129STATEMENT OF THE ISSUE
133Pursuant to Section 403.508(2), Florida Statutes, the sole
141issue for determina tion in this hearing is whether the proposed
152site for the expansion of the Hillsborough County Resource
161Recovery Facility is consistent and in compliance with existing
170land use plans and zoning ordinances.
176PRELIMINARY STATEMENT
178Hillsborough County o wns the Hillsborough County Resource
186Recovery Facility (Facility), an existing electrical power
193plant that burns municipal solid waste (MSW) to generate
202electricity. The Facility currently consists of three municipal
210waste combustor (MWC) units. On November 21, 2005, the County
220filed an application with DEP for certification to authorize the
230construction and operation of an additional MWC unit at the
240Facility (the Project).
243The Countys application is subject to review under the
252Florida Electri cal Power Plant Siting Act (PPSA), Sections
261403.501 - .518, Florida Statutes. 1
267The Department transmitted the Countys application to the
275Division of Administrative Hearings (DOAH) for appropriate
282proceedings under the PPSA. In compliance with Section
2904 03.508(1), Florida Statutes, see pp 10 and 11 e.g. , the land
302use hearing (the Land Use Hearing) in this case was scheduled
313for July 12, 2006.
317On June 30, 2006, a Prehearing Stipulation for Land Use
327and Certification Hearings (Prehearing Stipulation) was filed
334by the County, DEP, the Florida Department of Community Affairs
344(DCA), the Florida Department of Transportation, the Florida
352Public Service Commission (PSC), the Florida Fish and Wildlife
361Conservation Commission, the Southwest Florida Water Management
368District, and the Tampa Bay Regional Planning Council (TBRPC).
377In the Prehearing Stipulation, all of the signatories either
386agreed with, did not dispute, or took no position concerning the
397Countys assertion that the site of the proposed Proj ect is
408consistent and in compliance with existing land use plans and
418zoning ordinances.
420At the Land Use Hearing, the County called two witnesses,
430Jason Gorrie (accepted as an expert concerning solid waste
439management systems and resource recovery facilit ies) and Paula
448Harvey (accepted as an expert concerning land use planning and
458zoning issues). The County introduced Exhibits 1 8 (A, B, C
470and D), 9, 10 (A and B), 11 - 50, and 52 - 60 into evidence, without
487objection.
488By order dated July 6, 2006, the Ad ministrative Law Judge
499granted the Countys request to take official notice of various
509documents. These documents were included with the Countys
517exhibits and were introduced into evidence at the Land Use
527Hearing.
528No one contested the evidence presen ted by the County at
539the Land Use Hearing. None of the signatories to the Prehearing
550Stipulation participated at the Land Use Hearing, except the
559County and DEP. No one from the public attended, testified or
570proffered any exhibits at the Land Use Hearing .
579The Transcript of the Land Use Hearing was filed with DOAH
590on July 18, 2006, and the parties were allowed until July 21,
6022006, to submit proposed recommended orders. The County and DEP
612timely filed a Joint Proposed Recommended Order on July 19,
6222006. No other party filed a proposed recommended order.
631Based on all of the evidence of record, the following
641findings of fact are determined:
646FINDINGS OF FACT
649The Applicant
6511. The Applicant, Hillsborough County, is a political
659subdivision of the State of Fl orida. The County owns the
670existing Facility and will own the proposed Project. The
679Facility was designed, built, and is operated by a private
689company pursuant to a long - term contract with the County. It is
702anticipated that a private company will design , construct, and
711operate the Project for the County.
717The Site
7192. The Facility is located next to Falkenburg Road in an
730unincorporated area in the County. The Facility is southeast of
740the City of Tampa, west of Interstate 75 (I - 75"), and north of
755th e Crosstown Expressway and State Road 60.
7633. The Facility was built on a 50.4 - acre site (Site),
775which is in the southern portion of a 353 - acre tract of land
789owned by the County.
