223At issue is whether Tristen Onofry, a minor, qualifies for

233coverage under the Florida Birth - Related Neurological Injury

242Compensation Plan (Plan).

245PRELIMINARY STATEMENT

247On July 20, 2005, Victoria Hill and Keith Onofry, as

257parents and next best friend s of Tristen Onofry (Tristen), a

268minor, filed a petition (claim) with the Division of

277Administrative Hearings (DOAH) for compensation under the Plan.

285DOAH served the Florida Birth - Related Neurological Injury

294Compensation Association (NICA) with a copy of t he claim on

305July 21, 2004, and on November 4, 2004, following a number of

317extensions of time within which to do so, NICA filed its

328response to the petition, and gave notice that it was of the

340view that Tristen did not suffer a "birth - related neurological

351i njury," as defined by Section 766.302(2), Florida Statutes, and

361requested that a hearing be scheduled to resolve whether the

371claim was compensable. In the interim, Minal K. Krishnamurphy,

380M.D., and Tallahassee Memorial Regional Medical Center, Inc.,

388were accorded leave to intervene.

393At hearing, Joint Exhibits 1 and 2 were received into

403evidence. No witnesses were called and no further exhibits were

413offered.

414The transcript of the hearing was filed August 29, 2005,

424and the parties were accorded 10 days fr om that date to file

437proposed orders. T he parties declined such opportunity.

445FINDINGS OF FACT

448Stipulated facts

4501. Victoria Hill and Keith Onofry are the parents of

460Tristen Onofry, a minoristen was born a live infant on

470July 29, 2002, at Tallahasse e Memorial Regional Medical Center,

480Tallahassee, Florida, and his birth weight exceeded 2,500 grams.

4902. The physician providing obstetrical services at

497Tristen's birth was Minal K. Krishnamurphy, M.D., wh o at all

508times material hereto, was a "participatin g physician" in the

518Florida Birth - Related Neurological Injury Compensation Plan, as

527defined by Section 766.302(7), Florida Statutes.

533Coverage under the Plan

5373. Pertinent to this case, coverage is afforded by the

547Plan for infants who suffer a "birth - rel ated neurological

558injury," defined as an "injury to the brain or spinal cord . . .

572caused by oxygen deprivation or mechanical injury occurring in

581the course of labor, delivery, or resuscitation in the immediate

591postdelivery period in a hospital, which rend ers the infant

601permanently and substantially mentally and physically impaired."

608§ 766.302(2), Fla. Stat. See also §§ 766.309 and 766.31,

618Fla. Stat.

6204. To resolve whether Tristen suffered a "birth - related

630neurological injury," the parties offered the m edical records

639related to Tristen's birth and subsequent development (Joint

647Exhibit 1), and the opinions of Michael Duchowny, M.D., a

657physician board - certified in pediatrics; neurology, with special

666competence in child neurology; and clinical neurophysiolo gy

674(Joint Exhibit 2). Notably, Dr. Duchowny evaluated Tristen on

683October 6, 2004, and reported the results of his evaluation , as

694follows:

695PHYSICAL EXAMINATION reveals an [] alert and

702cooperative, well developed, well - nourished,

7082 - year - old, left - handed boy. Tristen weighs

71923 pounds and is 32 inches tall. His head

728circumference measures 46.4 centimeters,

732placing him at the 10th percentile for age

740match controls. There are no dysmorphic

746features and no cranial or facial anomalies

753. . . [or] asymmetries. Th ere are no

762neurocutaneous stigmata. The neck is supple

768without masses, thyromegaly, or adenopathy.

773The cardiovascular, respiratory and

777abdominal examinations are normal.

781Tristen's NEUROLOGIC EXAMINATION reveals him

786to be cooperative but with no speech o utput.

795He does know colors by pointing. He does

803not interact with meaningful speech sounds.

809He seems to enjoy the examination and

816actively participated. There are prominent

821tongue thrusting movements and intermittent

826drooling. The cranial nerve examin ation

832reveals full visual fields to direct

838confrontation testing. Fund u scopic

843examination reveals sharply demarcated disc

848margins without optic pallor. There is no

855retinopathy. Pupils are 3 mm and react

862briskly to direct and consensually presented

868light . The extraocular movements are

874conjugate and full in all planes of gaze.

