116STATEMENT OF THE ISSUES

153PRELIMINARY STATEMENT

155By Stop Work Order and Penalty Assess ment dated May 12,

1662004 (Stop Work Order), Petitioner, the Department of Financial

175Services, Division of Workers’ Compensation (Petitioner),

181alleged that Respondent failed to secure workers' compensation

189coverage for its workers.

193An Amended Order of Penalt y Assessment dated May 25, 2004

204(Amended Order), which calculated a penalty assessment as

212provided by law, was thereafter issued.

218Respondent timely requested a formal hearing to contest the

227penalty.

228The identity of the witnesses and exhibits and attendant

237rulings are set forth in the one - volume transcript of the

262The parties requested and were given an extension of time

272to file their proposed recommended orders. The par ties’

281Proposed Recommended Orders were filed January 25, 2005, and

295FINDINGS OF FACT

2981. Petitioner is the state agency responsible for

306enforcing provisions of Florida law, specifically Chapter 440,

314Florida Statutes, which requi res that employers secure workers’

323compensation coverage for their employees.

3282. At all times material to this case, Respondent was

338engaged in the construction business within the meaning of

347Chapter 440, Florida Statutes. Its individual principal, Mike

355Futch (Mr. Futch), was responsible for the day - to - day operations

368of the business.

3713. At all times material to this case, Respondent is an

382employer within the meaning of Section 440.02(16)(a), Florida

390Statutes.

3914. At all times material to this case, R espondent was

402legally obligated to provide workers' compensation insurance in

410accordance with the provisions of Chapter 440, Florida Statutes,

419for all persons employed by Respondent to provide construction

428services within Florida. Chapter 440 requires tha t the premium

438rates for such coverage be set pursuant to Florida law.

4485. It is undisputed that Respondent had not furnished the

458required coverage, and that there was no valid exemption from

468this requirement.

4706. Accordingly, on May 12, 2004, the Stop Work Order was

481properly entered.

4837. Thereafter, Petitioner reviewed Respondent's payroll

489records, which revealed that Respondent employed individuals

496whose identities are not in dispute, under circumstances which

505obliged Respondent to provide workers' compens ation coverage for

514their benefit.

5168. Based upon Respondent’s payroll records, Petitioner

523correctly calculated the penalty amount imposed by law under all

533the circumstances of the case, and issued the Amended Order

543imposing a penalty assessment in the amou nt of $198,311.82.

5549. Respondent did not persuasively dispute the factual or

563legal merits of Petitioner's case. Rather, Respondent suggested

571that this forum has some type of general equity powers to lessen

583the penalty on the grounds that Respondent made a good faith

594effort to provide coverage for its workers.

60110. The record does demonstrate that Mr. Futch in good

611faith engaged a Georgia insurance agent and instructed him to

621obtain workers' compensation coverage which would satisfy the

629requirements of F lorida law with respect to Respondent's Florida

639operations. The Georgia agent's failure to obtain coverage that

648satisfies Florida's requirements is a regrettable circumstance,

655but it raises no issue over which this forum has authority.

666CONCLUSIONS OF LAW

66911. The Division of Administrative Hearings has

676jurisdiction over the parties and the subject matter.

684§§ 120.569, and 120.57(1), Fla. Stat.

69012. Petitioner has the burden of proving by a

699preponderance of the evidence that Respondent has violated the

708wor kers’ compensation law, and that the penalty assessments are

718correct under the law. See Department of Labor and Employment

79313. Section 440.10(1)(a), Florida Statutes, provides in

800relevant part:

802(1)(a) Every employer coming within the

808provisions of this chapter shall be liable

815for, and shall secure, the payment to his or

824her employees . . . of the compensatio n

833payable under ss. 440.13, 440.15, and

839440.16. Any contractor or subcontractor who

845engages in any public or private

851construction in the state shall secure and

858maintain compensation for his or her

864employees under this chapter as provided in

871s. 440.38.

87314. Pursuant to Sections 440.10 and 440.38, Florida

881Statutes, Respondent was obliged to secure the payment of

890workers' compensation for the benefit of its employees and

899failed to do so.

90315. Petitioner has fulfilled its burden of proof.

911Respondent's good - faith, but mistaken trust in and reliance upon

922his out - of - state insurance agent, is not a legal defense, and

936cannot be considered in mitigation of the penalty to be

946assessed.

947RECOMMENDATION

948Based upon the foregoing Findings of Fact and Conclusions

957of Law , it is hereby RECOMMENDED that the Department of

967Financial Services, Division of Workers’ Compensation, enter a

975final order that affirms the Amended Order in the amount of

986$198,311.82.
