of this notice, the
568administrative claim under the Florida
573Civil Rights Act of 1992, Chapter 760, will
581be dismissed pursuant to section 760.11,
587Florida Statutes.
5894. The Notice of Determination: No Cause was dated
598April 21, 2004. The Petitioner received the Notice of
607Determination: No Cause on April 26, 2004. Based upon the
617date stated on the face of the Determination: No Cause, the
628Petitioner was required to file a Petition for Relief not
638later than May 26, 2004. The Petitioner did not mail her
649Petition for Relief until June 1, 2004.
6565. The Florida Commission on Human Relations received
664the Petition for Relief on June 3, 2004. Thereafter, the
674matter was forwarded to the Division of Administrative
682Hearings and filed for formal proceedings on June 9, 2004.
692CONCLUSIONS OF LAW
6956. The Division of Administrative Hearings has
702jurisdiction ove r the parties to and the subject matter of
713these proceedings. §§ 120.569, and 120.57(1), Fla. Stat.
7217. Section 760.11(7), Florida Statutes (2003) provides,
728in part:
730If the commission determines that there is
737not reasonable cause to believe that a
744violation of the Florida Civil Rights Act
751of 1992 has occurred, the commission shall
758dismiss the complaint. The aggrieved
763person may request an administrative
768hearing under ss. 120.569 and 120.57, but
775any such request must be made within 35
783days of the date of d etermination of
791reasonable cause and any such hearing shall
798be heard by an administrative law judge and
806not by the commission or a commissioner.
813If the aggrieved person does not request an
821administrative hearing within the 35 days,
827the claim will be barred.
8328. In this case the Petitioner did not file a Petition
843for Relief within 35 days of the Determination: No Cause. The
854statute unambiguously places that burden on the Petitioner to
863timely assert her claim. She did not do so.
8729. The Notice of Determ ination: No Cause, placed the
882Petitioner on notice of the time restrictions applicable to
891this case. Moreover, the Florida Commission on Human
899Relations provided a Petition for Relief form to the
908Petitioner along with the Notice of Determination: No Cause.
917In short, neither the statute nor the rules applicable to this
928case provide for an extension of time to file a complaint.
939Accordingly, the Petitioner's claim is barred as a matter of
949law.
95010. Florida Administrative Code Rule 60Y - 5.008(1)
958requires th at a Petition for Relief be filed within 35 days of
971the date of determination. "Date of filing" is defined as a
982completed complaint that is received by the Florida Commission
991on Human Relations prior to 5:00 p.m. (Eastern time). See
1001Fla. Admin. Code Rule 60Y - 3.001(29). Based upon the
1011foregoing, it is concluded the Petitioner did not timely
1020assert her administrative remedy.
1024RECOMMENDATION
1025Based on the foregoing Findings of Fact and Conclusions
1034of Law, it is RECOMMENDED that the Florida Commission on Hum an
1046Relations enter a Final Order dismissing the claim filed by
1056this Petitioner.
