121Whether Respondent violated Subsection 4 64 .018(1)(h),

128Florida Statutes (2001), 1 and Florida Adminis trative Code Rules

13864B9 - 8.005(2) and 64B9 - 8.005(15), and, if so, what discipline

153PRELIMINARY STATEMENT

155On September 29, 2003, Petitioner, the Department of

163Health, Board of Nursing (Department), filed a two - count

173Administrative Complai nt against Respondent, Beatrice A.

180Henderson (Ms. Henderson), alleging that she violated Subsection

188464.018(1)(h), Florida Statutes, by engaging in unprofessional

195conduct as defined in Florida Administrative Code Rules 64B9 -

2058.005(2) and 6B9 - 8.005(15). Ms. Henderson requested an

214administrative hearing by an Election of Rights Form dated

223November 24, 2003. The case was forwarded to the Division of

234Administrative Hearings on March 14, 2005.

240On May 20, 2005, Petitioner filed Petitioner's Motion to

249Take Offici al Recognition of certain rules. The motion was

259granted, and an O rder was entered on May 25, 2005, taking

271official recognition of the following rules: Florida

278Administrative Code Rule 64B9 - 8.005, which was in effect from

289March 23, 2000, until February 14 , 2002; Florida Administrative

298Code Rule 64B9 - 12.002, which has been in effect from January 16,

3111991, to the present; Florida Administrative Code Rule 64B9 -

32112.003, which has been in effect from April 9, 1998, to the

333present; and Florida Administrative Code Rule 64B9 - 12.004, which

343has been in effect from January 16, 1991, to the present.

354At the final hearing, the Department called the following

363witnesses: Carol Paris, Donna Payne, Sidronio Casas, Erlinda

371Lagman, Norma Dorothy Collins, and Bonnie Edwina Stra de.

380Petitioner's Exhibits 1 through 8 were admitted in evidence. At

390the final hearing, Ms. Henderson testified on her own behalf.

400Respondent's Exhibits 1 through 5 were admitted in evidence.

409The parties agreed to file their proposed recommended

417orders w ithin ten days of the filing of the two - volume

430Transcript, which was filed on August 3, 2005. The Department

440filed its Proposed Recommended Order on August 12, 2005. As of

451the date of the Recommended Order, Ms. Henderson has not filed a

463proposed recommen ded order.

467FINDINGS OF FACT

4701. The Department is the agency of the State of Florida

481charged with the responsibility for the investigation and

489prosecution of complaints involving nurses licensed to practice

497in Florida.

4992. Ms. Henderson is and was, at all times material to this

511proceeding, a Licensed Practical Nurse (LPN), licensed to

519practice nursing in Florida, having been issued license number

528PN1279561.

5293. In July 2001, Ms. Henderson was employed as a LPN II at

542Lucerne Transitional Care Center (Lucerne ). Lucerne is a

551hospital - based skilled nursing unit, similar to a nursing home

562and is part of the Orlando Regional Healthcare System (Orlando

572Regional). The policies of Orlando Regional apply to all the

582hospitals within Orlando Regional, including Lucern e. One of

591the policies of Orlando Regional deals with the types of IV

602medications that can be administered by a LPN and provides:

612LPN - IV medications may be administered by

620LPN's who have completed the IV therapy

627course required by the Florida State Boar d,

635and demonstrated competency.

6381. Exception: Aspects of intravenous

643therapy that are outside the scope of

650practice of the LPN per Florida State Board

658and therefore not allowed in ORH facilities

665are:

666a. Initiation of blood or blood products;

673b. Initiat ion of administration of cancer

680chemotherapy;

681c. Initiation of plasma expanders;

686d. Initiation of administration of

691investigational drugs;

693e. Mixing IV solutions;

697f. IV pushes, except heparin and saline

704flushes.

