149PRELIMINARY STATEMENT

151On January 26, 2005, Petitioner, Department of Health,

159B oard of Medicine (Department), filed an Administrative

167Complaint against Respondent, Melody M. Johnson, P.A.

174(Ms. Johnson), 2 alleging that she violated Subsection

182458.331(1)(t), Florida Statutes (2001). 3 Ms. Johnson requested

190an administrative hearing, a nd the case was forwarded to the

201Division of Administrative Hearings on March 4, 2005, for

210assignment to an a dministrative l aw j udge. The case was

222assigned to Administrative Law Judge Larry J. Sartin, but was

232later transferred to the undersigned to conduc t the final

242hearing.

243On April 29, 2005, the Department filed Petitioner's Motion

252to Amend Administrative Complaint, which was granted by order

261dated May 5, 2005.

265Prior to the final hearing, the parties submitted a Joint

275Prehearing Stipulation, which contai ned facts to which the

284parties agreed. Those facts which are contained in Section E of

295the Joint Prehearing Stipulation are incorporated into this

303Recommended Order to the extent relevant.

309At the final hearing, Respondent advised that she had

318married , and her legal name was Melody M. Johnson. The caption

329of the case was changed to reflect Ms. Johnson's married name.

340At the final hearing, the Department called Philip T. Nix as its

352witness and proffered the testimony of Dr. Lawrence Kaplan.

361Petitioner's E xhibits 1 through 4, and 6 were admitted in

372evidence. Petitioner's Exhibit 9 was proffered. Official

379recognition was taken of Sections 458.337 and 458.331,

387Florida Statutes (2000), and Florida Administrative Code

394Rule 64B8 - 30.015.

398At the final hearing, Ms. Johnson testified in her own

408behalf and called the following witnesses: Iqbal Ahmed, M.D. ;

417Ernest Benjamin Walton ; and Don Milton Harvey, M.D.

425Respondent's Exhibits 1 through 4 were admitted in evidence.

434The two - volume Transcript was filed on June 3, 2005. The

446parties filed their Proposed Recommended Orders on June 13,

4552005. The parties ' Proposed Recommended Orders have been

464considered in rendering this Recommended Order.

470FINDINGS OF FACT

4731. The Department is the state agency charged with the

483re gulation of medicine pursuant to Chapters 20, 456, and 458,

494Florida Statutes.

4962. Ms. Johnson, is and was at all times material to this

508proceeding, a licensed physician assistant in the State of

517Florida, having been issued license number PA3320.

5243. In Feb ruary 2000, Ms. Johnson was asked to help start a

537program to evaluate the benefit of having physician assistants

546in the Emergency Department at Highlands Regional Medical Center

555(Medical Center) in Sebring, Florida. She was the only full -

566time physician as sistant in the program. There were a few other

578physician assistants , who worked part - time. In the trial

588program, the emergency physician would work directly and closely

597with the physician assistant. The physician assistant would

605assess a patient and rep ort any abnormal findings to the

616physician. The physician would see the patient and repeat the

626assessment. Because this trial program was also a teaching

635experience, the physician would advise the physician assistant

643of any abnormal findings. The physic ian would tell the

653physician assistant what to order and the physician assistant

662would order it.

6654. On April 15, 2000, Ms. Johnson was working as a

676physician assistant in the Emergency Department at the Medical

685Center when J.W. arrived at the Emergency De partment via

695Highlands Emergency Medical Services (EMS) at about 9:40 a.m. A

705copy of the EMS report was made available to the Emergency

716Department staff.

7185. According to the EMS report, when the EMS personnel

728arrived at J.W.'s home, J.W.'s chief complain t was nausea and

739vomiting. J.W. had not had adequate fluid intake in two days.

750She was alert and oriented to time, place, and person , and

761denied having lost consciousness. She was taken to the Medical

771Center.

7726 . On arrival at the Medical Center, J.W. w as complaining

784of nausea and dry heaves, dizziness, and neck pain , and that she

796could not raise her head . J.W. was seen by Ms. Johnson, who

809examined J.W. and took a medical history. In assessing J.W.,

819Ms. Johnson used a T - sheet for nausea, vomiting and d iarrhea. A

833T - sheet is a form which has questions which would be germane to

847the complaints of the patient. In the instant case, a T - sheet

860for nausea and vomiting was appropriate based on J.W.'s primary

870complaint of nausea and vomiting.

8757 . Using the T - she et, Ms. Johnson found that J.W. had

889nausea, had been vomiting, had muscle aches, had a headache on

900the to p of her head, had blurred vision, had dizziness, and had

913back pain. It was noted that J.W. had a history of high blood

926pressure and was a smoker. Ms . Johnson's examination indicated

936that J.W.'s neck was supple, meaning that J.W. could freely move

947her neck and Ms. Johnson was able to bring J.W.'s neck from her

960chin to her chest. Ms. Johnson circled on the form that J.W.

