185The issue to be resolved in t his portion of this power
197plant site certification proceeding is whether the site for the
207proposed Seminole Generating Station Unit 3 Project is
215consistent and in compliance with the applicable land use plans
225and zoning ordinances of Putnam County, Florida , pursuant to
234Section 403.508(2), Florida Statutes. 1
239PRELIMINARY STATEMENT
241This proceeding was conducted pursuant to the Florida
249Electrical Power Plant Siting Act (PPSA), Chapter 403, Part II,
259Florida Statutes , and Florida Administrative Code Rule Chapter 2
26862 - 17, to consider the land use and zoning aspects of Seminole
281Electric Cooperative, Inc.s (SECIs) application for power
288plant site certification of the Seminole Generating Station Unit
2973 Project , which was filed with the Department of Environmental
307Pr otection (DEP) o n March 9 , 2006 . By agreement among the
320parties, th e land use hearing, held pursuant to Section
330403.508(2), Florida Statutes, was scheduled to be held in
339Palatka, Florida, on June 1, 2006 , and public notice was given
350by the Applicant and b y DEP.
357On May 16, 2006, SECI and Putnam County filed a Stipulation
368addressing land use and zoning is sues. In the Stipulation,
378Putnam County a cknowledge d that its adoption of Ordinance 2006 -
39002, which amended the Planned Unit Development (PUD) for the
400si te and approved the Development Agreement referenced in the
410Ordinance, confirm ed that the Seminole Generating Station site,
419including the proposed Unit 3 and the associated facilities (the
429Site) , is consistent and in compliance with the Countys land
439use p lans and zoning ordinances as re quired under Section
450403.508 (2), Florida Statutes.
454A Pre - hearing Stipulation among the parties was filed with
465DOAH on May 24, 2006. The Stipulation was signed by ten of the
47814 agenc ies and other parties. The Stipulatio n indicated that
489no agency party contested the Project sites consistency and
498compliance with local land use plans and zoning ordinances.
507Sierra Club, Inc., took the position that the existing water
517intake pump house , with larger capacity pump inside, and a new
528underground water pipeline and electrical duct bank proposed to
537be added within an existing pipeline easement , constitute
545industrial facilities that are not consistent with the
553Countys current land use plan.
558Only the Applicant, DEP, and Sierra Club appeared and
567participated in the land use hearing on June 1, 2006 . Only the
580Applicant presented witnesses or offered exhibits. The
587Applicants witnesses included: Bobby Payne, Manager for
594Projects and Administrative Services for SECI, who described the
603Project and its proposed site and presented SECI E xhibits 5, 6A,
6157B, 8A , 8B , and 19 ; and Richard Zwolak, who was accepted as an
628expert in l and u se p lanning and z oning presented SECI E xhibits
64318, 7A, 10A, 10 B, 10 C, 11, 12A, 12B, 13A, 13B , and 15 . SECI
659also offered additional SECI E xhibits 1, 2, 16 and 17. All of
672the exhibits were admitted into evidence.
678After the taking of evi dence, Sierra Club requested 15 days
689from the filing of the Transcript to file proposed recommended
699orders , and the request was granted without objection . The
709T ranscript (in two volumes) was filed with DOAH on July 11 ,
7212006. Timely proposed r ecommended o rder s submitted by SECI and
733Sierra Club have been considered in the preparation of this
743Recommended Order on Land Use and Zo ning .
752FINDINGS OF FACT
7551. SECI is a member - owned generation and transmission
765electric cooperative. SECI supplies power to ten electric
773cooperative member s throughout Florida. These cooperatives
780primarily serve rural areas of the State. SECI's members
789c urrently serve approximately 1.6 million cus tomers throughout
798the State. SECI's headquarters are in Tampa, Florida.
