124At issue is whether Chin a La'Sha Reaves (China), a minor,

135qualifies for coverage under the Florida Birth - Related

144Neurological Injury Compensation Plan (Plan).

149PRELIMINARY STATEMEN T

152On May 14, 2006, Sheila Sinclair, individually and as legal

162guardian of China La'Sha Reaves, a m inor, and April Reaves,

173individually and as mother of China La'Sha Reaves, a minor,

183filed a petition (claim) with the Division of Administrative

192Hearings (DOAH) for compensation under the Plan.

199DOAH served the Florida Birth - Related Neurological Injury

208Comp ensation Association (NICA) with a copy of the claim on

219March 15, 2006 ; and on March 27, 2007, following a number of

231extensions of time within which to do so, NICA responded to the

243claim, and gave notice that it was of the view that China did

256not suffer a "birth - related neurological injury," as defined by

267Section 766.302(2), Florida Statutes, and requested that a

275hearing be scheduled to resolve the issue. In the interim,

285Orlando Regional Healthcare System, Inc., d/b/a Arnold Palmer

293Hospital, was accorded l eave to intervene.

300Pursuant to notice, a hearing was scheduled for November 7,

3102007, to resolve whether the claim was compensable. However, on

434FINDINGS OF FACT

437Stipulated facts

4391. April Reaves is the mother of, and Sheila Sinclair is

450the legal guardian of, China La'Sha Reaves, a minor. China was

461born a live infant on September 6, 2001, at Orlando Regional

472Healt hcare System, Inc., d/b/a Arnold Palmer Hospital, Orlando,

481Florida, and her birth weight exceeded 2,500 grams.

4902. The physician providing obstetrical services during

497China's birth was Penny Ann Danna, M.D., who, at the time, was a

"510participating physician " in the Florida Birth - Related

518Neurological Injury Compensation Plan, as defined by Section

526766.302(7), Florida Statutes.

5293. April Reaves was provided notice as required by Section

539766.316, Florida Statutes.

5424. The Agreed Record does not demonstrate th at China

552suffered a "birth - related neurological injury," as defined by

562Section 766.302(2), Florida Statutes.

566Coverage under the Plan

5705. Pertinent to this case, coverage is afforded by the

580Plan for infants who suffer a "birth - related neurological

590injury," defined as an "injury to the brain or spinal cord . . .

604caused by oxygen deprivation or mechanical injury occurring in

613the course of labor, delivery, or resuscitation in the immediate

623postdelivery period in a hospital, which renders the infant

632permanently and substantially mentally and physically impaired."

639§ 766.302(2), Fla. Stat.

6436. Here, the parties' stipulation that "[t]he Agreed

651Record in this matter does not show that China La'Sha Reaves

662suffered a 'birth - related neurological injury ' under Section

672766.302(2), Fla. Stat.," is consistent with the record, which

681demonstrates that China's impairments are most likely

688developmentally based, as opposed to birth - related.

696Consequently, the record fails to support the conclusion that

705China suffered a "birth - related neurological injury," as

714required for coverage under the Plan.

720CONCLUSIONS OF LAW

7237 . The Division of Administrative Hearings has

731jurisdiction over the parties to, and the subject matter of,

741these proceedings. § 766.301, et seq. , Fla. Stat .

7508 . T he Florida Birth - Related Neurological Injury

760Compensation Plan was established by the Legislature "for the

769purpose of providing compensation, irrespective of fault, for

777birth - related neurological injury claims" relating to births

786occurring on or after Janu ary 1, 1989. § 766.303(1), Fla. Stat.

7989 . The injured infant, her or his personal representative,

808parents, dependents, and next of kin, may seek compensation

817under the Plan by filing a claim for compensation with the

828Division of Administrative Hearings. §§ 766.302(3), 766.303(2),

835and 766.305(1), Fla. Stat. The Florida Birth - Related

844Neurological Injury Compensation Association, which administers

850the Plan, has "45 days from the date of service of a complete

863claim . . . in which to file a response to the pe tition and to

879submit relevant written information relating to the issue of

888whether the injury is a birth - related neurological injury."

898§ 766.305(4), Fla. Stat.

