120STATEMENT OF THE ISSUES

124Whether R espondent violated Subsection 486 . 125 (1)( e),

134Florida Statutes (2004 ), 1 and, if so, what discipline should be

147PRELIMINARY STATEMENT

149On June 15 , 2005, Pe titioner, Department of Health , Board

159of Physical Therapy ( Department), filed an Administrative

167Complaint against Respondent, Mich ael G. Westrope, P.T.A. ,

175alleging that he violated Subsection 468 . 125 (1)( e ), Florida

187Statutes. Mr. Westrope requested an administrative hearing, and

195the case was forwarded to the Division of A dministrative

205Hearings on August 29 , 2005, for assignment to an A dministrative

216L aw J udge. On September 30, 2005, Mr. Westrope filed a Motion

229for Brief Continuance , whic h was granted by order dated

239October 5, 2005. The hearing was rescheduled for January 25,

2492006.

250Prior to the final hearing, the parties submitted a Joint

260Prehearing Stipulation, which contained facts to which the

268parties agreed. Those facts , which are contained in Section E

278of the Joint Prehearing Stipulation , are incorporated into this

287Recommended Order to the extent relevant.

293At the final hearing, the Department called the following

302witnesses: D.D. ; Michelle Hulse ; Catherine Page, P.T. , Ph.D. ,

310M.P.H .; Gaspard de Laaf , P.T. ; Tammy Hain , R.N. ; and

320Robert Hudson , O.T . P etitioner's Exhibits 1 through 8 were

331admitted into evidence .

335Mr. Westrope test ified on his own behalf and presented

345Tammy Hain and Robert Hudson as witnesses. Mr. Westrope did not

356offer any exhibits into evidence.

361The official Transcript was filed on February 1 3 , 200 6.

372The parties timely filed their Pro posed Recommended Order s ,

382which have been considered in rendering this Recommended Order.

391FINDINGS OF FACT

3941. The Department is the state agency charged with the

404regulation of medicine pursuant to Chapters 20, 456, and 458,

414Florida Statutes.

4162. Mr. Westrope is , and was at all tim es material to this

429proceeding, a licensed physic al therapy assistant in the State

439of Florida, having been issued license number P T A 1170 .

4513. Beginning in or about September 2004, D. D. was being

462provided physical therapy services through Girling Health Car e,

471Incorporated (Girling). Girling contracted with Rehab Action,

478Incorporated (Rehab) to provide home health physical therapy to

487p atient s. Rehab contracted with Mr. Westrope to perform the

498physical therapy in the patients' homes.

5044. In or about Septembe r 2004, Mr. Westrope was assigned

515to provide physical therapy to D.D. , who had undergone a

525complete knee replacement. D.D. had been assessed by

533Mr. Westrope’s supervising physical therapist , Gaspard de Laaf ,

541on September 29, 2004, prior to Mr. Westrope b eginning his

552physical therapy services on September 30, 2004.

5595. Mr. Westrope was required by Rehab to complete a

569visitation slip at the end of each physical therapy session.

579Mr. de Laaf had provided instruction to M r. Westrope on how to

592complete the for m. Mr. Westrope would send the completed form

603to Mr. de Laaf, who reviewed the form and sent i t to Girling for

618reimbursement.

6196 . When Mr. Westrope provided physical therapy to D.D.,

629she would lie on her bed and perform therapy exercises, and then

641move i nto the kitchen where Mr. Westrope would measure the bend

653in her knee. When each session was over, Mr. Westrope would

664complete a visit slip for the treatment , and D.D. signed them to

676verify that she received the services. D.D. is visually

685impaired and ca n only see light. In order to sign the forms,

698D.D. requested Mr. Westrope to place the forms near the end of

710the kitchen table so that she could align her arm with the table

723edge so that her signature would be in a straight line. D.D.

735always signed her s ignature as " D.A.D. " D.D. prided herself on

746her independence and did not allow anyone else to sign the visit

758slips for her.

7617 . Mr. Westrope provided physical therapy services to D.D.

771on September 30 and October 1, 5, 6, 8, 12, 15, and 22, 2004.

785Mr. de L aaf evaluated D.D. and provided physical therapy

795services to her on October 25, 2004. Mr. Westrope provided

805services to D.D. on October 28, 2004.

8128 . Mr. Westrope completed and submitted v isit s lip

823documentation for physical therapy treatment of D.D. , w hich he

833claimed to have provided on October 16, 2004 ; October 18, 2004 ;

844October 20, 2004 ; October 30, 2004 ; and November 1, 2004.

854However, Mr. Westrope did not provide services to D.D. on those

865da tes .

8689. On or about November 3, 2004, D.D. contacted Gir ling

879complaining that she had not received physical therapy from

888Mr. Westrope in a while . On or about November 4 , 2004,

900Mr. de Laaf was notified by Girling regarding the complaint it

911received from D.D. Mr. de Laaf then prohibited Mr. Westrope

921from seei ng any Girling patients after Girling indicated that it

932did not want Mr. Westrope performing any of its services. Mr.

943de Laaf then resumed the treatment of D.D.

