136STATEMENT OF THE ISSUES
1401. Whether Patrick Lambright, a minor, qualifies for
148coverage under the Florida Birth - Related Neurological Injury
157Compensation Plan (Plan).
1602. If so, whether the hospital and the participating
169physician g ave the patient notice, as contemplated by Section
179766.316, Florida Statutes, or whether notice was not required
188because the patient had an "emergency medical condition," as
197defined by Section 395.002(9)(b), Florida Statutes, or the
205giving of notice was no t practicable.
212PRELIMINARY STATEMENT
214On June 13, 2005, Cheryl Lambright and Paul Vincent
223Lambright, individually, and as parents and natural guardians of
232Patrick Lambright (Patrick), a minor, filed a petition with the
242Division of Administrative Hearings (D OAH) to resolve whether
251Patrick qualified for compensation under the Plan and, if so,
261whether the health care providers complied with the notice
270provisions of the Plan.
274DOAH served the Florida Birth - Related Neurological Injury
283Compensation Association (NICA ) with a copy of the petition on
294June 14, 2005, and on August 25, 2005, following an extension of
306time within which to do so, NICA responded to the petition and
318gave notice that it was of the view Patrick did not suffer a
"331birth - related neurological injury ," as defined by Section
340766.302(2), Florida Statutes, and requested that a hearing be
349scheduled to resolve whether the claim was compensable. In the
359interim, Naples Community Hospital, Inc., d/b/a North Collier
367Hospital (the hospital at which the infant was born) and
377Jeffrey Heitmann, M.D. (the participating physician who provided
385obstetrical services at the infant's birth) were granted leave
394to intervene.
396A hearing to address compensability and notice was
404initially scheduled for March 14 and 15, 2006, ho wever, at the
416parties' request, the hearing was rescheduled for June 28 and
42629, 2006. Notably, by notice filed June 19, 2006, and June 26,
4382006, respectively, North Collier Hospital and Dr. Heitmann
446withdrew from these proceedings.
450At hearing, Respondent' s Exhibit 1 was received into
459evidence. No witnesses were called and no further exhibits were
469offered.
470FINDINGS OF FACT
473Stipulated facts
4751. Cheryl Lambright and Paul Vincent Lambright are the
484natural parents and guardians of Patrick Lambright, a minor.
493Patrick was born a live infant on September 25, 2001, at North
505Collier Hospital, a hospital located in Naples, Florida, and his
515birth weight exceeded 2,500 grams.
5212. Obstetrical services were delivered at Patrick's birth
529by Jeffrey Heitmann, M.D., who, at all times material hereto,
539was a "participating physician" in the Florida Birth - Related
549Neurological Injury Compensation Plan, as defined by Section
557766.302(7), Florida Statutes.
560Further findings related to compensability
5653 . The only proof offered at h earing on the issue of
578compensability was a r eport of neurology evaluation prepared by
588Michael Duchowny, M.D., a pediatric neurologist associated with
596Miami Children's Hospital, who, based on his review of Patrick's
606birth records and his evaluation of Patr ick on August 3, 2005,
618concluded that Patrick's abnormalities were most likely
625developmentally based, as opposed to birth - related , and,
634regardless of the etiology of his abnormalities, Patrick was not
644substantially mentally or physically impaired. (Respon dent's
651Exhibit 1) Dr. Duchowny noted the results of his evaluation, as
662follows:
663NEUROLOGICAL EXAMINATION reveals Patrick to
668have difficulty with the evaluation as his
675attention span wanders and he does not make
683good eye contact. His speech output is
690dimi nished and there is marred lingual and
698labial disarticulation. The tongue
702movements are poorly coordinated. The uvula
708is midline and the pharyngeal folds are
715symmetric. Motor examination reveals
719symmetric strength and bulk. There is
725generalized hypoton ia and bilateral SMO's
731are inserted into Patrick's shoes. He can
738build a tower of seven cubes but his fine
747motor coordination is poor and there is a
755mild intention tremor. There are no other
762adventitious movements. No focal weakness
767or atrophy is noted. Sensory examination is
774intact to withdrawal of all extremities to
781stimulation. The deep tendon reflexes are
7872 - 3 and plantar responses are downgoing.
795Patrick walks in a consistent fashion with
802symmetric arm swing and turns crispy. He
809gets up from a st anding position without
817difficulty and his head control is well -
825developed. There are no pathological
830reflexes. The neurovascular examination
834reveals no cervical, cranial, or ocular
840bruits and no temperature or pulse
846asymmetries.
847In SUMMARY, Patrick's ne urological
852examination reveals developmental
855abnormalities in multiple domains consistent
860with a diagnosis of pervasive developmental
866disorder. He is clearly most affected in
873the area of language but has problems in
881motor coordination, social development, and
886attention. Patrick is developmentally
890abnormal, I do not believe that he has a
899substantial mental or motor impairment and I
906suspect that he will improve considerably in
913the future. A review of his birth records
921does not support the contention that
927P atrick's problems were acquired during
933labor and delivery. His MRI scan of
940April 14, 2004 reveals periventricular
945leukomalacia and thalamic gliosi s . They are
953most likely to be acquired prenatally. I
960therefore do not believe that Patrick is
967compensable u nder the NICA statute.
