101STATEMENT OF THE ISSUE S
106The issue s in the case are whether the allegations of the
118Administrative Complaint are correct, and , if so, what penalty
127should be imposed.
130PRELIMINARY STATEMENT
132By Administrative Complaint dated March 16, 2005, the
140Department of Health (Petitioner) alleged that Rose Gaubert,
148C.N.A. (Respondent) , violated certain Florida Statutes related
155to the provision of nursing services. The Respondent disputed
164the allegations and requested a formal administrative hearing.
172The Petitioner f orwarded the matter to the Division of
182Administrative Hearings, which scheduled the hearing to commence
190on October 19, 2005.
194At the hearing, the Petitioner presented the testimony of
203five witnesses and had Exhibits numbered 1 and 2 admitted into
214evidence . The Respondent testified on her own behalf. The
224hearing T ranscript was filed on November 15, 2005. The
234Petitioner filed a Proposed Recommended Order that has been
243considered in the preparation of this Recommended Order.
251FINDINGS OF FACT
2541. At all t imes material to this case, the Respondent was
266a c ertified n ursing a ssistant (C.N.A.), holding Florida
276certificate number CX 0501XXXX17400.
2802. At all times material to this case, the Respondent was
291employed as a C.N.A. at the Rehabilitation and Health C are
302Center, 2629 Del Prado Boulevard, Cape Coral, Florida.
3103. One of the residents at the facility where the
320Respondent was employed was H.L., a 67 - year - old female described
333as frail and in poor health, suffering from dementia, vascular
343insufficiency , a nd cardiac problems.
3484. On October 24, 2004, the Respondent was assigned to
358provide care to H.L. On that day, other employees heard yelling
369coming from H.L.'s room and entered her room, whereupon the
379Respondent was observed yelling at H.L with the Resp ondent's
389hands on H.L.'s shoulders and legs, forcefully pushing H.L. onto
399a bed.
4015. Linda Roan, a registered nurse, testified at the
410hearing as an expert in nursing care of elderly patients. Nurse
421Roan opined that the treatment provided by the Responde nt to
432H.L. on October 24, 2004, failed to meet minimal standards of
443acceptable and prevailing nursing practice. Nurse Roan's
450testimony is accepted.
453CONCLUSIONS OF LAW
4566. The Division of Administrative Hearings has
463jurisdiction over the parties to and t he subject matter of this
475proceeding. §§ 120.569 and 120.57, Fla . Stat . (2004).
4857. The Petitioner is the state agency charged with the
495regulation of C.N.A. s in the State of Florida. See Ch . 464 ,
508Fla . Stat . (2004) .
5148. The Petitioner has the burden of proving by clear and
525convincing evidence the allegations set forth in the
533Administrative Complaint against the Respondent. Department of
540Banking and Finance v. Osborne Stern and Company , 670 So . 2d
552932, 935 (Fla. 1996) ; Ferris v. Turlington , 510 So. 2d 29 2 (Fla.
5651987). Clear and convincing evidence is that which is credible,
575precise, explicit , and lacking confusion as to the facts in
585issue. The evidence must be of such weight that it produces in
597the mind of the trier of fact the firm belief of conviction ,
609without hesitancy, as to the truth of the allegations.
618Slomowitz v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983).
630In this case, the burden has been met.
6389. The Administrative Complaint charges that the
645Respondent has violated S ubs ection 464.204(1 )(b), Florida
654Statutes (2004) , by violating S ubs ection 464.018(1)(n), Florida
663Statutes.
66410. S ubs ection 464.018(1)(n), Florida Statutes (2004) ,
672provides that failure to meet minimal standards of acceptable
681and prevailing nursing practice constitutes grou nds for
689disciplinary action.
69111. S ubs ection 464.204(1)(b), Florida Statutes (2004) ,
699provides in relevant part as follows :
706(1) The following acts constitute grounds
712for which the board may impose disciplinary
719sanctions as specified in subsection (2):
725* * *
728(b) Intentionally violating any provision
733of this chapter, chapter 456, or the rules
741adopted by the board.
745(2) When the board finds any person guilty
753of any of the grounds set forth in
761subsection (1), it may enter an order
768imposing one or mo re of the following
776penalties:
777(a) Denial, suspension, or revocation of
783certification.
784(b) Imposition of an administrative fine
790not to exceed $150 for each count or
798separate offense.
800(c) Imposition of probation or restriction
806of certification, inc luding conditions such
812as corrective actions as retraining or
818compliance with an approved treatment
823program for impaired practitioners.
82712. As set forth herein, the evidence establishes that the
837Respondent is guilty of one count of failure to meet minim al
849standards of acceptable and prevailing nursing practice.
85613. In its Proposed Recommended Order, the Petitioner
864asserts that the applicable disciplinary guidelines are set
872forth at Florida Administrative Code Rule 64B9 - 8 . 006 which are
885applicable to the practice of nursing, and provide that an
895administrative fine of between $250 to $500 is the appropriate
905penalty in this case. The Petitioner's suggested penalty
913exceeds that authorized by S ubs ection 464.204(1)(b), Florida
922Statutes (2004) .
92514. Florida A dministrative Code Rule 64B9 - 15.009 sets
935forth disciplinary guidelines specifically related to C.N.A. s
943which are to be utilized in determining the appropriate penalty
953to be assessed in this case; however, none of the guidelines
964reference the statutory viol at ions alleged in the Administrative
974Complaint. The following penalty is based upon the language set
984forth at S ubs ection 464.204(1)(b), Florida Statutes (2004) .
994RECOMMENDATION
995Based on the foregoing Findings of Fact and Conclusions of
1005Law, it is
1008RECOMM ENDED that the Department of Health enter a f inal
1019o rder finding that Rose Gaubert, C.N.A., is guilty of one count
1031of failure to meet minimal standards of acceptable and
1040prevailing nursing practice, and imposing a fine of $50, a
1050probationary period of one y ear, and such additional training as
1061the Department of Health deems appropriate.
