141STATEMENT OF THE ISSUE

145The issue to be resolved in this portion of the power plant

157site certification proceeding is whether the site for the

166proposed Treasure Coast Energy Center (TCEC) is consistent and

175in compliance with the applicable land use plans and zoning

185ordinances of St. Lucie County (County), Florida, pursuant to

194Section 403.508(2), Florida Statutes (2005) 1 .

201PRELIMINARY STATEMENT

203This proceeding was conducted pur suant to the Florida

212Electrical Power Plant Siting Act (PPSA), codified in Part II of

223Chapter 403, Florida Statutes, and Florida Administrative Code

231Chapter 62 - 17 to consider Florida Municipal Power Agency's

241(FMPA) application for power plant site certific ation of the

251TCEC Project. On April 14, 2005, FMPA filed with the Department

262of Environmental Protection (Department) an application for site

270certification for the Project. By agreement of the parties,

279this land use hearing was scheduled to be held on Fe bruary 8,

2922006, as part of the final certification hearing also held on

303the same date. However, separate Recommended Orders are being

312rendered as to the land use and certification portions of the

323hearing. This Recommended Order addresses the land use iss ues.

333After appropriate notice by the Applicant and the

341Department, the consolidated land use and certification hearing

349was held on February 8, 2006, in Fort Pierce, Florida. The

360hearing was conducted, in part, for the purpose of receiving

370evidence as to whether the Project site was in compliance with

381the local land use plans and zoning regulations of the County.

392On February 6, 2006, FMPA and the County filed a

402Stipulation addressing land use and zoning issues. The

410Stipulation indicated that the County a nd FMPA agreed that the

421site for the Project is consistent and in compliance with the

432County's future land use map designations and zoning ordinances

441and approvals.

443At the hearing, FMPA presented four expert witnesses who

452offered testimony in the follow ing areas: James Hay, Project

462overview; Stanley A. Armbruster, design of plant and associated

471facilities; J. Michael Soltys, Project site conditions; and

479Dennis J. Murphy, land use planning. Also, it offered FMPA

489Exhibits 1 through 15, which were receive d in evidence.

499The Department presented Hamilton S. Oven, Jr., who is the

509Department Administrator for the Siting Coordination Office and

517was accepted as an expert. Also, it offered Department Exhibits

5271 and 2, which were received in evidence.

535A sing le set of exhibits was tendered and used at the

547hearing for both the land use and certification portions of the

558hearing; however, as noted above, separate Recommended Orders

566are being rendered.

569The County presented no witnesses and no exhibits. No

578other party participated in this hearing.

584Opportunity was afforded for members of the general public

593to appear. One member of the public, Elie J. Boudreaux, III,

604who is Director of the Fort Pierce Utilities Authority, offered

614sworn oral comments in support of the Project. No party or

625member of the public offered testimony or evidence contrary to

635the conclusion that the site for the Project is consistent and

646in compliance with local land use plans and zoning ordinances of

657the County.

659Notice of the consolidated land use and site certification

668hearing was published by FMPA in the Fort Pierce Tribune , a

679local newspaper of general circulation, on December 22, 2005.

688Notice of the land use and certification hearing was also

698published by the Department on its Officia l Notices website on

709December 16, 2005, pursuant to Section 120.551, Florida

717Statutes.

718The Transcript of the hearing was filed on March 1, 2006.

729On March 20, 2006, a Joint Proposed Recommended Order was filed

740by FMPA, the Department, and the County, and it has been

751substantially used in the preparation of this Recommended Order.

760FINDINGS OF FACT

763Based upon all of the evidence the following findings of

773fact are determined:

7761. FMPA is a joint action agency created under Florida law

787and comprises twenty - n ine municipal electric utilities across

797Florida. It was created to allow its member utilities to

807cooperate with each other on the basis of mutual advantage

817through the financing, construction, ownership, and operation of

825electrical generating resources. FMPA is governed by a Board of

835Directors consisting of one representative from each of the

844twenty - nine member cities. Within FMPA, the All - Requirements

855Project (ARP) was formed in 1986 and currently has fifteen

865municipal members serving approximately 280, 000 customers.

872Under the ARP, both generating and non - generating members are

883required to purchase all of their capacity and electrical energy

893needs from the ARP. Additionally, ARP members with generating

902plants commit their capacity to FMPA. FMPA will o wn TCEC and

914act as the project manager for construction. The Fort Pierce

924Utilities Authority will operate the TCEC Unit 1 for FMPA.

9342. FMPA filed with the Department a Site Certification

943Application (Application) for the TCEC on April 14, 2005. The

953Ap plication seeks a certification under the PPSA for the

963construction and operation of a 300 - megawatt natural gas - fired

975electrical generation facility, including accessory and

981ancillary facilities to be located in the County. The

990Application also seeks an u ltimate site capacity determination

999under the PPSA for 1,200 megawatts of electrical generating

1009capacity on the proposed site.

10143. TSEC is located in an unincorporated portion of the

1024County. The site is located five miles southwest of Fort Pierce

1035and ei ght miles northwest of Port St. Lucie and comprises

1046approximately sixty - nine acres.

10514. The site is a greenfield site currently used as active

1062pasture for cattle and horses. It is located in the Midway

1073Industrial Park near Fort Pierce. The site is borde red on the

1085north and west by a rail line along Glades Cut Off Road, and to

1099the south by an existing electrical transmission line right - of -

1111way. Land to the east is the undeveloped industrial park. A

1122wastewater treatment plant is proposed for a land parcel to the

1133north of the site. Lands surrounding the site are zoned for

1144industrial uses.

