215At issu e is whether Davin Asier McCray, a minor, qualifies

226for coverage under the Florida Birth - Related Neurological Injury

239PRELIMINARY STATEMENT

241On December 6, 2004, Krysteen McCray and Jason McCray, on

251behalf of and as parents and nat ural guardians of Davin Asier

263McCray (Davin), a minor, filed a petition (claim) with the

273Division of Administrative Hearings (DOAH) for compensation

280under the Plan.

283DOAH served the Florida Birth - Related Neurological Injury

292Compensation Association (NICA) w ith a copy of the claim on

303December 7, 2004, and on March 1, 2005, following an extension

314of time within which to do so, NICA filed its response to the

327petition for benefits and gave notice that it was of the view

339that Davin did not suffer a "birth - related neurological injury,"

350as defined by Section 766.302(2), Florida Statutes, and

358requested that a hearing be scheduled to resolve whether the

368claim was compensable. Thereafter, a hearing was scheduled for

377July 6, 2005, to address the issue of compensability , and

387Betty Jane L. Chiota, ARNP; C inda M . B urton, ARNP ; M unroe

401R egional H ealth S ystem, I nc., d/b/a M idwives of O cala; and

416M unroe R egional H ealth S ystem, I nc., d/b/a M unroe R egional

431M edical C enter were accorded leave to intervene.

440At hearing, the parties s tipulated to the facts set forth

451in paragraphs 1 and 2 of the Findings of Fact, and Respondent's

463Exhibits A through I were received into evidence. No witnesses

473were called, and no further exhibits were offered.

481The parties were accorded 10 days from the d ate of the

493hearing to file proposed orders. Respondent elected to file

502such a proposal and it has been duly considered.

511FINDINGS OF FACT

514Stipulated facts

5161. Krysteen McCray and Jason McCray are the natural

525parents and guardians of Davin Asier McCray, a minor. Davin was

536born a live infant on August 29, 2001, at Munroe Regional

547Medical Center, a hospital located in Ocala, Florida, and his

557birth weight exceeded 2,500 grams.

5632. Obstetrical services were provided at Davin's birth by

572Betty Jane L. Chiota, ARNP , and Cinda M. Burton, ARNP. At the

584time, n urses Chiota and Burton were certified nurse - midwives and

596were "participating physicians," as that term is used in the

606Plan. § 766.314(4)(c), Fla. Stat.

611Coverage under the Plan

6153. Pertinent to this case, c overage is afforded by the

626Plan for infants who suffer a "birth - related neurological

636injury," defined as an "injury to the brain or spinal cord . . .

650caused by oxygen deprivation or mechanical injury occurring in

659the course of labor, delivery, or resuscita tion in the immediate

670postdelivery period in a hospital, which renders the infant

679permanently and substantially mentally and physically impaired."

686§ 766.302(2), Fla. Stat. See also §§ 766.309 and 766.31, Fla.

697Stat.

6984. Here, the proof demonstrates that D avin, who presents

708with a diagnosis of periventricular leukomalacia and

715developmental delay in multiple areas, including language, motor

723activity, socialization, and behavior, is neither permanently

730and substantially mentally impaired nor permanently and

737s ubstantially physically impaired . Consequently, for reasons

745appearing more fully in the Conclusions of Law, the claim is not

757compensable, and it is unnecessary to resolve whether Davin's

766impairments resulted from a brain or spinal cord injury caused

776by ox ygen deprivation or mechanical injury occurring in the

786course of labor, delivery, or resuscitation, or whether his

795impairments are attributable to another etiology.

801CONCLUSIONS OF LAW

8045. The Division of Administrative Hearings has

811jurisdiction over the pa rties to, and the subject matter of,

822these proceedings. § 766.301, et seq ., Fla. Stat.

8316. The Plan was established by the Legislature "for the

841purpose of providing compensation, irrespective of fault, for

849birth - related neurological injury claims" relatin g to births

859occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8707. The injured "infant, her or his personal

878representative, parents, dependents, and next of kin," may seek

887compensation under the Plan by filing a claim for compensation

897with th e Division of Administrative Hearings. §§ 766.302(3),

906766.303(2), 766.305(1), and 766.313, Fla. Stat. The Florida

914Birth - Related Neurological Injury Compensation Association,

921which administers the Plan, has "45 days from the date of

932service of a complete claim . . . in which to file a response to

947the petition and to submit relevant written information relating

956to the issue of whether the injury is a birth - related

968neurological injury." § 766.305(3), Fla. Stat.

