112STATEMENT OF THE ISSUE

116The issue presented is whether case management and

124homemaker services for Petitioner should be terminated.

131PRELIMINARY STATEMENT

133B y correspondence dated August 20, 2004, Respondent

141Department of Children and Family Services advised Petitioner

149Ellen Nichols that it was terminating the case management and

159homemaker services it was providing to her, and Petitioner

168timely requested an ad ministrative hearing regarding that

176determination. This cause was thereafter transferred to the

184Division of Administrative Hearings to conduct the evidentiary

192proceeding.

193Petitioner Ellen Nichols testified on her own behalf. The

202Department presented the testimony of Joan Cecil,

209Latonya Snowden, Debra Niles, Judy Rose, and Judy Amison.

218Additionally, the Department's Exhibits 1 - 8 were admitted in

228evidence.

229Only the Department filed a proposed recommended order

237after the conclusion of the final hearing. Th at document has

248been considered in the entry of this Recommended Order.

257FINDINGS OF FACT

2601. In June 2004, the Department determined that Petitioner

269was eligible for services pursuant to its Community Care for

279Disabled Adults Program. Pursuant to its con tract with the

289Department, Gulf Coast Jewish Family Services, Inc., d/b/a Gulf

298Coast Community Care began delivering those services.

3052. Petitioner's apartment was dirty and cluttered, and she

314was in danger of being evicted from her Section 8 federally -

326s ubsidized housing. Petitioner began receiving case management

334and homemaker services, with the stated goal of cleaning and

344organizing her apartment so that she could avoid eviction.

3533. The case management services consisted of determining

361and managing the appropriate services for Petitioner. The

369homemaker services consisted of a helper going to Petitioner's

378apartment once a week for three hours to teach and assist her in

391keeping her apartment clean and uncluttered.

3974. The services rendered to Petit ioner were helpful and

407encouraged her to gradually discard much of her clutter so that

418it was easier to keep the apartment clean. When Gulf Coast

429employees came to her apartment, she was involved in sorting and

440discarding unneeded items and the apartment appeared much

448neater. Although it was difficult for her, Petitioner was able

458to get the apartment ready for her Section 8 inspection,

468primarily by herself.

4715. In August 2004, Gulf Coast determined that the stated

481goal of organizing and cleaning Petition er's apartment so that

491she could avoid eviction had been achieved. Both Petitioner's

500case manager and her homemaker services supervisor visited her

509apartment and determined that Petitioner was able to keep the

519apartment up to standards.

5236. Based upon t he achievement of the stated goal, the

534Department notified Petitioner that the case management and

542homemaker services were being terminated.

5477. Although Petitioner testified at the final hearing that

556she had developed a "heart condition" and was being en rolled in

568a cardiac rehabilitation program, no evidence was offered,

576either expert or non - expert, that her "heart condition" would

587prevent her from keeping her apartment clean and uncluttered.

596Rather, Petitioner admitted that no doctor had told her she

606sh ould not perform housework.

611CONCLUSIONS OF LAW

6148. The Division of Administrative Hearings has

621jurisdiction over the subject matter hereof and the parties

630hereto. §§ 120.569 and 120.57(1), Fla. Stat.

6379. Section 410.604(1), Florida Statutes, authoriz es the

645Department to operate or contract for a community care for

655disabled adults program, and Section 410.604(2) establishes the

663need for the Department to prioritize services due to limited

673funding for the program.

67710. The Department's contract with Gu lf Coast specifies on

687page 14 that the parameters of service delivery are detailed,

697and incorporated by reference, in the Department's CF Operating

706Procedure No. 140 - 8. That latter document provides on page 39

718in paragraph 6 - 5 that a client's case must be closed when

731services are no longer needed due to improvement.

73911. Petitioner received services to assist her in cleaning

748her apartment and disposing of clutter so that she could pass

759her Section 8 housing inspection. Petitioner's apartment passed

767in spection. Therefore, the goal of the services was met, and

778Petitioner no longer needs those services. Although Petitioner

786desires that the services continue, no evidence was offered that

796there was a need, not just a desire. The services should,

807therefor e, be terminated.

811RECOMMENDATION

812Based on the foregoing Findings of Fact and Conclusions of

822Law, it is

825RECOMMENDED that a final order be entered finding that

834Petitioner is no longer eligible for services and terminating

843the case management and homemaker s ervices provided to her.