972had "passed out," but this nota tion was in error. Ms. Johnson

984should have circled "dizziness" which appeared in front of

"993passed out" on the T - sheet.

10008 . J.W. was alert and oriented to person, place, and time

1012during the entire time she was in the Emergency Department of

1023the Medical C enter. None of J.W.'s relatives were available in

1034the Emergency Department during the entire time that she was in

1045the Emergency Department.

10489 . Iqbal Ahmed, M.D., Ms. Johnson's supervising physician

1057in the Emergency Department on April 15, 2000, also exam ined

1068J.W. and made an assessment. When he saw that Ms. Johnson had

1080indicated on the T - sheet that J.W. had passed out, he

1092specifically asked J.W. if she had passed out, and J.W. stated

1103that she had not , but that she was dizzy. Dr. Ahmed asked J.W.

1116about h er headache , and she indicated that the headache was not

1128a sudden onset and that she did not remember when it started.

1140J.W. denied any injury or trauma to the head and indicated that

1152she had a mild headache on the top of her head. He viewed the

1166headache as a secondary complaint.

117110 . While J.W. was in the Emergency Department, she was

1182given Tor a dol for the body aches and pain, and A ntivert for the

1197nausea and lightheadedness.

12001 1 . X - ray s were taken of J.W.'s lungs and cervical spine.

1215The X - ray s of the lu ngs indicated that there was a small patch

1231infiltrate in the right lower lobe. The X - ray s of the cervical

1245spine showed normal findings.

12491 2 . Ms. Johnson diagnosed J.W. with lower lobe pneumonia,

1260labyrinthitis, intractable neck pain, and nausea. After

1267con ducting his own examination and reviewing J.W.'s X - ray s,

1279Dr. Ah m ed concurred with the diagnosis. Both Ms. Johnson and

1291Dr. Ahmed felt that J.W. should be admitted to the Medical

1302Center.

13031 3 . J.W.'s primary care physician, Dr. Jackson, was

1313contacted at 1: 00 p.m. on April 15, 2000. He gave orders at

13261:20 for J.W. to be admitted to the Medical Center and further

1338ordered laboratory tests and medications for J.W. The patient's

1347primary care physician indicated that he would be in to see J.W.

1359on the day of her admission.

13651 4 . At 6:00 p.m. on April 15, 2000, the nurses' notes

1378indicate that after J.W. was admitted to the Medical Center, she

1389was complaining of neck pain and a pounding headache from her

1400forehead over the top of her head and back down to her neck.

1413J.W. was still complaining of a headache and neck pain at

14249:30 p.m. At 10:00 p.m., Dr. Jackson gave verbal orders for

1435additional pain medication.

14381 5 . On April 16, 2000, Dr. Jackson, assessed J.W. for the

1451first time and wrote a progress note that J.W. w as more

1463comfortable , but still had some neck discomfort. On the evening

1473of April 16, 2000, the nurses' notes indicate that a family

1484member had expressed concern about J.W.'s mental status, stating

1493that prior to going to the Medical Center, J.W. had acted

1504differently than normal, leaving clothing on the floor of her

1514home, not answering her telephone, failing to follow her normal

1524routine of talking on the telephone to her friend every morning ,

1535and walking around the house in front of her granddaughter with

1546n othing but a blouse on. Dr. Jackson spoke to the family member

1559about J.W.'s unusual behavior.

15631 6 . A CT scan was ordered of J.W.'s head. The laboratory

1576report that the indication for the procedure was a "Change in

1587mental status." The CT scan revealed th at J.W. had a

1598subarachnoid hemorrhage. She was later transferred to another

1606hospital. The evidence did not establish when J.W. actually

1615suffered the subarachnoid hemorrhage.

16191 7 . A subarachnoid hemorrhage is a rupture of a blood

1631vessel in the brain. Nor mally, when a patient has had a

1643subarachnoid hemorrhage, the primary complaint of the patient

1651will be the headache. The headache is usually described as the

1662worst headache of the patient's life, and the headache usually

1672starts as a sudden onset like a thu nder clap .

16831 8 . Ben Walton, a physician assistant with over

169320 years ' experience , testified as an expert witness on

1703Ms. Johnson's behalf. It was his opinion that her evaluation

1713and diagnosis of J.W. met the standard of care. Mr. Walton came

1725to this conc lusion prior to his finding out that the CT scan

1738taken after J.W. was admitted to hospital showed that J.W. had a

1750subarachnoid hemorrhage.

