43Petitioner filed a Motion for Summary Disposition,
50requesting that Petitioner be awarded attorney s fees and costs
61they incurred in the underlying case (Case Number 04 - 1593) in
73which they were the prevailing part y . Respondent did not file a
86response to Petitioner s Motion. After review of the Motion,
97being otherwise advised of the premises , and since there are no
108disputed issues of fact , summary disposition is appropriate.
116STATEMENT OF THE ISSUE
120The issue in this proceeding is wheth er Petitioner is
130entitled to attorneys fees and costs.
136FINDINGS OF FACT
1391. This case was filed by Petitioner on behalf of Ida
150Heaps pursuant to Section 760.35, Florida Statutes. The case
159alleged that Respondent discriminated against Petitioner, Hea ps,
167based on race when Respondent did not lease a home to Petitioner
179Heaps.
1802. On July 22, 2004, in Tavares, Florida, a one - day
192hearing was held after which post - hearing recommended orders
202were filed. Based on the evidence a R ecommended O rder findin g
215Respondent guilty of a discriminatory housing practice against
223Ms. Heaps in violation of Section 760.23(1), Florida Statutes ,
232was entered on February 1, 2005. Petitioner w as therefore the
243prevailing part y in this matter. The R ecommended O rder also
255foun d that Petitioner w as entitled to attorneys fees and costs;
267and reserved jurisdiction to determine the amount of fees and
277costs in the event the parties were unable to agree on such an
290award.
2913. On January 31, 2005, the Commission issued its F inal
302O rder approving the R ecommended O rder. The time limit for
314appealing the F inal O rder has passed.
3224. Petitioner ha s not been able to resolve the amount of
334fees and costs incurred in this matter.
3415. As evidence of the amount of attorneys fees,
350Pe titioner, FCHR, submitted an affidavit outlining the hours and
360costs spent incurred in the underlying case by its attorney .
371The requested fees are limited to hours expended on Petitioners
381behalf in DOAH Case No. 04 - 1593, including time spent in travel
394a nd establishing a right to attorneys fees and costs.
404Petitioners attorney spent a total of 53 hours on this case,
415which include 46 hours for legal services and seven hours for
426travel. The hours multiplied by the reasonable rate results in
436a total of $1 4,850.00 for attorneys fees. The Commissions
447direct costs total $453.70, which include the travel costs of
457Petitioner s attorney and investigator to attend the hearing and
468the court reporters fee .
4736 . The time spent on this case by the Petitioner s
485attorney was reviewed by an outside expert. The expert has
495found the time to be reasonable and has recommended a reasonable
506hourly rate, arrived at independently of the Commission and its
516attorneys and without direction by Petitioner, based on the
525natur e, novelty and complexity of the case, and the expertise of
537the Petitioners attorney in federal and Florida administrative
545and anti - discrimination law. The expert opin ed that a rate of
558$300.00 per hour legal services and $150.00 per hour for travel
569was r easonable .
5737 . Respondent did not challenge the affidavit of
582Petitioner s o r the expert s opinion. The amount of hours and
597costs reflected in the affidavit are reasonable for this type of
608case. Likewise , the hourly fees for such litigation are
617reas onable for this type of case and the long experience of
629Petitioner s attorney. Therefore, Petitioner, FCHR , is entitled
638to an award of attorney s fees and costs in the amount of
652$15,303 . 70.
656CONCLUSIONS OF LAW
6598 . The Division of Administrative Heari ngs has
668jurisdiction over the parties to and the subject matter of this
679proceeding. § 120.57(1), Fl a. Stat.
6859 . What constitutes a reasonable award of attorney s fees
697and costs and the proof necessary to make a showing of
708reasonableness were set fort h by the Supreme Court of Florida in
720Florida Patients Compensation Fund v. Rowe , 472 So. 2d. 1145
730(Fla. 1985). The reasonableness of fees is determined by such
740factors as the difficulty of the questions involved, the fee
750customarily charged in the locali ty for similar legal services
760and the experience and ability of the attorney. Rowe at 1150.
7711 0 . In this case , Petitioner has established the
781reasonableness of the hours, co s ts and rate s incurred in the
794underlying action.
796ORDER
797Based upon the foregoi ng Findings of Fact and Conclusions
807of Law, it is
811ORDERED:
812Petitioner FCHR is entitled to an award of attorneys fees
822and costs in the amount of $ 15,303.70.
