37Administrative Law Judge Don W. Davis of the Division of
47Administrative Hearings (DOAH) held a formal hearing in this cause

104STATEMENT OF THE ISSUE
108The issue for determination is whether Petitioner was
116subjected to an unlawful employment pract ice by Respondent due to
127Petitioner's race, age, sex, or as retaliation in violation of
137Section 760.10, Florida Statutes.
141PRELIMINARY STATEMENT
143Petitioner filed a Charge of Discrimination against
150Respondent with the Florida Commission on Human Relatio ns (FCHR)
160on April 22, 2003, alleging her termination by Respondent was the
171result of discrimination on the basis of her age, race, color, sex
183and age.
185On or about June 30, 2004, the FCHR issued its determination:
196No Cause.
198On or about July 26, 2004, Petitioner filed a Petition for
209Relief with the FCHR. Subsequently, on or about August 2, 2004,
220the case was forwarded to DOAH for formal proceedings.
229During the final hearing, Petitioner testified in her own
238behalf and presented two witnesses . Respondent presented one
247witness and three exhibits.
251No transcript of the final hearing was provided. Both
260parties were offered the opportunity to file proposed findings of
270facts and proposed conclusions of law. Respondent filed a
279Proposed Recommend ed Order, which has been reviewed and considered
289in the preparation of this Recommended Order. No post - hearing
300submission was filed on behalf of Petitioner.
307FINDINGS OF FACT
3101. Respondent employed Petitioner, a 56 - year - old African -
322American female, a s a Food Support Worker at Florida State
333Hospital in Chattahoochee, Florida, at all times relevant to
342these proceedings.
3442. Petitioner was promoted to the position of Food Service
354Worker on May 10, 2002, with probationary status until May 10,
365200 3.
3673. On February 12, 2003, Petitioner was terminated from
376her employment for failure to satisfactorily complete her
384probationary period in the career service.
3904. In the course of her employment with Florida State
400Hospital, Petitioner was a ware of the strict safety guidelines
410implemented by Respondent to protect employees from injury.
418Petitioner also knew that violation of the safety rules could
428result in dismissal of an erring employee. Violations of these
438policies had resulted in dismiss al of both non - minority and
450minority employees in the past.
4555. On February 9, 2003, due to an unsafe act and violation
467of Respondents safety rules, Petitioner proceeded to cut the
476tip of her left thumb in the process of slicing cabbage.
487Petitio ner was not using a cutting glove, a mandatory
497requirement of the safety rules.
5026. As a result of this rule violation, Respondent
511terminated Petitioners employment on February 12, 2003.
5187. At final hearing, Petitioner admitted the cutting
526injury to her finger, but contended that termination of
535employment had not been effected for other younger white
544employees for similar offenses in the past. These allegations
553of Petitioner were non - specific and uncorroborated; they are not
564credited.
565CON CLUSIONS OF LAW
5698. The Division of Administrative Hearings has jurisdiction
577over the parties to, and the subject matter of, these proceedings.
588§§ 120.56(9) and 120.57(1), Fla. Stat.
5949. Chapter 760, Florida Statutes, the "Florida Civil
602Rights A ct of 1992," provides security from discrimination based
612upon race, color, religion, sex, national origin, age, handicap,
621or marital status.
62410. The adverse effectuation of an employees
631compensation, conditions and privileges of employment on the
639b asis of race is an unlawful employment practice.
64811. The burden of proof rests with Petitioner to show a
659prima facie case of employment discrimination. After such a
668showing by Petitioner, the burden shifts to Respondent to
677articulate a nondiscrimina tory reason for the adverse action.
686If Respondent is successful and provides such a reason, the
696burden shifts again to Petitioner to show that the proffered
706reason for adverse action is pre - textual. School Board of Leon
718County v. Hargis , 400 So. 2d 103 ( Fla. 1st DCA 1981).
73012. The testimony and other evidence produced by
738Petitioner are not sufficient to establish that racial
746discrimination by employees or supervisors of Respondent toward
754Petitioner occurred. Petitioner failed to show that Respondent s
763basis for her termination, violation of safety rules, was pre -
774textual in any way.
77813. Petitioner violated safety rules established by
785Respondent and suffered a termination of employment as a
794consequence of that violation.
798RECOMMENDATION
799Based on the foregoing Findings of Fact and Conclusions of
809Law, it is
812RECOMMENDED:
813That a Final Order be entered dismissing the Petition for
823Relief.
