87STATEMENT OF THE ISSUE
91The issue is whether Respondent discriminated against
98Petitioner on the basis of his race in violation of
108Section 760.10, Florida Stat utes (2003).
114PRELIMINARY STATEMENT
116On June 30, 2004, the Florida Commission on Human Relations
126(Commission) notified Petitioner that the Commission had
133determined there was no reasonable cause to believe an unlawful
143employment practice had occurred. Peti tioner filed a Petition
152for Relief on July 9, 2004, and the Commission referred the
163matter to DOAH to conduct an administrative hearing. At the
173hearing, Petitioner did not appear and did not present any
183testimony.
184Respondent submitted three exhibits for a dmission into
192evidence and called no witnesses to testify. The identity of
202the exhibits and the rulings regarding each are reported in the
213Transcript of the hearing filed with DOAH on February 16, 2005.
224Respondent timely filed its proposed recommended or der (PRO) on
234February 24, 2005. Petitioner did not file a PRO.
243FINDINGS OF FACT
2461. No findings are made concerning the alleged
254discrimination. Petitioner did not appear and did not submit
263any evidence to support findings of fact.
2702. Findings are req uired concerning the adequacy of notice
280of the administrative hearing. On March 9, 2005, Petitioner,
289through his qualified representative, filed Petitioner's Request
296for Final Hearing and Petitioner's Request for the Reopening of
306Discovery.
3073. Petition er received adequate notice of the
315administrative hearing. The Commission referred this matter to
323DOAH by cover letter dated July 19, 2004. DOAH assigned the
334matter to ALJ Fred L. Buckine and transferred it to the
345undersigned on October 26, 2004.
3504. T he record shows that the two ALJs issued 10 notices or
363orders in this proceeding between August 12 and December 1,
3732004. 1 DOAH properly addressed, stamped, and delivered each
382notice and order by U.S. mail to the address of record for
394Petitioner, 1527 Sout h Central Avenue, Apopka, Florida 32703.
403On and after August 30, 2004, DOAH also delivered a copy of each
416notice and order by U.S. mail to the qualified representative.
426The address of record for the qualified representative is the
436same as that for Petit ioner. No notice or order was returned to
449DOAH as undelivered.
4525. During the four months preceding the administrative
460hearing, Petitioner declined to participate in discovery due to
469the poor health of his qualified representative. Respondent
477requested two continuances in an effort to complete discovery.
486Petitioner declined to complete discovery, and Respondent moved
494to dismiss for failure to complete discovery. Respondent
502alleged the qualified representative was "physically
508unqualified" to represent Petitioner.
5126. The undersigned denied Respondent's motion to dismiss
520and granted a motion for continuance filed by Petitioner on
530November 30, 2004. The motion for continuance was part of a
541document entitled, "Petitioner's Request for Continuance of
548Fi nal Hearing and Injunctive Relief Against Retaliatory
556Termination" (Petitioner's Motion for Continuance).
561Petitioner's Motion for Continuance discusses numerous grounds
568for the continuance and only parenthetically states that his
577qualified representative was in poor health. The Order Granting
586Continuance and Re - scheduling hearing included the following
595notice to Petitioner:
598The undersigned deems Petitioner's motion
603for continuance to be based on the illness
611of Petitioner's Qualified Representative.
615Petit ioner has had ample time to obtain a
624replacement for his Qualified Representative
629or to proceed pro se . The undersigned will
638grant no further continuances based on the
645illness of the Petitioner's Qualified

651Order Granting Continuance and Re - scheduling Hearing ,

6637. Petitioner's Motion for Continuance expressly admits
670that Petitioner received delivery of relevant documents in this
679proceeding. In relevant part, Petitioner states:
6851. On or about November 25 and 26 , 2004,
694the Friday and Saturday following
699Thanksgiving, Petitioner, who receives the
704mail in this case at his address for both
713him and his Qualified Representative (who
719has been repeatedly hospitalized during this
725case for the sudden occurrence of life -
733thr eatening congestive heart failure),
738received in those days' mail the following
745pleadings. . . . (emphasis added)
751Petitioner's Motion for Continuance at 6.
7579. Petitioner had actual notice of the administrative
765hearing. During the week preceding the hea ring, staff at DOAH
776contacted Petitioner, in the normal course of prehearing
784procedure, and provided information concerning the date and time
793of the hearing.
79610. Petitioner had ample time between the last order
805continuing the administrative hearing and t he date of the
815hearing to file any motion for relief to which he was entitled
827for good cause or extreme emergency. Petitioner did not file a
838motion for relief. Petitioner did not represent that no other
848person was competent or capable of representing Pet itioner
857except for his qualified representative.
86211. At the administrative hearing, the undersigned
869telephoned Petitioner at a telephone number of record.
877Petitioner answered, and the undersigned asked Petitioner if he
886intended to attend the hearing. Petitioner refused to answer
895and directed the undersigned to Petitioner's qualified
902representative.
90312. DOAH provided Petitioner and his qualified
910representative with adequate notice of the administrative
917hearing, and the undersigned conducted the hear ing. Petitioner
926chose to neither request a continuance of the hearing or attend
937the hearing. Petitioner now seeks to begin the process anew by
948filing post - hearing motions for an administrative hearing. The
958record does not support the remedy requested by Petitioner.
967CONCLUSIONS OF LAW
97013. DOAH has jurisdiction over the parties and the subject
980matter of this proceeding. §§ 120.569 and 120.57(1), Fla. Stat.
990(2003). The parties received adequate notice of the
998administrative hearing.
100014. The Notice of H earing sent to the address of record
1012for Petitioner and his qualified representative, like the other
1021eight other notices and orders issued in this proceeding, was
1031properly addressed, stamped, and mailed and was not returned.
1040Mail properly addressed, stamp ed, and mailed is presumed to be
1051received by the addressee if not returned. Brown v. Giffen
1061Industries, Inc. , 281 So. 2d 897, 900 (Fla. 1973).
107015. There is no direct evidence of discrimination in this
1080case. In the absence of such evidence, discrimin ation must be
1091shown by circumstantial evidence.
109516. The burden of proof in discrimination cases involving
1104circumstantial evidence is set forth in McDonnell Douglas Corp.
1113v. Green , 411 U.S. 792, 802 - 03 (1973). Petitioner has the
1125initial burden of establis hing by a preponderance of the
1135evidence a prima facie case of discrimination. Failure to
1144establish a prima facie case of discrimination ends the inquiry.
1154See Ratliff v. State , 666 So. 2d 1008, 1012 n.6 (Fla. 1st DCA
11671996), aff'd , 679 So. 2d 1183 (1996)( c iting Arnold v. Burger
1179Queen Systems , 509 So. 2d 958 (Fla. 2d DCA 1987)).
1189RECOMMENDATION
1190Based on the foregoing Findings of Fact and Conclusions of
1200Law, it is
1203RECOMMENDED that the Commission enter a final order
1211dismissing the Petition for Relief.