8062. SECI first came into existence in 1948 under the
816Federal Rural Electrification Act to provide electric power to
825rural areas. Initial ly, SECI purchased power from other
834utilities for its individual members. In the 1970s, in response
844to the oil embargo, SECI's member cooperatives determined it was
854in their best interest to build their own power supply. SECI
865then licensed, constructed , and commenced operation of the coal -
875fired power plant near Palatka , in Putnam County. SECI also has
886a power plant in Hardee County, Florida. These two power plants
897allow SECI to provide approxim ately 70 percent of the power for
909the member cooperatives, w hile purchasing 30 percent of the
919power needs of the member cooperatives fro m other utilities.
9293. The Site is located in the unincorporated area of the
940county . It is approximately five miles north of the city of
952Palatka. The St. Johns River is located to the south and to the
965east of the power plant site.
9714. The Site is a 1 , 300 megawatt facility located on a site
984comprised of two parcels of land totalling approximately 2 , 000
994acre s in size. The larger parcel of the site , which contains
1006the existing c oal - fired Units 1 and 2 and almost all related
1020facilities, began operation in 1984. Other existing facilities
1028on the larger parcel includ e : two boiler buildings and the
1040turbine generator buildings ; precipitator s , scrubber module s ,
1048and a combined flue sta ck ; two natural draft cooling towers; a
1060coal yard for unloading and storage of coal; a n A - frame storage
1074building for limesto ne used in the scrubber process ; a rail spur
1086and rail loop used to bring coal into the Plant site ; and a coal
1100conveyor to bring the coal from the coal yard to the boilers .
1113The new Unit 3 will be constructed on this larger parcel.
11245. The balance of the larger parcel of the S ite is in pine
1138flat woods. North and northwest of the power plant is the
1149Lafarge wallboard facility, where co mbustion by - products from
1159the existing units are converted into synthetic gypsum for the
1169manufacture of wallboard.
11726. The S ite also includes a smal ler parcel of
1183approximately 4.5 acres located approximately 1,000 feet to the
1193south along the St. Johns Ri ver. An intake pump house is
1205located on this parcel to pump water from the r iver for use by
1219the existing units. Currently, there are four underground pipes
1228(one of which is not in use) and a n underground duct bank with
1242electrical conduit. The undergrou n d pipes and duct bank
1252continue from the smaller parcel to the larger parcel through an
1263existing privately - granted easement .
12697. The Site and the existing two steam electric generating
1279units, Units 1 and 2, were certified in proceedings under the
1290PPSA tha t took place in 1978 and 1979. In 1978, when the Site
1304initial ly was being developed and certified under the PPSA,
1314Putnam County was in the process of developing its Comprehensive
1324Plan and its Future Land Use Map (FLUM) . However, the County
1336had zoning reg ulations in place, and it and rezoned the larger
1348and smaller parcels as a PUD for the purpose of an electrical
1360generating facility.
13628 . During the 1978 land use hearing , which also addressed
1373the pipeline easement which provides access to the St. Johns
1383Ri ver, the Hearing Officer concluded that the S ite was
1394consistent and in compliance with the land use plans and zoning
1405regulations in effect at that time. The Siting Board
1414subsequently adopted the Hearing Officers conclusions regarding
1421land use and zoning issues. In its Order Relating to Land Use
1433and Zoning, entered on March 21, 1979, the Siting Board
1443determined that the S ite, including the intake pump house and
1454pipeline easement, was consistent and in compliance with the
1463land use plans and zoning ordinanc es of Putnam County. In the
1475Order Relating to Land Use and Zoning, the Siting Board also
1486ordered the responsible zoning and planning authorities . . .
1496to refrain from hereafter changing such land use plans or zoning
1507ordinances so as to affect the propose d si te. IN RE: Seminole

15479 . Sierra Club was a party to the original site
1558certification proceeding and is bound by its determinations on
1567consistency with land use and zoning .
157410 . SECI is proposing to construct a new Unit 3 at the
1587S ite designed fo r a capacity of 750 megawatts . The new unit and
1602related facilities are much like the existing facilities and
1611will utilize many of the existing onsite facilities. Like the
1621two existing units , t he new Unit 3 will burn coal as its primary
1635fuel with up to 30 percent petroleum coke. The new unit will
1647consist of a turbine generat or building, a new boi ler building,
1659precipitators, scrubber modules , and a wet electrostatic
1666precipitator. A single flue gas stack will serve the new unit.
