153Whether Petitioners' rental property was licensed under

160Chapter 509, Flori da Statutes (2003).

166PRELIMINARY STATEMENT

168In October 2003, a Recovery Fund Claim Final Order was

178entered in Case No. 2002012997, Robert Meller, Jr. , and

187Kristine M. Meller, Claimant, v. Revonda Cross, Licensee . In

197that F inal O rder, the Florida Real Estat e C ommission (FREC )

211denied claimants' claim based on a determination that the

220l icensee managed claimants' property as a transient rental

229property licensed under Chapter 509, Florida Statutes (2003) ,

237thereby specifically exempting the property from protecti on

245afforded the public under Part 1, Chapter 475, Florida Statutes.

255Claimants, Petitioners herein, appealed FREC's decision

261to the District Court of Appeal, Fifth District, which, in

271May 2005, ruled that Petitioners were entitled to a S ubs ection

283120.57(1 ), Florida Statutes (2005) , hearing. After a particular

292discussion of the facts of the case, Justice Sawaya, speaking

302for the panel, indicated: " [W]hether the property was licensed

311under Chapter 509 is a critical issue because it determines

321whether the M ellers can recover."

327Petitioners made a timely request for administrative

334hearing by letter to FREC dated July 7, 2005. On September 6,

3462005, FREC forwarded the case to the Division of Administrative

356Hearings on September 6, 2005. On September 12, 2005, an

366Initial Order was sent to all parties. At Petitioners ' request,

377the case was scheduled for November 23, 2005, in Orlando,

387Florida.

388The case was presented as scheduled on November 23, 2005.

398Petitioners presented themselves as witnesses and offered

40511 exhibits , which were received into evidence and marked as

415Petitioners' Exhibits 1 through 11. Respondent, Department of

423Business and Professional Regulation (Respondent DBPR) ,

429presented Respondent , Revonda Cross (Respondent Cross) , as its

437witness and offe red four exhibits which were received into

447evidence and ma rked as Respondent's Exhibits 1 through 4.

457Respondent Cross testified on her own behalf. At the close of

468her testimony, leave was granted for Respondent Cross to produce

478computer printouts that we re provided to the Division of Hotels

489and Restaurants which listed transient rental properties

496maintained by Properties in Paradise, Inc. On December 5, 2005,

506Respondent Cross filed documents consisting of 24 pages of

515computer printout which has b een mark ed as Respondent Cross'

526Exhibit 1, which is included in this record as these records

537have been considered by the undersigned Administrative Law

545Judge.

546The Transcript of Proceedings was filed on December 20,

5552005. Petitioners and Respondent D BPR filed Prop osed

564Recommended Orders , which have been considered by the

572undersigned in preparation of this Recommended Order .

580FINDINGS OF FACT

583Based on the oral and documentary evidence presented at the

593final hearing, the following findings of fact are made:

6021. Petiti oners, Robert Meller, Jr. , and Kristine M.

611Meller , were owners of a rental property (a house located at

6224516 Bowa n Bayou ) in Sanibel, Florida. In addition, they owned

634a condominium in the same area.

6402. Respondent Cross held a valid real estate license at

650all times material to matters at issue. Respondent Cross had a

661business relationship with Petitioners , which antedated the

668purchase of the Bowen Bayou house as a result of being the

680leasing agent for a condominium association with which

688Petitioners were associated.

6913. Respondent DBPR is the State of Florida agency which

701represents the F REC in matters such as this matter.

7114. In January 2000, Petitioners purchased the house in

720Sanibel located at 4516 Bowan Bayou.

7265. On or about January 20, 2000, Resp ondent Cross mailed a

738Rental Property Management Agreement to Petitioners for the

746property located at 4516 Bowan Bayou, Sanibel, Florida. The

755parties to this contract were Petitioners and Properties in

764Paradise, Inc. Petitioner, Robert Meller, Jr. , signe d the

773contract and returned the contract to Respondent Cross.

7816. Petitioners maintain that the Rental Property

788Management Agreement was not signed by Petitioner, Robert

796Meller, Jr., and that his name is forged. He maintains that he

808entered into an oral a greement with Respondent Cross,

817individually, to manage the property.

8227. From the purchase of the house in January 2000 thr o u gh

836April 2001, Petitioners received correspondence, including a

843monthly "owner statemen t" reflecting short - term rental income,

853com missions, and debits for maintenance, from Properties in

862Paradise, Inc., regarding all aspects of the business

870relationship contemplated by the Rental Property Management

877Agreement.

8788. By letter dated January 20, 2000, Petitioner, Robert

887Meller, Jr., auth orized "Revonda Cross of Properties in Paradise

897as my agent in establishing telephone and electrical service and

907so forth for my property on Sanibel Island at 4516 Bowen's [sic]

919Bayou Road." Thereafter, Petitioners received correspondence

925from Respondent Cross relative to the subject property wherein

934she is identified as "Operations Manager, Properties in

942Paradise, Inc."

9449. During the relevant time period, Petitioners' property

952was rented at least 22 times; once for 17 days, four times for

96514 days, once f or nine days, thirteen times for seven days, and

978once for five days. The frequency and term of these rentals

989qualify for the statutory definition of a "resort dwelling" and

999transient rental dwelling.