705The policy further provides that IV pus hes may be administered

716by a qualified Registered Nurse (RN). Florida Administrative

724Code Rule 64B9 - 12.003(1) allows a LPN to administer IV pushes if

737done under the direct supervision of a RN or physician; however,

748Orlando Regional's policy prohibited LPN s from administering

756medications by IV push even if a RN or physician was directly

768supervising the IV push.

7724. R.U. was a patient at Lucerne on July 28, 2001. R.U.

784was a quadriplegic who had infected decubiti. When he was

794admitted on July 20, 2001, his physician ordered morphine

803sulfate to be administered for pain. The order provided:

812MORPHINE SULFATE INJ 8 MG. IV PUSH, O2H,

820PRN -- SEVERE PAIN -- MAY GIVE 6 - 8 MG.

8315. Ms. Henderson was on the team assigned to provide care

842for R.U. on July 28, 2001. At appr oximately 0130 hours on that

855date, R.U. requested his pain medication. Ms. Henderson went to

865get the RN on her team to administer the morphine sulfate. The

877RN was dressing another patient's wounds and could not leave the

888patient until the wounds were cov ered. The RN told Ms.

899Henderson that R.U. would have to wait until she finished

909dressing the wounds.

9126. Although Ms. Henderson was aware of the Orlando

921Regional's policy , which did not allow a LPN to administer

931medication by IV push, she did not wait f or the RN, but decided

945to administer the morphine sulfate by IV push herself. Instead

955of administering the dosage ordered by the physician, she

964administered ten milligrams. R.U. questioned Ms. Henderson

971about her ability to administer an IV push, stating that his

982home health care nurse could not do so. Ms. Henderson told him

994that she was qualified to do it and that an RN was on the

1008premises.

10097. On July 28, 2001, at 0430 hours, R.U. again asked for

1021pain medication. The RN on duty was not available to gi ve the

1034IV push because she was with another patient providing wound

1044care. Again, Ms. Henderson took it upon herself to administer

1054the morphine sulfate by IV push and administered ten milligrams,

1064in violation of the physician's order.

10708. Neither the RN on duty nor the RN supervisor delegated

1081to Ms. Henderson the authority to administer IV push medications

1091to R.U. Ms. Henderson was not under direct supervision of an RN

1103either time she administered the morphine sulfate to R.U. by IV

1114push.

11159. Ms. Henderson was aware that the physician's order for

1125R.U. was for an eight - milligram dose of morphine sulfate. In a

1138letter dated March 1, 2002, to an attorney for the Department,

1149she stated:

1151I administered 10 mg. b ecause I thought that

1160amount would be effective in re lieving my

1168patient's severe pain. I did read the

1175orders, took the facts into consideration,

1181and used the dose range calculation and

1188determined that since so much time had

1195elapsed, it would be acceptable.

120010. The physician's order for the morphine sulfat e by IV

1211push was never changed by the physician to ten milligrams while

1222R.U. was at Lucerne.

122611. The morphine sulfate by IV push was administered to

1236R.U. through a Groshong catheter. Medication administered

1243through a Groshong catheter travels directly t o the big central

1254vena cava vein of the patient. Improper administration of

1263medication through a Groshong catheter is dangerous because it

1272can cause respiratory distress or even death to a patient.

128212. Ms. Bonnie Strade, a RN, testified on behalf of the

1293Department and was qualified as an expert in the field of

1304nursing for both RNs and LPNs. It was Ms. Strade's opinion ,

1315which is credited, that Ms. Henderson's administration on two

1324occasions of ten milligrams of morphine sulfate by IV push to

1335R.U. did not conform to the minimum standards of acceptable and

1346prevailing nursing practice.

1349CONCLUSIONS OF LAW

135213. The Division of Administrative Hearings has

1359jurisdiction over the parties to and the subject matter of this

1370proceeding. §§ 120.569 and 120.57, Fla. Stat. (2004).

137814. The Department has the burden to establish the

1387allegations in the Administrative Complaint by clear and

1395convincing evidence. Department of Banking and Finance v.