17521 9 . Dr. Don Harvey, an emergency room physician with over

176424 years ' experience, also testified on Ms. Johnson's beha lf.

1775Dr. Harvey is board - certified in internal medicine and in

1786emergency medicine. He supervises physician assistant s in the

1795Emergency Department at Manatee Memorial Hospital and evaluates

1803the performance of physician assistant s. It is Dr. Harvey's

1813opini on that based on J.W.'s primary complaint of nausea and

1824vomiting that Ms. Johnson did not fall below the standard of

1835care by failing to order a CT scan and failing to diagnose a

1848cere bro vascular or neurologic abnormality.

185420 . Phillip Nix, a physician assis tant with over 20 years '

1867experience in emergency medicine, testified as an expert on

1876behalf of the Department. Mr. Nix was of the opinion that Ms.

1888Johnson's performance fell below the standard of care. His

1897opinion is based, in part, on an incorrect assum ption that J.W.

1909had lost consciousness at some point. Mr. Nix could not tell

1920when the subarachnoid hemorrhage occurred.

1925CONCLUSIONS OF LAW

192821 . The Division of Administrative Hearings has

1936jurisdiction over the parties to and the subject matter of th is

1948proceeding. §§ 120.569 and 120.57, Fla. Stat. (2004).

195622 . The Department has the burden to establish by clear

1967and convincing evidence the allegations in the Amended

1975Administrative Complaint. Department of Banking and Finance v.

1983Osborne Stern and Co. , 670 So. 2d 932 (Fla. 1996). The

1994Department has alleged that Ms. Johnson violated Subsection

2002458.331(1)(t), Florida Statutes, which provides that the

2009following acts constitute grounds for disciplinary action:

2016Gross or repeated malpractice or the failure

2023t o practice medicine with that level of

2031care, skill, and treatment, which is

2037recognized by a reasonably prudent similar

2043physician as being acceptable under similar

2049circumstances. The board shall give great

2055weight to the provisions of s. 766.102 when

2063enforc ing this paragraph. As used in this

2071paragraph, "repeated malpractice" includes,

2075but is not limited to, three or more claims

2084for medical malpractice within the previous

20905 - year period resulting in indemnities being

2098paid in excess of $25,000 each to the

2107clai mant in a judgment or settlement and

2115which incidents involved negligent conduct

2120by the physician. As used in this

2127paragraph, "gross malpractice" or "the

2132failure to practice medicine with that level

2139of care, skill, and treatment which is

2146recognized by a re asonably prudent similar

2153physician as being acceptable under similar

2159conditions and circumstances," shall not be

2165construed so as to require more than one

2173instance, event, or act. Nothing in this

2180paragraph shall be construed to require that

2187a physician be incompetent to practice

2193medicine in order to be disciplined pursuant

2200to this paragraph.

22032 3 . The Department alleged that Ms. Johnson violated

2213Subsection 458.331(1)(t), Florida Statutes, by "fail[ing] to

2220identify and record symptoms of cere b rovascular and neurologic

2230abnormality in Patient J.W." The Department has failed to

2239establish this allegation by clear and convincing evidence.

2247J.W.'s primary complaint was nausea and vomiting. Her headache

2256was a secondary complaint. Additionally, the symptoms of the

2265headache were not symptoms that would normally be found with a

2276subarachnoid hemorrhage. J.W. did not know when her headache

2285started, and she denied passing out. J.W. complained of neck

2295pain, and a cervical spine X - ray was taken. The X - ray did not

2311revea l any abnormalities. Additionally, Ms. Johnson's

2318supervising physician, who also examined and talked with J.W.,

2327came to the same diagnosis that Ms. Johnson did.

23362 4 . The Department alleged that Ms. Johnson violated

2346Subsection 458.331(1)(t), Florida Stat utes, by "fail[ing] to

2354recommend adequate diagnostic procedures such as a CT scan,

2363testing such as a lumbar puncture, or to obtain a timely

2374neurology consult to evaluate and treat the cause of Patient

2384J.W.'s abnormal symptoms." The Department has failed t o

2393establish this allegation by clear and convincing evidence. The

2402headache as described by the patient did not warrant the

2412ordering of a CT scan or other diagnostic procedures.

2421Additionally, Dr. Ahmed did not order a CT scan, and Dr. Jackson

2433did not orde r a CT scan until two days after J.W.'s admission to

2447the Medical Center.

2450RECOMMENDATION

2451Based on the foregoing Findings of Fact and Conclusions of

2461Law, it is

2464RECOMMENDED that a f inal o rder be entered finding that

2475Melody M. Johnson did not violate Subsecti on 458.331(1)(t),

2484Florida Statutes, and dismissing the Administrative Complaint.