100210. Properties in Paradise, Inc. , listed the property

1010located at 4516 Bowan Bayou in the list of properties it

1021provided the Division of Hotels and Restaurants as licensed in

1031accordance with Chapter 509, Florida Statutes (2005) .

103911. In April 2001, Properties in Paradise, Inc., through

1048an attorney, notified c lients that it had effectively ceased

1058doing business. At that time , Petitioners were owed $11,588.06 ,

1068which went unpaid.

107112. Petitioners made a claim in July 2001, against

1080Respondent Cross to recover their loss from the Florida Real

1090Estate Recovery Fund. In October 2003, Petitioners ' claim was

1100denied by the Florida Real Estate Recovery Fund.

1108CONCLUSIONS OF LAW

111113. The Division of Administrative Hearings has

1118jurisdiction of the parties to and the subject matter of this

1129proceeding . § 120.57(1), Fl a. Stat . (2005).

113814. Petitioners have the burden of proof in these

1147proceedings. Florida Department of Transportation v. J.W.C.

1154Company, Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981).

116415. Petitioners have failed to demonstrate that the Rental

1173Property Management Agr eement dated January 20, 2000, was not

1183signed by Petitioner , Robert M eller, Jr. The greater weight of

1194the evidence compels the conclusion that the Rental Property

1203Management Agreement controlled the related activities of the

1211parties and was generally foll owed by both parties until

1221Properties in Paradise, Inc. , defaulted in late April 2001.

123016. Petitioners ' claim to recover their losses is exempt

1240from the Florida Real Estate Recovery Fund. The statutes

1249governing the requirement for eligibility to make a c laim

1259require that the activity giving rise to the claim must be part

1271of a brokerage transaction. §§ 475.482(1) and 475.483(1),

1279Florida Statutes (2003). The activity of Respondent Cross and

1288Properties in Paradise, Inc. , arose from Petitioners' contract

1296to manage the transient rental property.

130217. Subsection 475.482(1), Florida Statutes (2003), reads

1309as follows:

1311Real Estate Recovery Fund . - - There is created

1321the Florida Real Estate Recovery Fund as a

1329separate account in the Professional

1334Regulation Trust Fun d.

1338(1) The Florida Real Estate Recovery

1344Fund shall be disbursed as provided in

1351s. 475.484, on order of the commission, as

1359reimbursement to any person, partnership, or

1365corporation adjudged by a court of competent

1372civil jurisdiction in this state to ha ve

1380suffered monetary damages by reason of any

1387act committed, as a part of any real estate

1396brokerage transaction involving real

1400property in this state, by any broker or

1408sales associate who:

1411* * *

1414(c) Was acting solely in the capacity of

1422a real estate licensee in the transaction;

142918. Subsection 475.483(1)(a), Florida Statutes (2003),

1435reads as follows:

1438Conditions for recovery; eligibility . --

1444(1) Any person is eligible to seek

1451recovery from th e Real Estate Recovery Fund

1459if:

1460(a) Such perso n has received a final

1468judgment in a court of competent civil

1475jurisdiction in this state against an

1481individual broker or sales associate in any

1488action wherein the cause of action was based

1496on a real estate brokerage transaction.

150219. Subsection 475.011, F lorida Statutes (2003), reads as

1511follows:

1512Exemptions. This part [Part 1 which

1518includes Section 476.482, Florida Statutes

1523(2003)] does not apply to:

1528* * *

1531(11) Any person, partnership,

1535corporation, or other legal entity which,

1541for another and for compensation or other

1548valuable consideration, rents or advertises

1553for rent, for transient occupancy, any

1559public lodging establishment licensed under

1564chapter 509.

156620. In accordance with its responsibilities as set forth

1575in the Rental Property Manageme nt Agreement dated January 20,

15852000, as demonstrated by the evidence, Properties in Paradise,

1594Inc. , licensed Petitioners' rental property as a transient

1602rental property in accordance with Subsection 509.242(1)(g),

1609Florida Statutes (2003) , which reads as fo llows:

1617Public lodging establishments;

1620classifications. --

1622(1) A public lodging establishment shall

1628be classified as a hotel, motel, resort

1635condominium, nontransient apartment,

1638transient apartment, roominghouse, bed and

1643breakfast inn, or resort dwelling if the

1650establishment sa tisfies the following

1655criteria:

1656* * *

1659( g) Resort dwelling. -- A resort dwelling

1667is any individually or collectively owned

1673one - family, two - family, three - family, or

1683four - family dwelling house or dwelling unit

1691which is rented more than three times in a

1700calendar year for periods of less than 30

1708days or 1 calendar month, whichever is less,

1716or which is advertised or held out to the

1725public as a place regularly rented for

1732periods of less than 30 days or 1 calendar

1741month, whichever is less.

1745RECOMMENDATION

1746Based on the foregoing findings of fact and conclusions of

1756law, it is

1759RECOMMENDED that Respondent, Department of Business and

1766Professional Regulation , enter a final order denying

1773Petitioners' claim for recovery from the Florida Rea l Estate

1783Recovery Fund .
