89This cause came on to be heard pursuant to Sections 766.304
100and 766.305(7), Florida Statutes, upon the stipulation and joint
109petition of the Petitioners and Respondent, filed August 11,
1182005, for the entry of an order approv ing the resolution of a
131formal claim for compensation benefits heretofore filed in this
140cause in accordance with the provisions of Chapter 766, Florida
150Statutes, and a resolution of the exclusive remedy otherwise
159available as outlined in Chapter 766, Flori da Statutes.
168By the terms of their stipulation, the parties have agreed
178that Petitioners, Suleyman Olgar and Chene Olgar, are the
187parents and natural guardians of Ahmed Olgar (Ahmed), a deceased
197minor; that Ahmed was born a live infant on January 19, 2004, at
210Spring Hill Regional Hospital, a hospital located in Spring
219Hill, Florida; and that Ahmed's birth weight exceeded 2,500
229grams. The parties have further agreed that the physician
238delivering obstetrical services at Ahmed's birth was
245Samir Shakfeh, M.D., who, at all times material hereto, was a
"256participating physician" in the Florida Birth - Related
264Neurological Injury Compensation Plan, as defined by Section
272766.302(7), Florida Statutes. Finally, by their stipulation,
279the parties have agreed that Ahmed s uffered a "birth - related
291neurological injury," as that term is defined by Section
300766.302(2), Florida Statutes.
303After due consideration of the interests of all parties,
312and being otherwise fully advised in the premises, it is
322ORDERED that:
3241. The stipulat ion and joint petition of the parties,
334filed August 11, 2005, is hereby approved, and the parties are
345directed to comply with the provisions thereof.
3522. Petitioners, Suleyman Olgar and Chene Olgar, as the
361parents of Ahmed Olgar, a deceased minor, are awar ded One
372hundred thousand dollars ($100,000.00), pursuant to Section
380766.31(1)(b), Florida Statutes, to be paid in lump sum.
3893. Upon payment of the award of One hundred thousand
399dollars ($100,000.00), a death benefit of Ten thousand dollars
409($10,000.00), a ttorney's fees and other expenses of Eleven
419thousand Five hundred f ive dollars and seventy - two cents
430($1 1,505.72 ), and past expenses, the claims of Petitioners
441(claimants) shall be deemed fully satisfied and extinguished.
4494. The Division of Administrative Hearings retains
456jurisdiction over this matter to resolve any dispute as to the
467interpretation of any provision of the parties' stipulation and
476to resolve any disputes, should they arise, regarding the
485parties' compliance with the terms of such stipulatio n.
