184On May 11, 2004, Petitioner, Frank M. Bafford, Sr., filed a
195complaint with the Florida Commission on Human Relations 1
204(Commission) alleging injury by discriminatory act of refusal to

230Discrimination Complaint with the Commission.
235On August 6, 2004, the Commission issued a Notice of
245Dismissal and a Determination of No Jurisdiction.
252On September 14, 2004, the Commission issued a Notice of
262Determination of No Jurisdiction: No Jurisdiction and Rescission

275On September 17, 2004, Petitioner filed a Petition for
284Relief, with the Commission, alleging violations of the Fair
293Housing Act, as amended, by Respondents, Gary Hediger, Marcus
302and Millichap Company, and Township Apartments Associates, et
310al. , to wit: "refusal to sale, denial of a property's
320availability, setting different terms and conditions in a
328contract, and refusing to negotiate."
333On September 20, 2004, the Commission referred this matter
342to the Division of Administrative Hearings for the assignment of
352an Administrative Law Judge to conduct all necessary proceedings
361required under the law and to submit recommended findings to the
372Commission.
373On October 1, 2004, Petitioner filed a Motion to Rule on
384Motion to Relinquish Jurisdiction and Refer the Case back to the
395Florida Commission for Investigation and Representation. Ten
402days later, Respondents, Marcus and Millichap Company and Darron
411Kattan, responded to Petitioner's motion and, on October 7,
4202004, filed a Motion to Dismiss or, in the alternative, Motion
431for Summary Final Order.
435On October 10, 2004, a Notice of Hearing, scheduling the
445final hearing for December 2, 2004, in Tampa, Florida, and an
456Order of Pre-hearing Instructions were entered.

644undersigned in Tallahassee, Florida.

680On November 1, 2004, Petitioner filed a Motion to Provide

697On November 3, 2004, an Order ruling on pending motions
707heard during the October 28, 2004, telephone conference was
716entered. In that Order, the following motions filed by
725Petitioner were DENIED: (1) Motion to Rule on Jurisdiction and

744Representation; (2) Emergency Motion to Rule on Jurisdiction or

798On November 4, 2004, Petitioner filed a Motion to Stay,

823On November 9, 2004, a case status telephone conference was
833held with all parties present for discussion of all preliminary
843matters before the final hearing scheduled for December 20,
8522004.
853On November 10, 2004, Petitioner filed a Motion for Summary
863Recommended Order. Having considered the motion, it is DENIED.
872On November 12, 2004, the undersigned provided a Notice of
882Understanding and Agreement that resulted from the telephonic
890conference held November 9, 2004.
895On November 12, 2004, Petitioner filed a Motion to Clarify
905and Dismiss the Petition for Relief, which provided:
913Petitioner, Frank M. Bafford, Sr., desires
919to clarify his previous filed motion. In
926the event the court does not grant a summary
935recommended order, the Petitioner asked the
941Division of Administrative Hearings (DOAH)
946to refer its ruling to the state court. The
955Florida Commission on Human Relations (FCHR)
961based a premature findings and conclusions
967on a ruling from this court. The FCHR's
975problem in determining the Petitioner's
980intent to dwell will be solved by the final
989ruling of the state court. We have two
997courts that will rule on the Petitioner's
1004intent to dwell during the same period,
1011which is not necessary and will be a waste
1020of tax dollars. Before this court wastes
1027any judicial resources it should allow the
1034FCHR to do its due diligence to solve this
1043matter itself. If the FCHR can't determine
1050the Petitioner's intent after the state
1056court's ruling, then and only then, should
1063the DOAH hear testimony. The DOAH was not
1071designed to hear testimony in cases where a
1079state agency can solve the problem itself,
1086but in cases where the agency has done
1094everything possible to solve the problem and
1101has not been able to. In the event the DOAH
1111does not grant the Petitioner's motion, the
1118Petitioner would like to dismiss. It will
1125be destructive to the Petitioner to give a
1133deposition without an attorney. The
1138Petitioner thanks the court for its
1144professionalism and its patience with the
1150Petitioner's ignorance of the law and legal
1157system.
1158The motion was heard by telephonic conference on
1166November 15, 2004, with all parties in attendance.
1174FINDINGS OF FACT
11771. At the telephonic hearing, it was explained to
1186Petitioner that should his Motion to Dismiss be granted, this
1196Recommended Order of Dismissal to the Commission would be
1205entered, recommending dismissal of his Petition for Relief filed
1214in this cause, and should the Commission adopt the
1223recommendation, his petition would be dismissed.
1229Notwithstanding explanations given and being otherwise fully
1236advised of the consequences, Petitioner insisted that his
1244Petition for Relief be dismissed.
12492. Based upon the pleadings filed, the discussions and
1258arguments made during the several telephonic conferences, it is
1267found that Petitioner willingly and knowingly made his Motion to
1277Dismiss, as an alternative, should he not prevail on his
1287previously filed Motion for Summary Recommended Order.
1294CONCLUSIONS OF LAW
12973. The Division of Administrative Hearing has jurisdiction
1305over the parties to the subject matter of this proceeding
1315pursuant to Section 120.569 and Subsections 120.57(1) and
1323760.23(1), Florida Statutes (2004).
13274. Petitioner, after conferencing with Respondents and the
1335undersigned regarding procedure, of his own free will knowingly
1344and willingly declined to pursue his claim of housing
1353discrimination against Respondents by a written motion that his
1362Amended Housing Discrimination Complaint be dismissed.
1368RECOMMENDATION
1369Based upon the foregoing Findings of Fact and Conclusions
1378of Law, it is
1382RECOMMENDED that the Florida Commission on Human Relations
1390enter a final order of dismissal of the Petition for Relief
1401filed in the cause by Petitioner, Frank M. Bafford, Sr.