1403Osborne Stern & Co. , 670 So. 2d 932 (Fla. 1996).

141315. The Department alle ged in the Administrative Complaint

1422that Ms. Henderson violated Subsection 464.018(1)(h), Florida

1429Statutes, which provides that the following constitutes grounds

1437for taking disciplinary action against LPN's in Florida :

1446Unprofessional conduct, which shall include

1451but not be limited to, any departure from,

1459or the failure to conform to, the minimum

1467standards of acceptable and prevailing

1472nursing practice, in which case actual

1478injury need not be established.

148316. In Count I of the Administrative Complaint, the

1492Department alleged that Ms. Henderson was guilty of

1500unprofessional conduct as defined in Florida Administrative Code

1508Rule 64B9 - 8.005(2), which includes "[a]dministering medications

1516or treatments in a negligent manner" in the definition of

1526unprofessional c onduct.

152917. Florida Administrative Code Rule 64B9 - 12.003(1)

1537provides:

1538(1) Aspects of intravenous therapy which

1544are outside the scope of practice of the

1552licensed practical nurse unless under the

1558direct supervision of the registered

1563professional nurse or p hysician and which

1570shall not be performed or initiated by the

1578licensed practical nurse without direct

1583supervision include the following:

1587(a) initiation of blood or blood products;

1594(b) initiation or administration of cancer

1600chemotherapy;

1601(c) initiation o f plasma expanders;

1607(d) initiation or administration of

1612investigational drugs;

1614(e) mixing Iv solution;

1618(f) IV pushes except heparin flushes and

1625saline flushes.

162718. Florida Administrative Code Rule 64B9 - 12.002 defines

"1636direct supervision" as "on the pr emises and immediately

1645physically available." Although a RN was on the premises when

1655Ms. Henderson administered the medication by IV push, the RN was

1666not immediately physically available. The RN was changing the

1675dressing on a wound that she could not lea ve uncovered in order

1688to immediately assist Ms. Henderson if necessary.

169519. Ms. Henderson violated Orlando Regional policy by

1703administering the medication by IV push. The policy prohibited

1712a LPN from administering IV pushes , except heparin flushes and

1722sa line flushes even if the LPN was under the direct supervision

1734of a RN.

173720. Ms. Henderson failed to administer the dosage

1745prescribed by R.U.'s physician. She administered ten milligrams

1753instead of the six to eight milligrams , which had been ordered

1764by the physician.

176721. The Department has established by clear and convincing

1776evidence that Ms. Henderson was guilty of unprofessional conduct

1785by administering the morphine sulfate in a negligent manner.

1794Thus, Ms. Henderson violated Subsection 464.018(1)(h), Fl orida

1802Statutes , by violating Florida Administrative Code Rule 64B9 -

18118.005(2).

181222. In Count II of the Administrative Complaint, the

1821Department alleged that Ms. Henderson was guilty of

1829unprofessional conduct as defined in Florida Administrative Code

1837Rule 64 B9 - 8.005(15), which includes "[p]racticing beyond the

1847scope of the licensee's license, education preparation, or

1855nursing experience" in the definition of unprofessional conduct.

1863The Department has established by clear and convincing evidence

1872that Ms. Hend erson practiced beyond the scope of her license

1883when she administered morphine sulfate to R.U. by IV push

1893without the direct supervision of a RN or physician. Thus, Ms.

1904Henderson violated Subsection 464.018(1)(h), Florida Statutes,

1910by violating Florida Ad ministrative Code Rule 64B9 - 8.005(15).

1920RECOMMENDATION

1921Based on the foregoing Findings of Fact and Conclusions of

1931Law, it is

1934RECOMMENDED that a final order be entered finding that

1943Beatrice A. Henderson violated Subsection 464.018(1)(h), Florida

1950Statutes, b y violat ing Florida Administrative Code Rules 64B9 -

19618.005(2) and 64B9 - 8.005(15); imposing an administrative fine of

1971$350; and placing her on probation for two years.
