145STATEMENT OF THE ISSUES
149The issues for determination are whether Petitioner is
157entitled to a reasonable attorney's fee, pursuant to
165Section 57.105, Florida Stat utes (2004), for time required to
175respond to an allegedly frivolous motion, and, if so, in what
186amount.
187PRELIMINARY STATEMENT
189On October 25, 2004, Petitioner filed an Amended Complaint
198against Respondent, Dixie Growers, Inc. (Dixie Growers), with
206the Depa rtment of Agriculture and Consumer Services
214(Department). Dixie Growers requested an administrative
220hearing, and the Department referred the matter to DOAH to
230conduct the hearing.
233At the hearing, Petitioner testified and submitted two
241exhibits for admissi on into evidence. Dixie Growers called two
251witnesses and submitted no exhibits. Respondent, United States
259Fidelity and Guaranty Company (USF&G), called no witnesses and
268submitted one exhibit.
271The identity of the witnesses and exhibits, and the ruling
281r egarding each, are reported in the two - volume Transcript of the
294proceeding filed with DOAH on February 28, 2005. None of the
305parties has yet filed a proposed recommended order (PRO).
314On March 17, 2005, the parties filed a Joint Motion for
325Enlargement of T ime to file PROs. The parties requested the ALJ
337to permit the parties to file PROs ten days after the ALJ issues
350an order on the motion for recommended order of dismissal that
361USF&G entered on the record at the conclusion of the hearing.
372By order dated M arch 18, 2005, the ALJ granted the Joint Motion
385for Enlargement of Time.
389The parties filed legal memoranda addressing the motion for
398recommended order of dismissal. Petitioner alleges, in relevant
406part, that the recommended order of dismissal is frivolous and
416seeks attorney fees and costs related to the motion for
426recommended order of dismissal. This Final Order addresses the
435motion for attorney fees and costs because an order concerning a
446motion for an attorney fee must be in the form of a final order.
460§ 57.105(5), Fla. Stat. (2004).
465FINDINGS OF FACT
4681. During the administrative hearing, counsel for
475Petitioner stated that the basis for recovery from Dixie Growers
485does not rest on an alleged breach of contract. Rather,
495Petitioner asserted that the recovery is based, in relevant
504part, on an alleged failure of Dixie Growers to maintain records
515required in Subsection 604.22(1), Florida Statutes (2003) (the
523record - keeping requirement).
5272. Counsel for USF&G entered an ore tenus motion to
537dismiss that sought, in relevant part, to dismiss any proceeding
547based on an alleged violation of the record - keeping requirement.
558The ALJ deemed the motion to dismiss to be a motion for
570recommended order of dismissal and reserved ruling.
5773. USF&G filed its legal m emorandum in support of the
588motion for recommended order of dismissal on March 8, 2005.
598Petitioner filed legal memoranda on March 16 and 17, 2005. The
609legal memorandum filed on March 17 included a motion for
619attorney's fees and costs.
6234. The record - ke eping requirement generally requires a
633licensee such as Dixie Growers to maintain records for each
643transaction and makes it a misdemeanor to fail to do so.
654§ 604.22(1)(a), Fla. Stat. (2003). The record - keeping
663requirement does not authorize an administr ative hearing
671concerning an alleged failure to maintain records. Nor does the
681record - keeping requirement authorize an ALJ to enforce the
691requirement.
6925. Neither legal memorandum from Petitioner asserts
699jurisdiction under the record - keeping requirement. Nor do the
709legal memoranda refer to the record - keeping requirement.
718Rather, the legal memoranda assert that Petitioner is entitled
727to a hearing pursuant to Subsection 604.21(6), Florida Statutes
736(2003).
7376. Subsection 604.21(6), Florida Statutes (2003) ,
743authorizes an administrative hearing conducted pursuant to
750Chapter 120, Florida Statutes, for the purpose of resolving
759issues concerning a complaint for damages authorized in
767Section 604.21, Florida Statutes (the hearing requirement). The
775hearing requir ement authorizes a hearing for any person "whose
785material interest is affected by a proceeding pursuant to this
795section . . . ." (emphasis supplied)
8027. The reference to "this section" in the hearing
811requirement refers to Section 604.21, Florida Statutes (2003).
819The reference does not authorize an administrative hearing
827concerning the record - keeping requirement.
8338. Petitioner knew or should have known that the
842proceeding was not based on the record - keeping requirement and
853that the then - existing law di d not support Petitioner's
864argument. In response to the motion for recommended order of
874dismissal of any proceeding based on the record - keeping
884requirement, Petitioner asserts that the motion for recommended
892order of dismissal is frivolous because Petitio ner is entitled
902to a hearing on damages pursuant to the hearing requirement.
912CONCLUSIONS OF LAW
9159. DOAH has jurisdiction over the parties and the subject
925matter in this proceeding. §§ 57.105(5), 604.21(6), 120.569,
933and 120.57(1), Fla. Stat. (2004). DOAH provided adequate notice
942of the administrative hearing.
94610. The motion for recommended order of dismissal of any
956proceeding based on the record - keeping requirement is granted in
967a separate order entered on the same date as this Final Order.
979The ALJ has no statutory authority to conduct an administrative
989hearing based on the record - keeping requirement.
99711. The motion for an award of attorney fees and costs
1008incurred in addressing the motion for recommended order of
1017dismissal based on the record - keepin g requirement is denied.
1028USF&G is the prevailing party on the motion for recommended
1038order of dismissal of a proceeding based on the record - keeping
1050requirement. Petitioner knew or should have known that the
1059claim of jurisdiction based on the record - keepi ng requirement,
1070as well as the relevancy of evidence intended to show that Dixie
1082Growers did not comply with the record - keeping requirement, was
1093not supported by the then - existing law. § 57.105(1)(b), Fla.
1104Stat. (2004).
110612. The motion for recommended ord er of dismissal based on
1117the record - keeping requirement does not dispose of the
1127underlying proceeding. The underlying proceeding is not
1134conducted pursuant to the record - keeping requirement. Rather,
1143the underlying proceeding is conducted pursuant to the h earing
1153requirement. Cf. Wood v. Price , 546 So. 2d 88 (Fla. 2d DCA
11651989); Ruppel v. Gulf Winds Apartments, Inc. , 508 So. 2d 534
1176(Fla. 2d DCA 1987)(each holding that a party is not entitled to
1188an attorney fee for responding to a motion to dismiss that does
1200not dispose of the case).
120513. The remaining portion of the motion for recommended
1214order of dismissal is denied in the separate order issued on the
1226same date as this order. The motion is based, in relevant part,
1238on the alleged failure of Petitioner to:
1245. . . establish any sort of contract, any
1254breach of contract, and . . . to present any
1264evidence whatsoever supporting his claim for
1270damages.

129614. The argument in the foregoing paragraph addresses the
1305merits of the underlying proceeding and the sufficiency of the
1315evidence. USF&G cited no legal authority for the ALJ to dispose
1326of the merits of the case in any manner other than in a
1339recommended order disposing of the merits of the complaint.
1348ORDER
1349Based on the foregoing Findings of Fact and Conclusions of
1359Law, it is
1362ORDERED that the claim for attorney fees and costs is
1372denied. That part of the motion for reco mmended order of
1383dismissal that seeks to dismiss a proceeding based on the
1393record - keeping requirement is granted. That part of the motion
1404for recommended order of dismissal that addresses the merits of
1414the underlying proceeding is denied. The ALJ retains
1422jurisdiction over the underlying proceeding. The parties shall
1430file their PROs addressing the merits of the underlying
1439proceeding no later than April 18, 2005.
