351. On November 12, 2004, Petitioner Teresa Burns Posey, as
45Chair of Florida Prisoners' Legal Aid Organization, Inc., filed a
55petition with DOAH seeking the determination of the invalidity of
65a proposed Department of Correction (hereinafter "DOC") rule
74(Florida Prisoners' Legal Aid Organization, Inc.'s v. Department
82of Corrections, Case No. 04-4094RP (January 26, 2005)). The
91Petitioner also filed a Notice of Appearance of Authorized
100Representative wherein the Petitioners asserted that Bob Posey
108had been appointed to act as the corporation's (Florida
117Prisoners' Legal Aid Organization, Inc.'s) authorized
123representative in Case No. 04-4094RP.
1282. Bob Posey, inmate # 046087 (now deceased), was at that
139time incarcerated in a Department of Corrections facility within
148the State of Florida.

1533. In response to the above-outlined circumstances, the
161Respondent filed an objection to Mr. Posey's representation of
170Florida Prisoners' Legal Aid Organization, Inc. on December 21,
1792004. The objection was heard by telephonic conference calIon
188January 13, 2005.
1914. The administrative law judge assigned to preside over
200Case No. 04-4094RP, Susan B. Harrell, ruled in favor of
210Respondent as follows:
213Bob Posey is incarcerated in one of Respondent's
221facilities. He is a prisoner as that term is defined
231in Section 944.02, Florida Statutes (2004). As a
239prisoner, he is prohibited from being a party in an
249administrative proceeding other than those authorized
255by Subsections 120.54(3) (c) and 120.54(7), Florida
262Statutes (2004). Mr. Posey, as a prisoner, cannot
270bring a rule challenge.
274Florida Administrative Code Rule 33-102.202
279prohibits prisoners from acting as qualified
285representatives in administrative proceedings. Thus,
290Mr. Posey is prohibited from representing a party in an
300administrative proceeding as a qualified
305representative.
306Petitioner cites Magnolias Nursing and
311Convalescent Center v. Department of Health and st
319Rehabilitative Services, 488 So. 2d 103 (Fla. 1 DCA
3281986), as authority for allowing Mr. Posey to appear as
338an authorized representative of Petitioner, a
344corporation. In the Magnolias case, the person seeking
352to represent the corporation as authorized
358representative was not a prisoner, and he and his wife
368were the sole owners of the capital stock of the
378cooperation he was seeking to represent. Such is not
387the situation in the instant case.
393Mr. Posey is a prisoner who is prohibited by
402statute from being a party in a rule challenge and who
413is prohibited by administrative rule from representing
420a party in an administrative proceeding. It is clear
429that the intent of the statute and the rule is to

443prohibit prisoners from participating in rule
449challenges. It is
452ORDERED that:
4541. Petitioner's Notice of Appearance of
460Authorized Representative is stricken. Bob Posey shall
467not represent Petitioner in this proceeding.
4732. All pleadings filed by Bob Posey in the
482instant case are stricken.
4863. Teresa Burns Posey filed the action for
494Petitioner and is deemed to be authorized
501representative until such time as Petitioner authorizes
508another person to represent it.
5135. On February 2, 2005 Petitioners filed a Petition seeking
523the invalidity of Judge Harrell's ruling in Case No. 04-4094RP
533that precluded Bob Posey from serving as a qualified
542representative in Florida Prisoners' Legal Aid Organization,
549Inc.'s v. Department of Corrections, Case No. 04-4094RP, as a
559non-rule policy and as an invalid exercise of delegated
568legislative authority.
5706. On March 24, 2005 an amended Petition was filed by
581Petitioners that did not change the allegations or claims made in
592the February 2, 2005 Petition in a substantive manner.
6017. On March 17, 2005 Respondent filed a motion to dismiss
612the matter in question wherein it sought dismissal on multiple
622grounds. On October 24, 2006 an amended motion to dismiss citing
633additional grounds for dismissal and supporting authority.
6408. The Motion to Dismiss and the Amended Motion to Dismiss
651were heard by the undersigned on via teleconference hearing on

662March 14, 2012 at 2:00 P.M. All parties were notified of the
674hearing via Notice of Hearing that was issued on February 23,
6852012, and sent to all the parties at their addresses of record.
697Edward A. Tellechea, Senior Assistant Attorney General, made an
706appearance on behalf of Respondent. Petitioners did not make an
716appearance nor did anyone appear on their behalf.
7249. At the hearing Respondent noted that despite the facts
734that Petitioners had been properly noticed of the hearing,
743Petitioners had not made an appearance and it had been almost six
755(6) years since the amended motion for dismissal was filed with
766no action taken on this matter by Petitioner. Based on such
777facts, Respondent's counsel made an ore tenus motion to dismiss
787this for lack of prosecution.
792Based on the foregoing, it is therefore ordered that this
802matter is DISMISSED for failure to prosecute.
