100STATEMENT OF THE ISSUE
104Whether Petitioner should be granted a license to engage in

126PRELIMINARY STATEMENT

141FINDINGS OF FACT
1441. Respondent Agency is charged by law with licensure of
154non - resident " all (insurance) lines " public adjusters.
1622. On or about July 21, 2005, Respondent denied
171Petitioner's application for such licensure as follows:
178You have never been licensed in this state
186to engage in business as an insurance
193adjuster. However, on or about October 1,
2002004, yo u identified yourself as a licensed
208public adjuster to William H. Baker, of 329
216Live Oak Road, Vero Beach, Florida, and
223solicited Mr. Baker to hire you to adjust a
232claim for hurricane damage with his insurer,
239Safeco Insurance Company. On or about
245November 4, 2005, Safeco received a Notice
252of Representation from you indicating that
258you were Mr. Baker's adjuster on his claim.
266On or about November 11, 2004, you met with
275a Safeco representative and attempted to
281settle Mr. Baker's claim.
285Legal Basis for Denia l
290The denial is based upon the following
297Florida Statutes:
299Section 626.112(3), Florida Statutes states:
304(3) No person shall act as an adjuster as
313to any class of business for which he or she
323is not then licensed or appointed.
3293. Petitioner time ly requested a disputed - fact hearing,
339and the cause was referred to the Division of Administrative
349Hearings on or about December 2, 2005.
3564. The case was scheduled for final hearing on
365February 21, 2006, in Tallahassee, Florida , by a Notice mailed
375Decemb er 27, 2006. An Order of Pre - hearing Instructions was
387entered the same date.
3915. Petitioner requested a continuance by a letter filed
400February 15, 2006.
4036. On February 21, 2006, an Order was entered granting a
414continuance until April 20, 2006.
4197. On April 17, 2006, Petitioner filed a letter requesting
429another continuance.
4318. On April 24, 2006, an Order was entered granting a
442continuance and requ iring that the parties submit mutually
451agreeable dates for hearing by May 10, 2006.
4599. On May 10, 2006, a C onsented R esponse was filed.
47110. On May 15, 2006, a Notice of Hearing for June 19,
4832006, was entered and mailed .
48911. On June 19, 2006, when the final hearing was convened ,
500Petitioner was not in attendance.
50512. Respondent's counsel and Respondent's agency
511representative were in attendance. Respondent's counsel
517represented that she had been unable to get any telephonic
527response from Petitioner for several weeks.
53313. The undersigned inquired if any Pre - hearing
542Stipulation, as requ ired by the Orde r of Pre - hearing
554Instructions had been entered, and Respondent's counsel answered
562in the negative. The undersigned inquired if , due to the nature
573of the license denial, any agreement to shift the duty to go
585forward had been reached, and Respondent's couns el answered in
595the negative. The Division's file reflects no stipulations.
60314. The undersigned wait ed a half - hour for Petitioner to
615appear . He did not appear by the end of that half - hour .
63015. Inquir y within the Division revealed that Petitioner
639had n either come to the building housing the hearing room , nor
651had he telephoned the secretary to the undersigned with any
661excuse for his absence.
665CONCLUSION OF LAW
66816. Petitioner, as a first - time applicant, bears the duty
679to go forward and the burden of proo f by a preponderance of the
693evidence to establish his entitlement to licensure. Florida
701Department of Transportation v. J.W.C. Company, Inc. , 396 So. 2d
711778 (Fla. 1st DCA 1981 ). He has failed to go forward and has
725failed to bear his burden of ultimate pr oof , and his license
737application should be denied.
741RECOMMENDATION
742Upon the foregoing Findings of Fact and Conclusion of Law,
752it is recommended that the Department of Financial Services
761enter a final order denying Petitioner's licens e application .