1677A new mechanical draft cooling tower will also be constructed on
1688the site to serve the new Unit 3 . The new cooling towe r will
1703have a lower profile than the existing natural draft cooling
1713towers. The existing coal yard will be expanded for the new
1724unit and additional facilities will be added in the limestone
1734scrubber area to handle the additional gypsum that will be
1744create d. Construction for the new Unit 3 is planned to begin in
1757late 2008. As planned, the new unit is expected to start up in
1770May 2012.
177211 . SECI's Unit 3 project will integrate the new unit into
1784the existing plant facilities. The existing administration
1791b uilding and parking lot will support the new unit. SECI will
1803continue to use the existing rail spur, including for the
1813delivery of coal and construction materials. The existing
1821switchyard and transmission area will be utilized for the new
1831unit. There wi ll be no new off - site electrical transmission
1843lines for the Unit 3 Project . The existing plant access off
1855Highway 17 will be improved to enhance access for turning
1865vehicles into th e site .
187112 . As indicated, t he existing units are supplied with
1882cooling a nd other service water from the St. Johns R iver. SECI
1895proposes to utilize the existing pump house and to install an
1906additional water pipeline and duct bank within the easement to
1916supply primarily cooling water and also other service water
1925(primarily for b ottom ash handling and for the scrubber system )
1937to the proposed Unit 3. There will be some enhancements to the
1949pumps and motors inside the pump house to increase the capacity
1960of water withdrawals. Otherwise, t here will be no changes to
1971the existing pump house for the new Unit 3 project .
198213 . The cooling and other service water for Unit 3 will be
1995conveyed to the main power plant site by an additional 36 - inch
2008pipeline to be placed underground and within the e xisting
2018private easement . As indicated, t he ex isting easement was
2029created in 1978 and the existing pipelines were installed as
2039part of the development of Units 1 and 2. A second duct bank
2052will also be placed in the existing easement. There will be no
2064facilities constructed above the ground surface w ithin that
2073easement. The easement will be restored to its existing
2082condition after the new water pipeline is installed.
209014. The existing land uses adjacent to the Site are
2100primarily undeveloped land. Residential areas along the St.
2108Johns River are the closest development to the S ite, with the
2120exception of the Lafarge gypsum plant located adjacent to the
2130larger parcel of the Site . The closest communities are
2140Bridgeport , which is located approximately 3.5 miles to the
2149east , and Bostwick, which is locate d 2 .5 miles to the north.
216215. The pattern of development in the area since the
2172existing Units 1 and 2 began operation in 1984 has been single
2184family residential development located along the river and the
2193construction of the Lafarge wallboard plant . Wi th the exception
2204of the wallboard plant, t he areas between that residential
2214corridor and the Site , as well as in all four directions around
2226the site, continue to be undeveloped land.
223316. There are two e xisting homes located near the S ite.
2245One home is l ocated approximately one mile south of the proposed
2257Unit 3 stack, and another home is approximately one mile west of
2269the Plant site . There is existing power plant infrastructure
2279between the Unit 3 site and those two nearest residences,
2289including the large natural draft cooling towers, wastewater
2297treatment equipment, and other associated facilities.
230317. The addition of the proposed Unit 3 would be
2313compatible with the existing land uses at and near the S ite.
2325The new Unit 3 will have very similar operatin g characteristics
2336to the existing units , but will use additional air emissions
2346controls . The residential development along the St. Johns River
2356has continued while Units 1 and 2 have operated. The new Unit 3
2369will be able to co - exist with existing land use s in that the new
2385Unit 3 is not expected to have a significant adverse impact to
2397nearby residential development.
