134STATEMENT OF THE ISSUES

138The issues are: (1) whether Petitioner is qualified for a

148pari - mutuel wagering occupational license; and (2) whether

157Petitioner is entitled to waiver of his felony conviction in

167accordance with Chapter 550, Florida Statutes (2 006 ).

176PRELIMINARY STATEMENT

178By letter dated June 30, 2005, Respondent, Department of

187Business and Professional Regulation, Division of Pari - Mutuel

196Wagering (Division), notified Petitioner, Joseph L. Nacca

203(Petitioner), that his application for a pari - mutu el wagering

214occupational license as a racehorse owner and request for waiver

224were denied. Petitioner timely requested a formal hearing to

233challenge the denial of his application and request for waiver.

243At the hearing, Petitioner testified in his own behal f.

253Petitioner did not offer any exhibits. The Division presented

262the testimony of its investigator Dennis Badillo and offered

271three Exhibits, which were received into evidence without

279objection.

280The parties elected not to provide a transcript of the

290proc eedings. The parties were afforded an opportunity to submit

300a proposed recommended order on or before January 23, 2006. The

311Division timely filed a Proposed Recommended Order which has

320been duly - considered; Petitioner did not file a p roposed

331r ecommended o rder.

335FINDINGS OF FACT

3381. Petitioner submitted an application for a pari - mutuel

348wagering occupational license as a racehorse owner on or about

358March 30, 2005. On his application, Petitioner accurately

366reported that he had been convicted on one count of Conspiracy

377to Transport Stolen Property and Evade Taxes, a felony.

3862. Due to Petitioner’s felony conviction, his application

394for a pari - mutuel wagering occupational license was subject to

405denial. Consequently, Petitioner also requested that a waiver

413be granted so that he could obtain the license.

4223. Petitioner's application and his request for waiver

430failed to include any information which would establish his

439rehabilitation or demonstrate that he is of good moral

448character.

4494. In the regular course of the Division's review of

459Petitioner's application and request for waiver, on or about

468April 11, 2005, Petitioner was interviewed by Dennis Badillo, an

478investigator for the Division. During the interview,

485Mr. Badillo completed a waiver interview form based upon the

495answers provided by Petitioner. Petitioner was afforded a full

504and fair opportunity to present information to establish his

513rehabilitation and to demonstrate his present good moral

521character, but Petitioner did not provide such information.

5295. In light of the information regarding Petitioner’s

537felony conviction, which is undisputed and admitted by

545Petitioner on his application form and at the final hearing,

555Petitioner does not meet the eligibility requirements for the

564license he seeks.

5676. At h earing, Petitioner attempted to minimize his role

577in the crime of which he was convicted, and expressed the view

589that he "doesn't have much time" to fulfill his desire to

"600participate in the racing industry" in Florida, inasmuch as he

610has passed his 70th b irthday.

6167. Petitioner failed to present any testimony from

624friends, relatives, associates, employers, probation officers,

630or other individuals to establish good conduct and reputation

639subsequent to the date of his felony conviction. Absent such

649evidence , the Division has no basis upon which to conclude that

660Petitioner is rehabilitated or that Petitioner is of present

669good moral character.

672CONCLUSIONS OF LAW

6758. The Division of Administrative Hearings has

682jurisdiction over the parties and the subject matt er of this

693proceeding pursuant to Section 1 20.57(1), Florida Statutes

701(2006 ).

7039. The Division is authorized to issue or deny pari - mutuel

715wagering occupational licenses pursuant to the provisions of

723Section 550.105, Florida Statutes (2006 ).

72910. As an app licant, Petitioner bears the burden of

739proving his entitlement to the license he seeks. Department of

749Banking and Finance, Division of Securities and Investor

757Protection v. Osborne Stern and Co. , 670 So. 2d 932, 934, (Fla.

7691996); Florida Department of Tra nsportation v. J.W.C., Co.,

778Inc. , 396 So. 2d 778 (1st DCA 1981). Petitioner has failed to

790meet this burden.

