128Whether Respondent, Garrison Irrigation, Inc., failed to

172PRELIMINARY STATEMENT

174On July 20, 2004, Petitioner, C .M. Payne and Son, Inc.,

185filed a complaint with the Department of Agriculture and

194Consumer Services (Department), alleging that Respondent,

200Garrison Irrigation, Inc., failed and refused to pay four

209invoices, totaling $1,540.80, 1 for four pallets of Bahia s od,

221after repeated calls and attempts were made to collect those

231four outstanding invoices.

234On August 12, 2004, the Department noticed the Commissioner

243of Agriculture under the provisions of the Agriculture Bond and

253License Law, Sections 604.15 through 604 .34, Florida Statutes

262(2004), of Petitioner's complaint.

266On August 24, 2004, Respondent, Joe Garrison,

273president/owner of Garrison Irrigation, Inc., filed a response

281to the compliant filed by Petitioner.

287On September 9, 2004, the complaint was referred by the

297Department to the Division of Administrative Hearings where it

306was assigned to the undersigned Administrative Law Judge and set

316for hearing. On that same date, the Initial Order was entered

327and forwarded to all parties of interest.

334On September 21, 20 04, Respondent, Continental Casualty

342Company, filed a letter declining to file an answer or move in

354any other manner on this matter at this time.

363On September 23, 2004, a Notice of Hearing, scheduling the

373final hearing for October 27, 2004, in Sebring, Flo rida, and an

385Order of Pre - hearing Instructions were entered.

393At the formal hearing on October 27, 2004, no one appeared

404on behalf of Respondents, Garrison Irrigation, Inc., and

412Continental Casualty Company.

415The undersigned called his secretary who telephon ed

423Respondent, Joseph L. Garrison, and was informed that he had

433forgotten the hearing and the date, was out - of - pocket, and would

447not be attending. Jennifer Payne, wife of John Payne, president

457of C.M. Payne and Son, Inc., appeared on his behalf and gave

469t estimony.

471The hearing was recorded and transcribed. Petitioner was

479advised of the option and the time frame in which to file a

492proposed recommended order and declined to do so. The

501Transcript of the hearing was filed on November 5, 2004.

511Neither party filed a proposed recommended order.

518FINDINGS OF FACT

521Based upon observation of the witness and her demeanor

530while testifying, the documents received into evidence, and the

539entire record of this proceeding, the following relevant and

548material findings of fact are determined:

5541. At all times material to this proceeding, Petitioner,

563C.M. Payne and Son, Inc., was a producer of agricultural

573products as that term is defined in Subsection 604.15(5),

582Florida Statutes (2004).

5852. At all times material to this pro ceeding, Respondent,

595Garrison Irrigation, Inc. (Garrison), was licensed as a dealer

604in agriculture products as that term is defined in Subsection

614604.15(1), Florida Statutes (2004). Respondent was licensed

621under number 13653, supported by Bond No. 9292377 54 in the

632amount of $10,000; written by Respondent, Continental Casualty

641Company, as Surety (Continental); Inception Date: December 4,

6492003; Expiration Date: December 3, 2004; and Execution Date:

658December 4, 2003.

6613. At all times material, Continental i s the surety which

672issued Garrison a surety bond.

6774. On January 23, 2004, Petitioner sold 16 pallets of

687Bahia sod to Garrison and, on Invoice 20027, billed Garrison a

698total of $599.20 for the 16 pallets of sod.

7075. On January 26, 2004, Petitioner sold 32 pallets of

717Bahia sod to Garrison and, on Invoice 20033, billed Garrison a

728total of $1,198.40 for the 32 pallets of sod.

7386. On January 27, 2004, Petitioner sold 16 pallets of

748Bahia sod to Garrison and, on Invoice 20039, billed Garrison a

759total of $599.20 for the 16 pallets of sod.

7687. On February 2, 2004, Petitioner sold 16 pallets of

778Bahia sod to Garrison and, on Invoice 20044, billed Garrison a

789total of $599.20 for the 16 pallets of sod.

7988. The terms of the sale between Petitioner and Garrison

808were for net payment for products sold within 30 days after the

820invoice date.

8229. Garrison did not appear at the hearing to contest or

833otherwise refute the charges alleged in Petitioner's complaint.

84110. Garrison is indebted to Petitioner in the amount of

851$2,996.00 for Bahia sod purchases from Petitioner on

860January 23, 26, and 27, 2004, and February 2, 2004. Garrison

871has failed to pay Petitioner for the sod purchases.

880CONCLUSIONS OF LAW

88311. The Division of Administrative Hearings has

890jurisdiction over the subject matter of and the parties to this

901action pursuant to Subsection 120.57(1), Florida Statutes

908(2004).

90912. The authority of the Department is derived from

918Chapter 604, Florida Statutes (2004).

92313. Petitioner is an agricultural producer within the

931meaning o f Subsection 604.15(5), Florida Statutes (2004).

93914. Garrison is an agricultural dealer as that term is

949defined in Subsection 604.15(1), Florida Statutes (2004).

95615. During all times material, Continental issued a bond

965to Garrison for agricultural produc ts pursuant to

973Section 604.20, Florida Statutes (2004).

97816. Garrison is indebted to Petitioner in the amount of

988$2,996.00 for the purchases of Bahia sod from Petitioner on

999January 23, 26, and 27, 2004, and February 2, 2004.

1009RECOMMENDATION

1010Based on the fo regoing Findings of Fact and Conclusions of

1021Law, it is

1024RECOMMENDED that the Department issue its final order

1032requiring that Respondent, Garrison Irrigation, Inc., pay to

1040Petitioner, C. M. Payne and Son, Inc., the amount of $2,996.00

1052for the purchases of Ba hia sod from Petitioner on

1062January 23, 26, and 27, 2004, and February 2, 2004.

1072It is further RECOMMENDED that if Respondent, Garrison

1080Irrigation, Inc., fails to comply with the order directing

1089payment, the Department shall call upon the surety, Continenta l

1099Casualty Company, to pay over to the Department from funds out

1110of the surety certificate, the amount needed to satisfy the

1120indebtedness.