240018 . When its Comprehensive Plan with FLUM was adopted
2410(after the Siting Boards March 1979 Order Relating to Land Use
2421and Zoning ), t he Count y designated the larger parcel in the
2434Industrial Future Land Use category to recognize the existing
2443Units 1 and 2 at the site. Electrical power plants are an
2455allowed use in the Industrial future land use category.
246419 . A pproximately two - thirds of t he sm aller parcel of the
2479site front ing on the St. Johns River wa s designated Agricultural
2491II and approximately one - third ( the part contiguous to the
2503river) was designated Rural Residential under the Countys
2511Comprehensive Plan and FLUM . The existing pump house is located
2522on the Rural Re sidential part of the parcel. The u nderground
2534water pipe s and electrical duct bank lead from the pump house
2546towards the larger parcel of the S ite, which is designated
2557Industrial . The existing pump house and underground water pi pe s
2569and electrical duct bank are allowed use s in both the
2580Agricultural II and in the Rural Residential future land use
2590districts, as a Type 2 Community Facility.
259720 . The underground water pipe s a nd electrical duct bank
2609proceed from the smaller parcel to th e larger parcel of the S ite
2623through a privately - granted easement across property designated
2632Agricultur al II on the Countys FLUM . The Countys
2642C omprehensive P lan does not prohibit such facilities in that
2653land use designation. The lands in the pipeline easement are
2663zoned Agricultural. Such facilities also are not precluded in
2672that zoning district.
267521 . The installation of the existing underground water
2684p ipe s and electrical duct bank within the easement was approved
2696by Putnam County a t the time of the original site certification
2708proceeding for the Site . In October 1978, the Putnam County
2719Code Administrator stated that the Countys zoning for the lands
2729covered by the easement to the St. Johns River did not preclude
2741the use of the easement for the pipel ine installation.
275122 . On January 10, 2006, the Putnam County Commission
2761adopted Ordinance 2006 - 02, which amended the original PUD zoning
2772approval for the S ite. The amended PUD zoning ordinance covers
2783both parcels of the S ite. This amended PUD zoning o rdinance
2795allows the placement of Unit 3 and its related facilities within
2806both parcels of the S ite. The PUD zoning ordinance incorporates
2817a Development Agreement between Putnam County and SECI , which
2826addresses the Unit 3 facilities proposed to be construc ted by
2837SECI .
283923 . As part of the PUD zoning amendments, the Putnam
2850County Board of County Commission ers reviewed SECI's Unit 3
2860Project for consistency with the Countys Comprehensive Plan.
2868The Commission found the Project to be consistent with the
2878Count ys Comprehensive Plan. More specifically, Ordinance No.
28862006 - 02 found that SECIs proposed amendment to the PUD zoning
2898was consistent with the Comprehensive Plan, would not
2907adversely affect . . . orderly development, met the
2918requirements of the Land Development Code, and will not be
2929placed in agricultural lands. (SECI Exs. 12B, 13A , and 13B)
293924 . The Development Agreement incorporated into Ordinance
2947No. 2006 - 02 acknowledges that the existing pipeline easement is
2958not a part of the PUD. The Deve lopment Agreement clearly
2970differentiated between underground pipelines and other aspects
2977of the Unit 3 Project:
2982The existing pipeline easement, which is not
2989a part of the PUD, runs across property
2997zoned for agricultural uses and falling
3003[sic] within the Ag ricultural II future land
3011use category. Neither the County
3016Comprehensive Plan nor the Land Development
3022Code precludes the repair, replacement or
3028addition of underground water pipes
3033necessary to plant operations. The
3038underground pipes, and the pipeline
3043ea sement, were part of the original
3050certification and any modifications required
3055to accommodate Unit 3 will be reviewed as
3063part of the site certification process.