793The Surrounding Area
7964. The Facility is surrounded by a variety of
805institutional and industrial land uses. The Facility is
813bounded: on the south by the Countys Falkenburg Road
822Wastewater Treatment Plant and a railroad track that is owned by
833the CSX railroad company; on the west by a 230 kilovolt
844transmission line corri dor and easement owned by Tampa Electric
854Company; on the north by vacant improved pasture land, the
864Falkenburg Road Jail, the Hillsborough County Department of
872Animal Services, and the Hillsborough County Sheriffs Office
880(District 2); and on the east by F alkenburg Road and vacant
892land.
8935. The nearest residential area is approximately one mile
902away from the Facility. It is located on the opposite (east)
913side of I - 75.
918The Existing Facility
9216. The Facility currently consists of three MWC units,
930which have been in commercial operation since 1987. Each MWC
940unit has a nominal capacity of 400 tons per day (tpd) of
952municipal solid waste (440 tpd when burning a reference fuel
962with a higher heating value of 4500 British thermal units
972(Btu) per pound). T he three MWC units are located inside a
984fully enclosed building, which also contains the air pollution
993control systems for the MWC units, the tipping floor (i.e.,
1003refuse unloading area), the refuse storage pit, and a turbine
1013generator. In addition, the Facility includes an ash management
1022building, cooling tower, stack, stormwater management system,
1029water treatment system, transformer yard, electrical
1035transmission lines, and ancillary equipment and facilities.
10427. Municipal solid waste (e.g., household and commercial
1050garbage) is delivered to the Site in trucks, which drive inside
1061the refuse storage building to the tipping floor, where the
1071trucks dump the MSW into the refuse storage pit. Two overhead
1082cranes mix the waste in the refuse storage pit and the n load the
1096waste into the charging hoppers that feed the three MWC units.
1107The combustion of the municipal solid waste produces heat, which
1117is used to produce steam. The steam is used in a turbine
1129generator to produce approximately 29.5 megawatts (MW) o f
1138electricity.
1139The Project
11418. The Project involves the construction and operation of
1150a fourth MWC unit at the Facility. The new unit will be
1162substantially the same as the three existing MWC units, but
1172larger. The new unit will have the capacity to pr ocess 600 tpd
1185(nominal) of municipal solid waste (660 tpd @ 5000 Btu/lb). A
1196new turbine generator will be installed, which will increase the
1206Facilitys net electrical generating capacity approximately 18
1213MW to a total of approximately 47 MW. The cooling tower will be
1226expanded, the refuse and ash management buildings will be
1235expanded, two lime silos and a carbon silo will be installed, a
1247new settling basin will be installed, and other related
1256improvements will be made.
12609. The construction and operation of the Project will
1269occur in disturbed upland areas that are adjacent to the
1279Facility and already used for industrial operations. Only about
12880.3 acres of open space will be used for a building or similar
1301purpose.
130210. The Facility will process more solid waste and
1311generate more electricity after the expansion Project is
1319completed, but the basic operation of the Facility will not
1329change.
1330Historical Land Use Designations
133411. In 1984, the County revised its land use plans and
1345zoning designations fo r the Site to authorize the construction
1355and operation of the Facility. As revised, the comprehensive
1364plan and zoning authorized the immediate construction of three
1373MWC units and the subsequent expansion of the Facility with a
1384fourth MWC unit, when needed . The Countys plans for the
1395Facility were reviewed under the PPSA and in 1984 the Siting
1406Board concluded that the Site was consistent and in compliance
1416with the existing land use plans and zoning ordinances. At all
1427times since 1984, the County has ensur ed that the zoning and
1439comprehensive plan designations for the Site are consistent with
1448the Countys long - term plan to construct the Project.
1458Current Land Use Designations and Zoning Ordinances
146512. The Site currently is designated Public/Quasi - Public
1474( P - QP) under the Countys comprehensive land use plan.
1485Typical land uses allowed in Public/Quasi - Public areas include:
1495major existing and programmed government -
1501owned facilities, and other public uses.
1507This category also accommodates quasi - public
1514uses s uch as private establishments
1520generally available to the public for use;
1527for example, churches, hospitals, schools,
1532clubs, major (regional, district or
1537community) recreation services and related
1542uses, tourist attractions, and utility and
1548transportation fac ilities.
