107STATEMENT OF THE ISSUE

111At issue in this proceeding is whether a citation and

121imposition of a $1,500.00 fine for installing a septic tank

132without a permit was properly imposed on Respondent, Paul Ware,

142a/k/a Paul Montgomery - Ware, by Petitioner , the Department of

152Health, Polk County Health Department (the "Department").

160PRELIMINARY STATEMENT

162This cause arose on July 1, 2004, when the Department

172served a citation on Respondent for failure to obtain a permit

183before installing an on - site sewage tr eatment and disposal

194system ("OSTD system"), commonly called a septic tank system, in

206violation of Subsections 381.0065(4) and 386.041(1)(b), Florida

213Statutes (2003), and Florida Administrative Code Rule

22064E - 6.003(1). The citation assessed a fine and orde red

231Respondent to pay $1,500.00 for the cited violations. The

241citation further informed Respondent of his rights to a hearing

251pursuant to Chapter 120, Florida Statutes (2003). Respondent

259indicated that he did not accept the Department's intended

268action, and the Department forwarded the case to the Division of

279Administrative Hearings on August 17, 2004. The matter was set

289for hearing on October 13, 2004.

295On September 1, 2004, Respondent filed a "Petition for

304Voluntary Dismissal," which was denied by Order dated

312September 28, 2004. On October 7, 2004, Respondent filed a

322pleading titled, "Notice and Demand In Re: Order," in which

332Respondent raised constitutional issues beyond the scope of this

341administrative proceeding and further challenged the style of

349th e case, which at the time characterized Mr. Ware as the

361Petitioner.

362The final hearing was convened as scheduled. The

370Department was present and prepared to proceed. Respondent did

379not appear. The hearing was delayed for 20 minutes to afford

390Respondent a n opportunity to appear. At the outset of the

401hearing, the undersigned declined to address the constitutional

409issues raised in Respondent's "Notice and Demand," but granted

418Respondent’s motion to change the style of the case to reflect

429the actual posture of the parties. At the hearing, the

439Department proffered the testimony of Susan Patlyek, an

447environmental specialist with the Department, and William A.

455Walker, Respondent's neighbor and a witness to the construction

464of the septic system in question. The Department's Exhibits 1

474through 7 were proffered at the hearing.

481Respondent never appeared during the course of the hearing.

490On October 15, 2004, the undersigned issued an Order to Show

501Cause, providing Respondent ten days in which to explain his

511absenc e from the hearing. On October 28, 2004, Respondent filed

522a reply that reasserted his constitutional issues, but otherwise

531failed to explain his absence from the hearing. The

540Department’s proffered testimony and exhibits are, therefore,

547ADMITTED. Subseq uent to the hearing, the Department elected to

557submit a Proposed Recommended Order which has been considered in

567the rendition of this Recommended Order.

573FINDINGS OF FACT

5761. Respondent is the owner of three contiguous lots in

586Polk County (Bevington Manor , PB 20 PG 47, Lots 100 through

597102), purchased via tax deed recorded on October 21, 2003.

607Respondent's lots are surrounded by property owned by Irma

616Walker, whose son, William Walker, testified at the hearing.

6252. Respondent apparently intended to develo p his lots as a

636commercial enterprise and had erected a Quonset - type structure

646on the property. From his mother's adjoining property,

654Mr. Walker regularly observed Respondent's activities.

660Mr. Walker testified that Respondent was using his property to

670op erate a motorcycle repair shop.

6763. On June 4, 2004, Mr. Walker observed Respondent using a

687backhoe on his property. Mr. Walker testified that Respondent

696was installing a septic tank. Mr. Walker told his mother, who

707then initiated inquiries as to whether Respondent had a permit

717to install a septic tank. When her inquiries met with a

728negative response, Ms. Walker called in a complaint to the

738Department.

7394. On June 7, 2004, the Department sent environmental

748specialist Susan Patlyek to the site. Ms. Patly ek observed

758infiltrator chambers on the site. Infiltrator chambers are used

767only in connection with OSTD systems. Ms. Patlyek also observed

777a recently excavated area and a rented backhoe, commonly used to

788dig out areas for septic tank installation. It w as obvious to

800Ms. Patlyek that a septic tank and drainfield had been installed

811on Respondent's property, though no permit had been issued by

821the Department allowing installation of an OSTD system.

