163Petitioner charged Respondent with violating Chapter 477,
170Florida Statutes, pertaining to the practice of cosmetology.

222proposed findings of fact and conclusions of law. Petitioner
231timely filed its Proposed Recommended Order. Respondent has
239not fi led a proposed recommended order.
246FINDINGS OF FACT
249Based upon the evidence and the testimony of witnesses
258presented, and the entire record in this proceeding, the
267following facts were established:
2711. Petitioner is the state agency charged with
279regulating the operation of establishments providing
285cosmetology services, including hair care and styling, to the
294public. Petitioner's regulatory authority derives from
300Chapter 477, Florida Statutes.
3042. Respondent has at all times material to this case
314been subjec t to Petitioner's jurisdiction by virtue of its
324license to operate Mayelin Unisex Beauty Salon (Respondent or
333Mayelin), a hair salon located in North Miami Beach, Florida.
3433. At all times material to this case, Respondent was
353under a legal duty to refrai n from permitting unlicensed
363individuals to perform cosmetology services, including hair
370care, upon members of the public.
3764. On or about April 26, 2003, Abdel Cedeno (Cedeno), a
387duly - qualified inspector employed by Petitioner and whose job
397includes monit oring compliance with Chapter 477, Florida
405Statutes, went to Mayelin's during its regular business hours
414for the purpose of conducting a routine inspection.
4225. On that occasion, Cedeno observed one Yomaira Payero
431(Payero) performing cosmetology services o n a customer.
4396. More specifically, Payero was observed styling or
447arranging the customer's hair, utilizing a blow - dryer and
457other cosmetology implements. Payero was not licensed to
465perform such services within Florida.
4707. At all times material to this case, Payero was a paid
482employee of Respondent. Payero's activities, which Respondent
489authorized and facilitated, constituted a violation by
496Respondent of Section 477.0265(1)(d), Florida Statutes.
502CONCLUSIONS OF LAW
5058. The Division of Administrative H earings has
513jurisdiction over the subject matter and parties in this
522proceeding. § 120.57, Fla. Stat.
5279. The burden of proof is on Petitioner to show by clear
539and convincing evidence that Respondent committed the
546violation alleged in the administrative complaint and the
554reasonableness of any proposed penalty. Ferris v. Turlington ,
562510 So. 2d 292 (Fla. 1987); Department of Banking and Finance,
573Division of Securities and Investor Protection v. Osborne
581Stern and Company , 670 So. 2d 932 (Fla. 1996).
59010. Pe titioner has fulfilled its burden of proof.
59911. The state has a substantial interest in assuring the
609health and safety of patrons of establishments such as
618Mayelin's where customers seek services aimed at enhancing the
627appearance of their hair or skin. Businesses such as
636Respondent's have a high potential for spreading disease if
645employees are not trained in and compliant with sanitation and
655other principles taught to persons who seek a state license to
666engage in the businesses regulated by Chapter 477, Florida
675Statues.
67612. Respondent offered no mitigating factors which would
684militate against penalties at the upper end of those
693authorized by law for its violation. § 477.029, Fla. Stat.
703RECOMMENDATION
704Based on the foregoing Findings of Fact and Conclusi ons
714of Law, it is RECOMMENDED that a final order be issued
725assessing Respondent an administrative penalty in the amount
733of $500.