1551The Project is consistent with this land use category because
1561the Facility is a major government - owned facility and the
1572Project is part of a long - standing plan (i.e., the Project is
1585programmed) to expand the Facility, when needed.
159213. The Site currently is zoned Planned Development (PD)
1601by Hillsborough County. Under the Countys zoning code, all
1610uses are potentially allowed in a PD district; however, the
1620specific uses must be approved by the Board of County
1630Commissioners. In 1984, the Board of County Commissioners
1638specifically approved the use of the Site for the construction
1648and operation of the Facility, including the fourth MWC unit.
1658In 2005 the Board of County Commissioners decided to install
1668Unit No. 4, consistent with the County s longstanding plan, and
1679specifically authorized the Project to go forward. Accordingly,
1687the Project is consistent and in compliance with the Countys PD
1698zoning designation.
1700Consistency With Land Use Plans and Zoning Ordinances
170814. In the Prehearing Stipulation, the Florida Department
1716of Community Affairs, DEP, the Florida Department of
1724Transportation, the Florida Fish and Wildlife Conservation
1731Commission and the Southwest Florida Water Management District
1739either agreed with or did not dispute the Cou ntys assertion
1750that the Site is consistent and in compliance with existing land
1761use plans and zoning ordinances. The Florida Public Service
1770Commission and the TBRPC took no position concerning the
1779Countys assertion that the Site is consistent and in com pliance
1790with existing land use plans and zoning ordinances.
179815. The expert testimony and other evidence presented in
1807the Land Use Hearing demonstrate that the Site and Project are
1818consistent and in compliance with Hillsborough Countys
1825Comprehensive Pl an and zoning ordinances. The Project also is
1835compatible with adjacent and surrounding land uses. There is no
1845evidence to suggest the Project is inconsistent with any
1854applicable local, regional, or state plan.
1860Public Notice of the Land Use Hearing
186716 . On December 19, 2005, the County published a Notice
1878of Filing of Application for Electrical Power Plant Site
1887Certification in the Tampa Tribune , which is a newspaper of
1897general circulation published in Hillsborough County, Florida.
190417. On May 25, 2006, the County published notice of the
1915Land Use Hearing in the Tampa Tribune .
192318. On December 23 and December 30, 2005, the Department
1933electronically published Notice of Filing of Application for
1941Power Plant Certification.
194419. On May 26, 2006, the Department electronically
1952published notice of the Land Use Hearing.
195920. The public notices for the Land Use Hearing satisfy
1969the informational and other requirements set forth in Section
1978403.5115, Florida Statutes, and Florida Administrative Code
1985Ru les 62 - 17.280 and 62 - 17.281(4).
1994CONCLUSIONS OF LAW
199721. The Division of Administrative Hearings has
2004jurisdiction over the parties to and subject matter of this
2014proceeding pursuant to Sections 120.569, 120.57(1) and 403.508,
2022Florida Statutes.
202422. The County and DEP published timely public notice of
2034the Land Use Hearing, in compliance with the requirements
2043contained in the PPSA and Florida Administrative Code Rule
2052Chapter 62 - 17.
205623. Pursuant to Section 403.508(2), Florida Statutes, the
2064sole issue fo r determination in this proceeding is whether the
2075proposed Site of the Countys Project is consistent and in
2085compliance with existing land use plans and zoning ordinances.
209424. The competent, substantial, and unrebutted evidence
2101presented by the County at the Land Use Hearing demonstrates
2111that the Site and the Project are consistent and in compliance
2122with the applicable provisions of the existing land use plans
2132and zoning ordinances.
2135RECOMMENDATION
2136Based on the foregoing Findings of Fact and Conclusion s of
2147Law, it is RECOMMENDED that the Governor and Cabinet, sitting as
2158the Siting Board, enter a Final Land Use Order in this case
2170finding that the Site and the proposed expansion of Hillsborough
2180Countys resource recovery facility are consistent and in
2188co mpliance with the existing land use plans and zoning
2198ordinances.
