101STATEMENT OF THE ISSUE
105The issue to be resolved in this proceeding concerns
114whether the P etitioner had been discriminat ed against based upon
125race for alleged denial of lodging, as addressed in Chapter 760,
136Florida Statutes .
139PRELIMINARY STATEMENT
141This cause arose upon the filing of a charge of
151discrimination based upon race by the above - named Petitioner
161with the Florida Commission on Human Relations (Commission).
169The Commission on December 17, 2004, entered a Notice of
179Determination , finding no cause to believe a discriminatory
187practice had occurred.
190Thereafter the Petitioner filed a Petition for Relief
198continuing to asse r t her claim of discrimination against the
209above - named Respondent.
213The cause ultimately was assigned to the undersigned
221administrative law judge and came on for hearing as noticed on
232the above - referenced date. Upon convening the hearing the
242Petitioner failed to appear. After waiting for a substantial
251period of time approximately one hour, the Petitioner never
260entered an appearance and never therefore advanced a prima facie
270claim. Because the Petition er has the burden of pro of, the
282Respondent was not required to present any evidence and the
292hearing was adjourned.
295FINDINGS OF FACT
2981. The Findings of Fact are in essence as stated in the
310above Preliminary Statement concerning the Petitioner's lack of
318appearance at the hearing. The hearing was duly noticed at the
329last address of record for the parties , including the
338Petitioner. No appearance has eve r been entered since the
348convening of the hearing and no communication , by the
357Petitioner, with the undersigned , telephonically , o r in writing
366or otherwise has been made to explain her absence from the duly -
379scheduled hearing . She has provide d no indication that she
390wishe s to prosecute her claim. Accordingly, being advised in
400the premises, it is
404RECOMMENDATION
405RECOMMENDED: Th at a final order be entered by the Florida
416Commission on Human Relations dismissing th is Petition for lack
426of prosecution, based upon the above - stated reasons.
