130STATEMENT OF THE ISSUES
134At issue is whether Albert Houston, III, a minor , qualifies
144for coverage under the Florida Birth - Related Neurological Injury
154Compensation Plan (Plan).
157PRELIMINARY STATEMENT
159On January 21, 2005, Patricia White and Albert Houston,
168Jr., on behalf of, and as parents and natural guardians of
179Albert Houston, III (Albert), a minor, filed a petition (c laim)
190with the Division of Administrative Hearings (DOAH) for
198compensation under the Plan.
202DOAH served the Florida Birth - Related Neurological Injury
211Compensation Association (NICA) with a copy of the claim on
221January 25, 2005, and on March 23, 2005, follow ing an extension
233of time within which to do so, NICA gave notice that it was of
247the view that Albert did not suffer a "birth - related
258neurological injury," as defined by Section 766.302(2), Florida
266Statutes, and requested that a hearing be scheduled to reso lve
277whether the claim was compensable. Such a hearing was initially
287scheduled for August 8, 2005, re - scheduled at Petitioners'
297request for October 6, 2005 , and again re - scheduled for
308January 20, 2006.
311Although duly noticed, neither Petitioners nor anyone on
319their behalf appeared at hearing, and no evidence was offered to
330support their claim. Respondent appeared through counsel, but
338offered no competent proof. 1
343FINDINGS OF FACT
3461. As observed in the Preliminary Statement, neither
354Petitioners nor anyone on their behalf appeared at hearing, and
364no proof was offered to support their claim. Consequently,
373there being no proof, the record fails to demonstrate that
383Albert suffered a birth - related neurological injury," as defined
393by the Plan.
396CONCLUSIONS OF LA W
4002. The Division of Administrative Hearings has
407jurisdiction over the parties to, and the subject matter of,
417these proceedings. § 766.301, et seq ., Fla. Stat.
4263. The Plan was established by the Legislature "for the
436purpose of providing compensation, ir respective of fault, for
445birth - related neurological injury claims" relating to births
454occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
4654. The injured "infant, her or his personal
473representative, parents, dependents, and next of kin," may s eek
483compensation under the Plan by filing a claim for compensation
493with the Division of Administrative Hearings. §§ 766.302(3),
501766.303(2), 766.305(1), and 766.313, Fla. Stat. The Florida
509Birth - Related Neurological Injury Compensation Association,
516which administers the Plan, has "45 days from the date of
527service of a complete claim . . . in which to file a response to
542the petition and to submit relevant written information relating
551to the issue of whether the injury is a birth - related
563neurological injury. " § 766.305(3), Fla. Stat.
5695. If NICA determines that the injury alleged in a claim
580is a compensable birth - related neurological injury, it may award
591compensation to the claimant, provided that the award is
600approved by the administrative law judge to whom the claim has
611been assigned. § 766.305(6), Fla. Stat. If, on the other hand,
622NICA disputes the claim, as it has in the instant case, the
634dispute must be resolved by the assigned administrative law
643judge in accordance with the provisions of C hapter 120, F lorida
655Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
6636. In discharging this responsibility, the administrative
670law judge must make the following determination based upon the
680available evidence:
682(a) Whether the injury claimed is a
689birth - relate d neurological injury. If the
697claimant has demonstrated, to the
702satisfaction of the administrative law
707judge, that the infant has sustained a brain
715or spinal cord injury caused by oxygen
722deprivation or mechanical injury and that
728the infant was thereby ren dered permanently
735and substantially mentally and physically
740impaired, a rebuttable presumption shall
745arise that the injury is a birth - related
754neurological injury as defined in s.
760766.303(2).
761(b) Whether obstetrical services were
766delivered by a particip ating physician in
773the course of labor, delivery, or
779resuscitation in the immediate post - delivery
786period in a hospital; or by a certified
794nurse midwife in a teaching hospital
800supervised by a participating physician in
806the course of labor, delivery, or
812resu scitation in the immediate post - delivery
820period in a hospital.
824§ 766.309(1), Fla. Stat. An award may be sustained only if the
836administrative law judge concludes that the "infant has
844sustained a birth - related neurological injury and that
853obstetrical ser vices were delivered by a participating physician
862at birth." § 766.31(1), Fla. Stat.
8687. Pertinent to this case, "birth - related neurological
877injury" is defined by Section 766.302(2), Florida Statutes
885(2000), to mean:
888injury to the brain or spinal cord of a live
898infant weighing at least 2,500 grams at
906birth caused by oxygen deprivation or
912mechanical injury occurring in the course of
919labor, delivery, or resuscitation in the
925immediate postdelivery period in a hospital,
931which renders the infant permanently and
937substantially mentally and physically
941impaired. This definition shall apply to
947live births only and shall not include
954disability or death caused by genetic or
961congenital abnormality.
9638. As the claimants, the burden rested on Petitioners to
973demonstrate that Albert suffered a "birth - related neurological
982injury," as defined by the Plan. § 766.309(1)(a), Fla. Stat.

1001Services , 348 So. 2d 349, 350 (Fla. 1st DCA 1977)("[T]he burden
1013or proof, apart fro m statute, is on the party asserting the
1025affirmative of an issue before an administrative tribunal . ") By
1036failing to appear and offer proof, Petitioners failed to sustain
1046that burden. Accordingly, the Petitioners' claim has not been
1055shown to be compensabl e under the Plan.
10639 . Where, as here, the administrative law judge determines
1073that "the injury alleged is not a birth - related neurological
1084injury . . . he [is required to] enter an order [to such effect]
1098and . . . cause a copy of such order to be sent imme diately to
1114the parties by registered or certified mail." § 766.309(2),
1123Fla. Stat. Such an order constitutes final agency action
1132subject to appellate court review. § 766.311(1), Fla. Stat.
1141CONCLUSION
1142Based on the foregoing Findings of Fact and Conclusi ons of
1153Law, it is
1156ORDERED that the claim for compensation filed by
1164Patricia White and Albert Houston, Jr., on behalf of and as
1175parents and natural guardians of Albert Houston, III, a minor,
1185is dismissed with prejudice.