11465. The TCEC will consist initially of one nominal 300 -

1157megawatt combined cycle electrical generating unit and accessory

1165and ancillary facilities. These additional faci lities include

1173control and maintenance buildings, water treatment and storage

1181facilities, ultra low - sulfur light oil storage tanks, cooling

1191tower, and electrical switchyard. An additional 900 megawatts

1199of electrical generation facilities and accessory and ancillary

1207facilities may be constructed on the site in the future subject

1218to necessary approvals under the PPSA. The proposed units will

1228be fueled primarily with natural gas with ultra low - sulfur fuel

1240oil as a backup fuel.

12456. The County has adopted it s Comprehensive Plan (Plan)

1255pursuant to the requirements of Chapter 163, Florida Statutes,

1264and Florida Administrative Code Chapter 9J - 5. That Plan has

1275been determined to be in compliance with the requirements of

1285Florida law. No portion of that Plan mater ial to the Project

1297and the site is subject to challenge in any proceeding.

13077. The site has a future land use designation on the

1318Plan's Future Land Use Map (FLUM) of Transportation/Utilities.

1326Electrical generation facilities are an allowed use within tha t

1336future land use designation.

13408. The site is zoned Utilities under the Zoning District

1350Use Regulations in the County's Land Development Code and is

1360shown in the Utilities Zoning District on the official Zoning

1370Map of the County. Electric generation pl ants are a Conditional

1381Use in the Utilities Zoning District.

13879. Conditional Uses are defined in Section 2.00.00 of the

1397Land Development Code as a "use that is generally compatible

1407with the use characteristics of a zoning district, but that

1417requires indi vidual review of its location, design, potential

1426effect on nearby properties, and configuration in accordance

1434with Section 11.07.00 [of the Land Development Code] to

1443determine the appropriateness of the use on any particular site

1453in the district."

145610. O n November 1, 2005, by County Resolution 05 - 388, the

1469St. Lucie County Board of County Commissioners (Commissioners)

1477granted a Conditional Use Permit and Major Site Plan Approval

1487for the site. That Resolution approved the use of the site for

1499electrical gen erating facilities. As part of its approval of

1509the Conditional Use Permit and Major Site Plan Approval, the

1519Commissioners determined that the site and its use for

1528electrical generating facilities were consistent with the

1535adopted Plan, including the Future Land Use Element (FLUE) and

1545accompanying FLUM.

154711. During that same meeting, FMPA agreed to, and the

1557Commissioners approved, a Conditional Use Permit and Major Site

1566Plan Approval for only two of the originally proposed four

1576units, thereby reducing the Project from a 1200 - megawatt, four -

1588unit Project to a 600 - megawatt, two - unit Project for purposes of

1602the County's zoning approvals. FMPA also agreed to obtain

1611additional zoning reviews and approvals prior to the

1619construction of the third and fourth units proposed at the site.

1630By its zoning action, the Commissioners did not disapprove

1639additional future units.

164212. Resolution 05 - 388 contains certain conditions related

1651to the Project and the site and a site plan for the use of the

1666site. These conditions relate to an updated landscape plan,

1675construction traffic mitigation plans, a limitation on the fuels

1684to be used at the site without further approval by the

1695Commissioners, and annual contributions by FMPA toward

1702environmental protection in the County.

170713 . FMPA is able to design, construct, and operate the

1718Project in full compliance with the conditions contained in the

1728Conditional Use Permit and Major Site Plan Approval.

1736CONCLUSIONS OF LAW

173914. The Division of Administrative Hearings has

1746jurisdiction of the parties and the subject matter of this

1756proceeding pursuant to Sections 120.569, 120.57 and 403.508(2),

1764Florida Statutes.

176615. In accordance with Chapter 403, Florida Statutes, and

1775Florida Administrative Code Chapter 62 - 17, proper public notice

1785was acc orded all persons, entities, and parties entitled to such

1796notice. All necessary and required governmental agencies, as

1804well as members of the public, either participated in or had the

1816opportunity to participate in the land use hearing.

182416. The applicab le land use plans and zoning ordinances

1834for the Project and its site are those adopted by the County.

1846For purposes of the land use hearing, under Section 403.508(2),

1856Florida Statutes, the applicable "land use plan" is the Plan's

1866FLUE and the accompanying FLUM. The applicable zoning

1874ordinances for the Project and its site are contained in the

1885Land Development Code and in the Conditional Use Permit issued

1895by the Commissioners.

189817. Unrebutted evidence at the hearing demonstrates that

1906the Project and its sit e are consistent and in compliance with

1918the County's Plan and are consistent and in compliance with the

1929Land Development Code. Additional zoning reviews will be

1937necessary prior to the certification of generating capacity

1945above the initial 600 megawatts.

1950R ECOMMENDATION

1952Based upon the foregoing Findings of Fact and Conclusions

1961of Law, it is

1965RECOMMENDED that the Siting Board enter a final order

1974determining that the Treasure Coast Energy Center Project and

1983its site, as described by the evidence presented at the hearing,

1994are consistent and in compliance with existing land use plans

2004and zoning ordinances and site - specific zoning approvals of the

2015County, pursuant to Section 403.508(2), Florida Statutes.