882The motor examination reveals a static

888hypotonia with dynamic hypertonicity most

893prominent in the lower extremities. At

899rest, Tristen demonstrates an overly full

905range of motion a t all joints. He will then

915stiffen with activated movement. There are

921bilateral AFO's in placeisten shows no

927evidence of stable weightbearing and has

933poor head control with the head flopping

940forward. He has a wide based stance and

948demonstrates trun cal ataxia. He is able to

956grasp objects only with a palmar grasp and

964has no evidence of developed pincher grasp

971in either hand. He tends to grasp cubes but

980cannot transfer and drops them readily. He

987cannot build a tower of cubes. There are no

996pathologi cal reflexes. The deep tendon

1002reflexes are 2 in the upper extremities but

10103 at both knees and 3 at the ankles.

1019There are bilateral Babinski responses. The

1025spine is straight without dysraphic

1030featuresisten maintains a plantar grade

1035attitude when held in the vertical position.

1042His shoulder girdle seems to slip through

1049the examiner's hands. Sensory examination

1054is intact to withdrawal of all extremities

1061to stimulation. The neurovascular

1065examination reveals no cervical, cranial, or

1071ocular bruits an d no temperature or pulse

1079asymmetries.

10805. As for the etiology of Tristen's impairments, it was

1090Dr. Duchowny's opinion, based on the results of his neurologic

1100evaluation of Tristen and review of the medical records, that,

1110while of unknown etiology, Tris ten's impairments were most

1119likely developmentally based, and not associated with oxygen

1127deprivation or mechanical injury occurring in the course of

1136labor, delivery, or the immediate postpartum period. In so

1145concluding, Dr. Duchowny observed that the impa irments

1153demonstrated by Tristen are consistent with the syndrome of

1162ataxic ce rebral palsy, a developmentally - based brain disorder

1172acquired before the onset of labor. Dr. Duchowny was also of

1183the opinion that the medical records did not reveal evidence of

1194a substantial mechanical or hypoxic event having occurred during

1203labor and delivery. As for the significance of Tristen's

1212impairments, it was Dr. Duchowny's opinion that Tristen is

1221permanently and substantially physically impaired. However,

1227mentally, Tri sten is not similarly affected or, stated

1236otherwise, he is not permanently and substantially mentally

1244impaired. Notably, Dr. Duchowny's opinions were uncontroverted,

1251grossly consistent with the record, and credible.

1258CONCLUSIONS OF LAW

12616. The Division o f Administrative Hearings has

1269jurisdiction over the parties to, and the subject matter of,

1279these proceedings. § 766.301, et seq. , Fla. Stat .

12887. The Florida Birth - Related Neurological Injury

1296Compensation Plan was established by the Legislature "for the

1305pu rpose of providing compensation, irrespective of fault, for

1314birth - related neurological injury claims" relating to births

1323occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

13348. The injured infant, her or his personal representative,

1343parents, d ependents, and next of kin, may seek compensation

1353under the Plan by filing a claim for compensation with the

1364Division of Administrative Hearings. §§ 766.302(3), 766.303(2),

1371and 766.305(1), Fla. Stat. The Florida Birth - Related

1380Neurological Injury Compensa tion Association, which administers

1387the Plan, has "45 days from the date of service of a complete

1400claim . . . in which to file a response to the petition and to

1415submit relevant written information relating to the issue of

1424whether the injury is a birth - rela ted neurological injury."

1435§ 766.305(4), Fla. Stat.

14399. If NICA determines that the injury alleged in a claim

1450is a compensable birth - related neurological injury, it may award

1461compensation to the claimant, provided that the award is

1470approved by the administ rative law judge to whom the claim has

1482been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

1493NICA disputes the claim, as it has in the instant case, the

1505dispute must be resolved by the assigned administrative law

1514judge in accordance with the pro visions of C hapter 120, F lorida

1527Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

153510. In discharging this responsibility, the administrative

1542law judge must make the following determination based upon the

1552available evidence:

1554(a) Whether the injury claimed is a

1561birth - related neurological injury. If the

1568claimant has demonstrated, to the

1573satisfaction of the administrative law

1578judge, that the infant has sustained a brain

1586or spinal cord injury caused by oxygen

1593deprivation or mechanical injury and that

1599t he infant was thereby rendered permanently

1606and substantially mentally and physically

1611impaired, a rebuttable presumption shall

1616arise that the injury is a birth - related

1625neurological injury as defined in s.