973CONCLUSIONS OF LAW
9764 . The Division of Administrative Hearings has
984jurisdiction over the parties to, and the subject matter of,
994these proceedings. § 766.301, et seq ., Fla. Stat.
10035 . The Florida Birth - Related Neurological Injury
1012Com pensation Plan was established by the Legislature "for the
1022purpose of providing compensation, irrespective of fault, for
1030birth - related neurological injury claims" relating to births
1039occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
10506 . The i njured "infant, her or his personal
1060representative, parents, dependents, and next of kin," may seek
1069compensation under the Plan by filing a claim for compensation
1079with the Division of Administrative Hearings. §§ 766.302(3),
1087766.303(2), 766.305(1), and 766 .313, Fla. Stat. The Florida
1096Birth - Related Neurological Injury Compensation Association,
1103which administers the Plan, has "45 days from the date of
1114service of a complete claim . . . in which to file a response to
1129the petition and to submit relevant written information relating
1138to the issue of whether the injury is a birth - related
1150neurological injury." § 766.305(4), Fla. Stat.
11567 . If NICA determines that the injury alleged in a claim
1168is a compensable birth - related neurological injury, it may award
1179compensat ion to the claimant, provided that the award is
1189approved by the administrative law judge to whom the claim has
1200been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
1211NICA disputes the claim, as it has in the instant case, the
1223dispute must be reso lved by the assigned administrative law
1233judge in accordance with the provisions of C hapter 120, F lorida
1245Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
12538 . In discharging this responsibility, the administrative
1261law judge must make the following dete rmination based upon the
1272available evidence:
1274(a) Whether the injury claimed is a
1281birth - related neurological injury. If the
1288claimant has demonstrated, to the
1293satisfaction of the administrative law
1298judge, that the infant has sustained a brain
1306or spinal c ord injury caused by oxygen
1314deprivation or mechanical injury and that
1320the infant was thereby rendered permanently
1326and substantially mentally and physically
1331impaired, a rebuttable presumption shall
1336arise that the injury is a birth - related
1345neurological injur y as defined in s.
1352766.303(2).
1353(b) Whether obstetrical services were
1358delivered by a participating physician in
1364the course of labor, delivery, or
1370resuscitation in the immediate post - delivery
1377period in a hospital; or by a certified
1385nurse midwife in a tea ching hospital
1392supervised by a participating physician in
1398the course of labor, delivery, or
1404resuscitation in the immediate post - delivery
1411period in a hospital.
1415§ 766.309(1), Fla. Stat. An award may be sustained only if the
1427administrative law judge concl udes that the "infant has
1436sustained a birth - related neurological injury and that
1445obstetrical services were delivered by a participating physician
1453at birth." § 766.31(1), Fla. Stat.
14599 . Pertinent to this case, "birth - related neurological
1469injury" is defined by Section 766.302(2), to mean:
1477injury to the brain or spinal cord of a live
1487infant weighing at least 2,500 grams for a
1496single gestation or, in the case of a
1504multiple gestation, a live infant weighing
1510at least 2,000 grams at birth caused by
1519oxygen depriva tion or mechanical injury
1525occurring in the course of labor, delivery,
1532or resuscitation in the immediate
1537postdelivery period in a hospital, which
1543renders the infant permanently and
1548substantially mentally and physically
1552impaired. This definition shall apply to
1558live births only and shall not include
1565disability or death caused by genetic or
1572congenital abnormality.
157410 . Here, the proof failed to support a conclusion that,
1585more likely than not, Patrick, suffered a "birth - related
1595neurological injury," as defined by the Plan. Consequently,
1603Patrick does not qualify for coverage under the Plan, and it is
1615unnecessary to address whether the hospital and the
1623participating physician complied with the notice provisions of
1631the Plan. See § 766.309, Fla. Stat.
163811 . Where, as here, the administrative law judge
1647determines that "the injury alleged is not a birth - related
1658neurological injury . . . he [is required to] enter an order [to
1671such effect] and . . . cause a copy of such order to be sent
1686immediately to the parties by re gistered or certified mail."
1696§ 766.309(2), Fla. Stat. Such an order constitutes final agency
1706action subject to appellate court review. § 766.311(1), Fla.
1715Stat.
1716CONCLUSION
1717Based on the foregoing Findings of Fact and Conclusions of
1727law, it is
1730ORDERED t hat the petition for compensation filed by
1739Cheryl Lambright and Paul Vincent Lambright, individually, and
1747as parents and natural guardians of Patrick Lambright, a minor,
1757is dismissed with prejudice.