90210 . If NICA determines that the injury alleged in a claim

914is a compensable birth - related neuro logical injury, it may award

926compensation to the claimant, provided that the award is

935approved by the administrative law judge to whom the claim has

946been assigned. § 766.305(7), Fla. Stat. If, on the other hand,

957NICA disputes the claim, as it has in the instant case, the

969dispute must be resolved by the assigned administrative law

978judge in accordance with the provisions of C hapter 120, F lorida

990Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.

99811 . In discharging this responsibility, the administrative

1006law judge must make the following determination based upon the

1016available evidence:

1018(a) Whether the injury claimed is a

1025birth - related neurological injury. If the

1032claimant has demonstrated, to the

1037satisfaction of the administrative law

1042judge, that the i nfant has sustained a brain

1051or spinal cord injury caused by oxygen

1058deprivation or mechanical injury and that

1064the infant was thereby rendered permanently

1070and substantially mentally and physically

1075impaired, a rebuttable presumption shall

1080arise that the injur y is a birth - related

1090neurological injury as defined in s.

1096766.303(2).

1097(b) Whether obstetrical services were

1102delivered by a participating physician in

1108the course of labor, delivery, or

1114resuscitation in the immediate postdelivery

1119period in a hospital; or by a certified

1127nurse midwife in a teaching hospital

1133supervised by a participating physician in

1139the course of labor, delivery, or

1145resuscitation in the immediate postdelivery

1150period in a hospital.

1154§ 766.309(1), Fla. Stat. An award may be sustained only if the

1166administrative law judge concludes that the "infant has

1174sustained a birth - related neurological injury and that

1183obstetrical services were delivered by a participating physician

1191at birth." § 766.31(1), Fla. Stat.

119712 . Pertinent to this case, "birth - r elated neurological

1208injury" is defined by Section 766.302(2), Florida Statutes,

1216to mean:

1218injury to the brain or spinal cord of a live

1228infant weighing at least 2,500 grams for a

1237single gestation or, in the case of a

1245multiple gestation, a live infant weighin g

1252at least 2,000 grams at birth caused by

1261oxygen deprivation or mechanical injury

1266occurring in the course of labor, delivery,

1273or resuscitation in the immediate

1278postdelivery period in a hospital, which

1284renders the infant permanently and

1289substantially mental ly and physically

1294impaired. This definition shall apply to

1300live births only and shall not include

1307disability or death caused by genetic or

1314congenital abnormality.

131613 . Here, the proof failed to support the conclusion that,

1327more likely than not, China's n eurologic impairments were the

1337result of an injury to the brain or spinal cord caused by oxygen

1350deprivation or mechanical injury occurring in the course of

1359labor, delivery, or resuscitation in the immediate postdelivery

1367period in the hospital. Consequentl y, given the provisions of

1377Section 766.302(2), Florida Statutes, China does not qualify for

1386coverage under the Plan. See also §§ 766.309(1) and 766.31(1),

1396Fla. Stat.; Humana of Florida, Inc. v. McKaughan , 652 So. 2d

1407852, 859 (Fla. 2d DCA 1995)("[B]ecause the Plan . . . is a

1421statutory substitute for common law rights and liabilities, it

1430should be strictly constructed to include only those subjects

1439clearly embraced within its terms."), approved , Florida Birth -

1449Related Neurological Injury Compensation Associat ion v.

1456McKaughan , 668 So. 2d 974, 979 (Fla. 1996) .

146514 . Where, as here, the administrative law judge

1474determines that ". . . the injury alleged is not a birth - related

1488neurological injury . . . she or he [is required to] enter an

1501order [to such effect] and . . . cause a copy of such order to

1516be sent immediately to the parties by registered or certified

1526mail." § 766.309(2), Fla. Stat. Such an order constitutes

1535final agency action subject to appellate court review.

1543§ 766.311(1), Fla. Stat.

1547CONCLUSION

1548ORD ERED the claim for compensation filed by Sheila

1557Sinclair, individually and as legal guardian of China La'Sha

1566Reaves, a minor, and April Reaves, individually and as mother of

1577China La'Sha Reaves, a minor, is dismissed with prejudice.