1631766.303(2).

1632(b) Whether obstetrical services wer e

1638delivered by a participating physician in

1644the course of labor, delivery, or

1650resuscitation in the immediate postdelivery

1655period in a hospital; or by a certified

1663nurse midwife in a teaching hospital

1669supervised by a participating physician in

1675the course of labor, delivery, or

1681resuscitation in the immediate postdelivery

1686period in a hospital.

1690§ 766.309(1), Fla. Stat. An award may be sustained only if the

1702administrative law judge concludes that the "infant has

1710sustained a birth - related neurological injury a nd that

1720obstetrical services were delivered by a participating physician

1728at birth." § 766.31(1), Fla. Stat.

173411. Pertinent to this case, "birth - related neurological

1743injury" is defined by Section 766.302(2), Florida Statutes,

1751to mean:

1753injury to the brain o r spinal cord of a live

1764infant weighing at least 2,500 grams for a

1773single gestation or, in the case of a

1781multiple gestation, a live infant weighing

1787at least 2,000 grams at birth caused by

1796oxygen deprivation or mechanical injury

1801occurring in the course of l abor, delivery,

1809or resuscitation in the immediate

1814postdelivery period in a hospital, which

1820renders the infant permanently and

1825substantially mentally and physically

1829impaired. This definition shall apply to

1835live births only and shall not include

1842disability or death caused by genetic or

1849congenital abnormality.

185112. As the proponent of the issue, the burden rested on

1862Petitioners to demonstrate that Tristen suffered a "birth -

1871related neurological injury." § 766.309(1)(a), Fla. Stat. S ee

1880also Balino v. Departm ent of Health and Rehabilitative Services ,

1890348 So. 2d 349, 350 (Fla. 1st DCA 1997)("[T]he burden of proof,

1903apart from statute, is on the party asserting the affirmative

1913issue before an administrative tribunal.")

191913. Here, the proof failed to support the c onclusion that,

1930more likely than not, Tristen's neurologic impairment was the

1939result of a brain or spinal cord injury caused by oxygen

1950deprivation or mechanical injury occurring in the course of

1959labor, delivery, or resuscitation in the immediate postdeliv ery

1968period in the hospital, or that Tristen was permanently and

1978substantially mentally impaired. Consequently, given the

1984provisions of Section 766.302(2), Florida Statutes, Tristen does

1992not qualify for coverage under the Plan. See also §§ 766.309(1)

2003and 766.31(1), Fla. Stat.; Humana of Florida, Inc. v. McKaughan ,

2013652 So. 2d 852, 859 (Fla. 5th DCA 1995)("[B]ecause the Plan

2025. . . is a statutory substitute for common law rights and

2037liabilities, it should be strictly constructed to include only

2046those subj ects clearly embraced within its terms."), approved ,

2063Association v. McKaughan , 668 So. 2d 974, 979 (Fla. 1996);

2073Florida Birth - Related Neurological Injury Compensation

2080Association v. Florida Division of Administrative Hearings ,

2087686 So. 2d 1349 (Fla. 1997)(The Plan is written in the

2098conjunctive and can only be interpreted to require both

2107substantial mental and physical impairment.)

211214. Where, as here, the administrative law judge

2120determines that ". . . t he injury alleged is not a birth - related

2135neurological injury . . . she or he [is required to] enter an

2148order [to such effect] and . . . cause a copy of such order to

2163be sent immediately to the parties by registered or certified

2173mail." § 766.309(2), Fla. S tat. Such an order constitutes

2183final agency action subject to appellate court review.

2191§ 766.311(1), Fla. Stat.

2195CONCLUSION

2196Based on the foregoing Findings of Fact and Conclusions of

2206Law, it is

2209ORDERED that the claim for compensation filed by

2217Victoria H ill and Keith Onofry, as parents and next best friends

2229of Tristen Onofry, a minor, is dismissed with prejudice.