9511 0 . O n or about November 5, 2004, Tammy Hain , R.N. , and

965Rob Hudson, O.T., who are supervisors employe d by Girling,

975visited D.D. to verify that she had not been receiv ing physical

987therapy from Mr. Westrope on October 16, 2004 ; October 18, 2004 ;

998October 20, 2004 ; October 30, 2004 ; and November 1, 2004. D.D.

1009verified that she had not received servi ces on those dates.

10201 1 . D.D.'s daughter has been assisting D.D. with her

1031financial transactions for 15 years and is familiar with D.D. 's

1042signature. At the final hearing, D.D.'s daughter reviewed for

1051the first time the visit slips submitted by Mr. Westrop e for

1063services to D.D. After reviewing the visit slips, D.D.'s

1072daughter concluded that the signatures on t he visit slips for

1083October 16, 2004 ; October 18, 2004 ; October 20, 2004 ;

1092Octobe r 30, 2004 ; and November 1, 2004, were not written by D.D.

1105D.D.'s da ughter verified that D.D. always uses her middle

1115initial “A” when signing her signature . The signature s on the

1127disputed dates do not contain D.D.'s middle initial and are

1137different in appearance from the signatures on the vis it slips

1148on which Mr. Westrope documented services that he did provide to

1159D.D.

11601 2 . On five occasions d uring the time that Mr. Westrope

1173was providing services to D.D., Robert Hudson also provided

1182occupational therapy services to D.D . on five occasions. At the

1193end of the therapy sess ions with Mr. Hudson, D.D. signed the

1205visit slips “D.A.D.”

120813. T he parties stipulated that if Mr. Westrope did not

1219provide the services to D.D. on the dates he indicated on the

1231visit slips, then Mr. Westrope violated the rules of the

1241Department and Subse ction 486.125(1)(e), Florida Statutes.

1248CO NCLUSIONS OF LAW

125214 . The Division of Administrative Hearings has

1260jurisdiction over the parties to and the subject matter of this

1271proceeding. §§ 120.569 and 120.57, Fla. Stat. (2005 ).

128015 . The Department has the b urden to establish by clear

1292and convincing evidence the allegations in the Administrative

1300Complaint. Department of Banking and Finance v. Osborne Stern

1309and Co. , 670 So. 2d 932 (Fla. 1996). The Department has alleged

1321that M r. Westrope violated Subsection 486 . 125 (1)( e ), Florida

1334Statutes, which p rovides that the following act constitute s

1344grounds for disciplinary action:

1348Failing to maintain acceptable standards

1353of physical therapy practice as set forth by

1361the Board in rules adopted pursuant to

1368Chapter 486, Florida Statutes.

137216. Florida Administrative Code Rule 64B17 - 6.001(2)(e)

1380p rovides:

1382[P]hysical therapy assistants shall not

1387use or participate in the use of any form of

1397communication containing false , fraudulent,

1401misleading, deceptive, unfair, or

1405sensat ional statement or claim, nor use

1412bribery in any form, nor use false

1419advertising, nor misrepresentation o f

1424services or self, nor engage in other

1431unprofessional conduct, including, but not

1436limited to,

14381. Inaccurately recorded, falsified, or

1443altered pati ent records[.]

14471 7 . The Department alleged that Mr. Westrope violated

1457Subsection 4 8 6 . 125 (1)( e), Florida Statutes, when he "falsely

1470documented physical therapy treatments to Patient D.D. when he

1479failed to perform the treatment modalities.” The Department has

1488established this allegation by clear and convincing evidence.

1496The documentation presented by the Department demonstrates that

1504the visit slips did not contain D.D.’s authentic signature for

1514the treatment dates October 16, 2004 ; October 18, 2004 ;

1523Octob er 20, 2004 ; October 3 0, 2004 ; and November 1, 2004.

1535Mr. Westrope did not provide services on those dates , but

1545submitted visit slips showing that he did provide services on

1555those dates . Thus, Mr. Westrope failed to maintain acceptable

1565standards of physi cal therapy practice by falsifying D.D. 's

1575patient records in violation of Florida Administrative Code Rule

158464B17 - 6.001(2)(e)1. and Subsection 486 .125(1)(e) , Florida

1592Statutes.

15931 8 . Florida Administrative Code Rule 64B17 - 7.001 (1)(e)

1604provides a range of penal ties for violations of Subsection

1614486.125(1)(e), Florida Statutes, and states:

1619Section 486.125(1)(e) or 456.072(1)(b),

1623F.S.: Failure to maintain acceptable

1628standards of practice as set forth in rules -

1637from a minimum fine of $1,000 and a letter

1647of concern , up to a maximum fine of $6,000

1657and/or two years of suspension followed by

1664two years of probation. . . .

1671RECOMMENDATION

1672Based on the foregoing f indings of f act and c onclusions of

1685l aw, it is

1689RECOMMENDED that a f inal o rder be entered finding that

1700Michael G. Westrope, P.T.A. , violate d Subsection 4 8 6 . 125 (1)( e ),

1715Florida Statutes, and imposing a penalty of a $ 2 ,000 fine and a

1729six - month suspension followed by one y ear of probation with the

1742terms to be set by the Department at the conclusion of the

1754suspension p eriod and requiring Respondent to complete five

1763hours of Continuing Education in physical therapy medical

1771records documentation .
