134STATEMENT OF THE ISSUE

138The issue is whether Respondent , Greenblades of Central

146Florida, Inc., and its surety, Western Surety Company, are

155liable for funds due to Petitioner from the sale of agricultural

166products.

167PRELIMINARY STATEMENT

169On or about June 24, 2005, Petitioner filed a Producer

179C omplaint with the Florida Department of Agricultur e and

189Consumer Services (the "Department"). The C omplaint alleged

198that Respondent or its surety owed funds to Petitioner for

208nursery products in the amount of $20,512.97 purchased by

218Respondent under the provisions of the Agricultural Bond and

227License Law , Sections 604.15 through 604.34, Florida Statutes.

235Thereafter, on or about July 20, 2005, Petitioner filed an

245A mended C omplaint with the Department reducing the amount owed

256to $8,689.47. On or about August 15, 2005, R espondent filed a

269response to the Am ended Compla int.

276The matter was referred to the Division of Administrative

285Hearings on August 24, 2005. A Notice of Hearing issued

295scheduling the matter for October 24, 2005. The hearing

304commenced that morning in Jacksonville, Florida, with the

312testimon y of Petitioner's witnesses since neither Respondent nor

321a representative of its surety appeared. During the hearing,

330Respondent sent by facsimile to Judge Cohen's office, a request

340for a c ontinuance based upon hurricane - related emergency duties

351Responden t was obligated to perform. After a telephonic hearing

361on Respondent's m otion, the hearing was re - scheduled for

372November 14, 2005, to allow Respondent to present its case and

383for any rebuttal from Petitioner. Petitioner chose not to

392appear on November 14 , 2005, and the hearing commenced and was

403completed that day.

406At the hearing, Petitioner presented the testimony of

414Thomas W. Robinson and Sandra Salyers and offered E xhibit s

425numbered 1 through 7, all of which were admitted, into evidence.

436Respondent pres ented the testimony of Joe Robbins and

445Bill Spriet and offered E xhibit n umbered 1 , which was admitted

457into evidence.

459No t ranscript was filed . Neither Petitioner nor Respondent

469submitted proposed findings of fact and conclusions of law.

490FINDINGS OF FACT

4931. Petitioner is a producer of agricultural products as

502defined by Section 604.15(5), Florida Statutes. Petitioner

509operates a nursery supply company that produces trees, p lants,

519and other landscaping supplies at a location in Bunnell,

528Florida.

5292. Respondent is a dealer in agricultural products as

538defined by S ection 604.15(1), Florida Statutes. At the time of

549the transactions in question, Respondent was a licensed deale r

559in agricultural products supported by a surety bond provided by

569Western Surety Company.

5723. This matter arose over a Producer Complaint filed by

582Petitioner on June 24, 2005, in which it alleged that Respondent

593owed $20,512.97, based upon five invoices for nursery goods

603delivered to various job sites where Respondent was providing

612landscaping services. The five invoices set forth in the

621original Producer Complaint are as follows:

6644. Petitioner later amended its Complaint to withdraw its

673claims under Invoice Nos. 65229 and 65127, as untimely filed,

683resu lting in an amended amount due of $8,689.47.

6935. Respondent filed a Response to the Producer Complaint

702on August 15, 2005, admitting the amounts due under Invoice Nos.

71364679 and 64828, totaling $6,763.47, and denying the amount

723claimed in Invoice No. 6482 9, $1,926.00, as never having been

735filled, resulting in Respondent 's using another vendor to fill

745the order.

7476. Respondent admitted the amounts due under Invoice Nos.

75664679 and 64828 ; therefore , no further discussion is necessary

765for those items , except to note that Delivery Receipt No. 17751,

776relating to Invoice No. 64828 contains the note "Reject 1 Live

787Oak." Therefore, the amount of Invoice No. 64828 must be reduced

798by $214.00 ($200 for the tree and 7 percent Florida Sales Tax).

8107. With respect to In voice No. 64829, however, Petitioner

820produced at hearing only an unsigned invoice without either a

830sales order or a receipt for delivery of goods, as was its

842custom concerning deliveries of nursery goods. Accordingly,

849Petitioner provided no proof that the order under Invoice No.

85964829 was actually delivered to Respondent.

8658. Respondent and its surety, Western Surety Company,

873currently owe Petitioner $2,884.72 under Invoice No. 64679, and

883$3,664.75 under Invoice No. 64828, for a total amount owed of

895$6,54 9.47.

898CONCLUSIONS OF LAW

9019 . The Division of Administrative Hearings has

909jurisdiction over the subject matter of and the parties to this

920proceeding. § § 120.569, 120.57(1), and 604.21(6), Fla. Stat.

92910. Section 604.15, Florida Statutes, contains the

936following definitions in pertinent part:

941(1) ' Agricultural products ' means the

948natural products of the farm, nursery,

954grove, orchard, vineyard, garden, and apiary

960(raw or manufactured); . . . .

967( 2 ) ' Dealer in agricultural products ' means

977any person, partnership, corporation, or

982other business entity, whether itinerant or

988domiciled within this state, engaged within

994this state in the business of purchasing,

1001receiving, or soliciting agricultural

1005products from the producer or the producer's

1012agent or repre sentative for resale or

1019processing for sale; acting as an agent for

1027such producer in the sale of agricultural

1034products for the account of the producer on

1042a net return basis; or acting as a

1050negotiating broker between the producer or

1056the producer's agent or representative and

1062the buyer.

1064* * *

1067(5) ' Producer ' means any producer of

1075agricultural products produced in the state.

108111. Section 604.17, Florida Statutes, requires dealers in

1089agricultural products to have a license to engage in such

1099business.

110012. Before dealers receive their licenses, they must

1108deliver to the Department a surety bond or a certificate of

1119deposit. The surety bond or certificate of deposit secures

1128payment to producers for agricultural products sold to dealers.

1137§ 604.20(1), Fla . St at.

114313. Petitioner has met its burden of proving, by a

1153preponderance of the evidence, that Respondents are indebted to

1162Petitioner for unpaid invoices in the amount of $6,549.47.

1172RECOMMENDATION

1173Based upon the Findings of Fact and Conclusions of Law, it

1184is

1185RECOMMENDED that the Florida Department of Agriculture and

1193Consumer Services enter a Final Order requiring Respondent,

1201Greenblades of Central Florida, Inc., or its surety, Respondent,

1210Western Surety Company, to pay Petitioner $6,549.47 for unpaid

1220inv oices .