8295. Installation of an OSTD system without a permit

838constit utes a sanitary nuisance. The Department sent a letter

848to Respondent dated June 8, 2004, advising him of the need to

860abate the nuisance by obtaining a permit. With the letter, the

871Department enclosed a blank application form that Respondent

879could have co mpleted and returned to the Department's permitting

889office.

8906. Respondent replied by contending that the Department

898lacked jurisdiction over activities on his land and suggested

907that the Department initiate court action. Respondent also

915returned the appl ication form in its original blank form.

9257. The Department then issued Respondent a citation for

934violations of Subsection 381.0065(4), Florida Statutes (2003),

941and Florida Administrative Code Rule 64E - 6.003(1), constructing

950an OSTD system without a permit ; and for a violation of

961Subsection 386.041(1)(b), Florida Statutes (2003), maintaining a

968sanitary nuisance. The citation provides for a $1,500.00 fine.

9788. The Department's citation also informed Respondent of

986his right to a hearing pursuant to Chapter 1 20, Florida Statutes

998(2003). Respondent contends that the relegation of this matter

1007to an administrative forum is unconstitutional.

1013CONCLUSIONS OF LAW

10169. The Division of Administrative Hearings has

1023jurisdiction of the subject matter of and the parties to this

1034proceeding. §§ 1 20.569 and 120.57(1), Fla. Stat. (2004).

1043Respondent's constitutional claims as to the jurisdiction of

1051this tribunal are beyond the scope of this proceeding. Key

1061Haven Associated Enterprises, Inc. v. Board of Trustees of the

1071Interna l Improvement Trust Fund , 427 So. 2d 153, 157 (Fla. 1982)

1083(circuit court, not administrative tribunal, is the proper forum

1092to adjudicate facial constitutionality of a statute).

1099Department of Revenue v. Young American Builders , 330 So. 2d

1109864, 865 (Fla. 1s t DCA 1976).

111610. The Department has the authority granted by Section

1125381.0065, Florida Statutes (2003), to issue permits, inspect

1133sites, issue citations, and impose fines for violations of

1142adopted rules, which govern OSTD systems and their installation

1151an d operation.

115411. Subsection 381.0065(4), Florida Statutes (2003),

1160provides as follows, in relevant part:

1166A person may not construct, repair, modify,

1173abandon, or operate an onsite sewage

1179treatment and disposal system without first

1185obtaining a permit appr oved by the

1192department. . . .

119612. Florida Administrative Code Rule 64E - 6.003(1) states

1205in part:

1207No portion of an onsite sewage treatment and

1215disposal system shall be installed,

1220repaired, altered, modified, abandoned or

1225replaced until an 'onsite sewage t reatment

1232and disposal system construction permit' has

1238been issued on Form DH4016. . . .

124613. Subsection 386.041(1)(b), Florida Statutes (2003),

1252provides as follows:

1255(1) The following conditions existing,

1260permitted, maintained, kept, or caused by

1266any indi vidual, municipal organization, or

1272corporation, governmental or private, shall

1277constitute prima facie evidence of

1282maintaining a nuisance injurious to health:

1288* * *

1291(b) Improperly built or maintained septic

1297tanks, water closets, or privies. . . .

130514. A person or property owner who occupies a dwelling

1315which has an illegal, un - permitted connection or suffers a

1326dwelling on the permitted premises to be served by a sewage

1337system, or portion thereof, which is not properly permitted and

1347approved, is subject to an Order of Correction and a fine in

1359accordance with Subsection 381.0065(5), Florida Statutes (2003).

1366The fine may not exceed $500.00 for each violation. Each day of

1378a violation constitutes a separate violation for which a

1387citation may be issued. In th e instant situation, the

1397Department issued a single citation and, therefore, may impose

1406only a $500.00 fine.

1410RECOMMENDATION

1411RECOMMENDED that Petitioner, the Department of Health, Polk

1419County Health Department, enter a final order imposing a $500.00

1429fine for the violations described in the above Findings of Fact

1440and Conclusions of Law.