9748. If NICA determines that the injury alleged in a claim

985is a compensable birth - related neurological injury, it may award

996compensation to the claimant, provided that the award is

1005approved by the administrative law judge to whom the claim has

1016been assigned. § 766.305(6), Fla. Stat. If, on the other hand,

1027NICA disputes the claim, as it has in the instant case, the

1039dispute must be resolved by the assigned administrative law

1048judge in accordance with the provisions of C hapter 120, F lorida

1060Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

10689. In disc harging this responsibility, the administrative

1076law judge must make the following determination based upon the

1086available evidence:

1088(a) Whether the injury claimed is a

1095birth - related neurological injury. If the

1102claimant has demonstrated, to the

1107satisfact ion of the administrative law

1113judge, that the infant has sustained a brain

1121or spinal cord injury caused by oxygen

1128deprivation or mechanical injury and that

1134the infant was thereby rendered permanently

1140and substantially mentally and physically

1145impaired, a re buttable presumption shall

1151arise that the injury is a birth - related

1160neurological injury as defined in s.

1166766.303(2).

1167(b) Whether obstetrical services were

1172delivered by a participating physician in

1178the course of labor, delivery, or

1184resuscitation in the immediate post - delivery

1191period in a hospital; or by a certified

1199nurse midwife in a teaching hospital

1205supervised by a participating physician in

1211the course of labor, delivery, or

1217resuscitation in the immediate post - delivery

1224period in a hospital.

1228§ 766.30 9(1), Fla. Stat. An award may be sustained only if the

1241administrative law judge concludes that the "infant has

1249sustained a birth - related neurological injury and that

1258obstetrical services were delivered by a participating physician

1266at birth." § 766.31(1), Fla. Stat.

127210. Pertinent to this case, "birth - related neurological

1281injury" is defined by Section 766.302(2), Florida Statutes,

1289to mean:

1291injury to the brain or spinal cord of a live

1301infant weighing at least 2,500 grams for a

1310single gestation or, in the ca se of a

1319multiple gestation, a live infant weighing

1325at least 2,000 grams at birth caused by

1334oxygen deprivation or mechanical injury

1339occurring in the course of labor, delivery,

1346or resuscitation in the immediate

1351postdelivery period in a hospital, which

1357render s the infant permanently and

1363substantially mentally and physically

1367impaired. This definition shall apply to

1373live births only and shall not include

1380disability or death caused by genetic or

1387congenital abnormality.

138911. Here, the proof demonstrated that Dav in was neither

1399permanently and substantially mentally impaired nor permanently

1406and substantially physically impaired. Consequently, given the

1413provisions of Section 766.302(2), Florida Statutes, Davin does

1421not qualify for coverage under the Plan. See also Florida

1431Birth - Related Neurological Injury Compensation Association v.

1439Florida Division of Administrative Hearings , 686 So. 2d 1349

1448(Fla. 1997)(The Plan is written in the conjunctive and can only

1459be interpreted to require both substantial mental and physic al

1469impairment.); Humana of Florida, Inc. v. McKaughan , 652 So. 2d

1479852, 859 (Fla. 2d DCA 1995)("[B]ecause the Plan . . . is a

1493statutory substitute for common law rights and liabilities, it

1502should be strictly construed to include only those subjects

1511clearly embraced within its terms."), approved , Florida Birth -

1521Related Neurological Injury Compensation Association v.

1527McKaughan , 668 So. 2d 974, 979 (Fla. 1996).

153512. Where, as here, the administrative law judge

1543determines that "the injury alleged is not a birth - r elated

1555neurological injury . . . he [is required to] enter an order [to

1568such effect] and . . . cause a copy of such order to be sent

1583immediately to the parties by registered or certified mail."

1592§ 766.309(2), Fla. Stat. Such an order constitutes final age ncy

1603action subject to appellate court review. § 766.311(1), Fla.

1612Stat.

1613CONCLUSION

1614Based on the foregoing Findings of Fact and Conclusions of

1624Law, it is

1627ORDERED that the claim for compensation filed by

1635Krysteen McCray and Jason McCray, on behalf of and as parents

1646and natural guardians of Davin Asier McCray, a minor, is

1656dismissed with prejudice.
