110STATEMENT OF THE ISSUE

114The issue in this proceeding is whether the Department of

124Veterans’ Affairs properly denied Petitioner’s application for

131admission to a veterans’ hospital.

136PRELIMINARY STATEMENT

138On June 29, 2004, Respondent, Department of Veterans’

146Affairs ("th e Department" or "Veterans' Affairs"), issued a

157letter to Petitioner, Tinsley Murphy Bradley, notifying him that

166his application for admission to a Veterans’ hospital had been

176denied. The denial of admission was based solely upon the

186Department’s determin ation that Petitioner had not been a

195Florida resident for one year prior to the date of his

206application.

207Petitioner challenged the Department's intended action and

214requested an administrative hearing. The Department forwarded

221the case to the Division o f Administrative Hearings on or about

233July 16, 2004. A formal hearing was scheduled for August 30,

2442004.

245At the commencement of the hearing, Ms. Lynn O’Grady,

254Petitioner’s daughter, was authorized to appear on behalf of

263Petitioner.

264At hearing, Petit ioner did not present any evidence.

273Respondent presented the testimony Lynn O’ Grady and Lyndette

282Aguirre. No exhibits were admitted into evidence by either

291party.

292A Transcript of the hearing was filed on September 8, 2004.

303Petitioner did not file any post - hearing written submission. On

314September 10, 2004, Respondent filed a post - hearing submission

324declining to file a proposed recommended order.

331FINDINGS OF FACT

3341. Approximately five months prior to the final hearing

343Petitioner’s daughter, Mrs. Lyn n O’Grady, applied for admission

352to the Clifford Chester Sims nursing home in Springfield,

361Florida, on behalf of her father, Tinsley Murphy Bradley. The

371Springfield facility is a nursing home operated by the

380Department.

3812. On June 29, 2004, the Departmen t notified Petitioner

391that his application had been denied because he had not been a

403Florida resident for one year prior to the date of his

414application.

4153. Petitioner is an honorably discharged veteran. There

423is no dispute that other than the question of residency,

433Petitioner otherwise meets admission requirements for a

440Veterans' Affairs facility.

4434. According to Mrs. O’Grady, Petitioner has resided with

452Mrs. O’Grady or her sister in Florida for approximately two and

463one - half years. Mrs. O’Grady’s tes timony in this regard is

475deemed to be credible and is accepted.

4825. Accordingly, Petitioner meets the one - year residency

491requirement and is entitled to admission in a Veterans’ Affairs’

501facility.

502CONCLUSIONS OF LAW

5056. The Division of Administrative Hea rings has

513jurisdiction over the parties to and subject matter of this

523proceeding. §§ 120.569 and 120.57(1), Fla. Stat. 1/

5317. The Department of Veterans’ Affairs is the state agency

541responsible for the operation of the state's veterans’ nursing

550homes. § § 296.32 and 296.34, Fla. Stat.

5588. Petitioner seeks admission to a veterans’ nursing home.

567As Petitioner is the party asserting the affirmative of an

577issue, Petitioner has the burden of proof. Department of

586Transportation v. J.W.C. Company , 396 So. 2 d 778 (Fla. 1st DCA

5981981); Balino v. Department of Health and Rehabilitative

606Services , 348 So. 2d 349 (Fla. 1st DCA 1977).

6159. Florida law imposes several requirements of eligibility

623for admittance to a veterans’ nursing home. Among those is the

634requi rement that the person seeking admission be a resident of

645Florida for one year immediately preceding the date of

654application. § 296.36(1)(b), Fla. Stat.

65910. The Department does not dispute Petitioner’s other

667eligibility requirements. Accordingly, since Petitioner has

673been a resident of Florida more than one year prior to his

685application for admission into a veterans’ nursing home, he

694meets the eligibility requirement set forth in Section

702296.36(1)(b), Florida Statutes.

705RECOMMENDATION

706Based upon the Fin dings of Fact and Conclusions of Law,

717it is

719RECOMMENDED:

720That the Department of Veterans' Affairs enter a final

729order granting Petitioner's application for admission into a

737veterans’ nursing home.