79311. The reasons for which the Division may deny an

803application for a pari - mutuel wagering occupational license are

813set forth in Section 550.1 05(5 )(b), Florida Statutes (2006 ),

824which provides in pertinent part:

829The division may deny, suspend, revoke, or

836declare ineligible any occupational license

841if the applicant for or holder thereof has

849violated the provisions of this chapter or

856the rules of the division governing the

863conduct of persons connected with racetracks

869and frontons. In addition, the division may

876deny, suspend, revoke, or declare ineligible

882any occupational license if the applicant

888for such license has been convicted in this

896state, in a ny other state, or under the laws

906of the United States of a capital felony, a

915felony, or an offense in any other state

923which would be a felony under the laws of

932this state involving arson; trafficking in,

938conspiracy to traffic in, smuggling,

943importing, con spiracy to smuggle or import,

950or delivery, sale, or distribution of a

957controlled substance; or a crime involving a

964lack of good moral character, or has had a

973pari - mutuel license revoked by this state or

982any other jurisdiction for an offense

988related to pari - mutuel wagering.

99412. Here, Petitioner’s application for licensure was

1001properly denied on the basis of Petitioner’s criminal record;

1010Petitioner does not dispute that he was convicted of Conspiracy

1020to Transport Stolen Property and Evade Taxes, a felony. This

1030conviction established a valid basis for the Division’s denial

1039of Petitioner’s application for a pari - mutuel wagering

1048occupational license. See Section 550.105(5)(b), Florida

1054Statutes (2006 ).

105713. Petitioner's felony conviction is not necessarily a

1065p ermanent bar to his obtaining a pari - mutual wagering

1076occupational license. Pursuant to the Division’s rulemaking

1083authority set forth in Section 550.0251(3), Florida Statutes

1091(2004), the Division adopted Florida Administrative Code Rule

109961D - 5.006, which pr ovides in relevant part:

1108(1) Any applicant for an occupational

1114license who is subject to denial on the

1122basis of a criminal conviction or discipline

1129by any racing jurisdiction may seek a waiver

1137from the division director. The applicant

1143shall submit an I ndividual Occupational

1149License Application BPR Form 15 - 027,

1156incorporated by Rule 61D - 10.001, Florida

1163Administrative Code, the annual license fee

1169and fingerprint fee, a complete set of

1176fingerprints on a card supplied by the

1183division, and a Request for Waive r BPR Form

119215 - 022, incorporated by Rule 61D - 10.001,

1201Florida Administrative Code. The applicant

1206must also schedule a waiver interview with

1213the Bureau of Investigations. Failure to

1219participate in a waiver interview or to

1226disclose any pertinent information regarding

1231convictions, rulings, revocations or denials

1236from other jurisdictions will result in a

1243denial of the request for waiver.

1249(2) The applicant must establish

1254rehabilitation and must demonstrate present

1259good moral character. The waiver applies to

1266convictions or enforcement actions disclosed

1271to the division, unless revoked by the

1278division for violation of Chapter 550,

1284Florida Statutes, or these rules. . . .

129214. In this case, Petitioner has been afforded an

1301opportunity, pursuant to Florida Adminis trative Code Rule 61D -

13115.006, to obtain a waiver. The waiver was properly denied

1321because Petitioner failed to establish rehabilitation and failed

1329to demonstrate present good moral character.

133515. In light of the foregoing, Petitioner failed to meet

1345his bur den of proof and, thus, he is not entitled to the pari -

1360mutuel wagering occupational license under the waiver provisions

1368of Florida Administrative Code Rule 61D - 5.006.

1376RECOMMENDATION

1377Based on the foregoing Findings of Fact and Conclusions of

1387Law, it is RECO MMENDED that the Division enter a final order

1399denying Petitioner’s application for a pari - mutuel wagering

1408occupational license and his request for waiver.