3069Subject to site certification under the
3075PPSA, Unit 3 will be constructed primarily
3082east of, bu t integrated with, existing Units
30901 and 2 such that any new development
3098activity will fall within that portion of
3105Parcel 1 designated under the Industrial
3111future land use category. But for the
3118existing pump house, Parcel 2, which is part
3126of the PUD, will remain undeveloped. Pumps
3133within the existing pump house will be
3140replaced or upgraded and existing
3145underground water pipes may be replaced or
3152upgraded, and new underground pipes may be
3159added, but no new uses or structures are
3167intended for Parcel 2. The p ipeline
3174easement which is not part of the PUD
3184will remain undeveloped although pipes may
3190be repaired, replaced (or additional pipes
3196installed) underground between Parcels 1 and
32022.
3203Although no new uses or above - ground
3211structures are anticipated on Parc el 2 or
3219the pipeline easement, both are considered
3225to be part of the electrical power plant to
3234be certified under the PPSA and will be
3242reviewed along with Parcel 1 throughout the
3249State site certification process to which
3255the COUNTY shall be a party.
3261(SECI Ex. 13B , pp. 5 - 6 )
326925 . Sierra Club participated in the Putnam County January
32792006 zoning hearing on the amended PUD zoning for the S ite. The
3292Sierra Club did not object to the adoption of the amended PUD
3304zoning ordinance at that hearing. No party has app ealed the
3315Putnam County Commissions amended PUD zoning ordinance for
3323SECI's Unit 3 Project. S ierra Club is now bound by the
3335determinations of land use and zoning consistency in these prior
3345proceedings , as well as in the original site certification
3354procee ding.
335626 . Putnam County entered into a Stipulation with SECI
3366which addresses land use and zoning issues. In the Stipulation,
3376Putnam County acknowledged that the adoption of Putnam County
3385Ordinance 2006 - 02, which amended the PUD zoning for the Site,
3397and the approval of the Development Agreement referenced in that
3407Ordinance by the Putnam County Board of County Commissioners,
3416both confirm that the S ite, including the proposed Unit 3 and
3428the associated facilities, are consistent and in compliance with
3437appli cable land use plans and zoning ordinances as requir ed
3448under Section 403.508 (2), Florida Statutes.
345427 . Despite its participation in both the 1979 site
3464certification proceeding and the 2006 re - zoning process, Sierra
3474Club nonetheless takes the position i n this case that the pump
3486house and cooling water pipeline are industrial facilities
3494which are not consistent with the future land use designations
3504for the lands occupied by those facilities.
351128 . Putnam County has adopted a definition of
3520development that provides in pertinent part:
3526T he following operations or uses shall not
3534be taken for the purposes of this act [the
3543Countys land development code] to involve
3549development:
3550(b) Work by any utility and other
3557persons engaged in the
3561distribution or t ransmission of
3566gas or water, for the purpose of
3573inspecting, repairing, redoing, or
3577constructing on established
3580rights - of - way any sewers, mains,
3588pipes, tables, utility tunnels,
3592power lines, tow ers, poles, tracks
3598or the like.
3601Putnam Countys Land Developm ent Code, Article 12, Section
361012.01.01.a.2. This definition of development also applies to
3618actions seeking legislative action to amend this Code and the
3628Comprehensive Plan of Putnam County. Id. The Countys
3636definition of development therefore excl udes the additional
3644cooling water pipeline and duct bank within the established
3653easement containing similar pipelines and duct bank between the
3662principal power plant site and the riverside pump house. No
3672Comprehensive Plan amendments or other zoning appro vals would be
3682required for those pipelines and duct banks as they are not
3693development subject to the plan or the local land development
3703code.
370429 . Underground pipelines and electrical duct banks such
3713as those proposed for SECI's Unit 3 project are not typically
3724regulated as a land use. All developed areas have water and
3735sewer pipelines that radiate through different zoning districts
3743and that serve the users that subscribe to such water and sewer
3755service. The practical effect of regulating such facilit ies as
3765 development c ould result in a spider web of land use and
3779zoning classifications running wherever those facilities are
3786placed .
378830 . Even i f it were to be concluded that the underground
3801water pipes and electrical duct bank s were "development" subj ect
3812to Putnam Countys Comprehensive Plan, SECI's expert land
3820planner testified without contradiction that they would be
3828considered a T ype 2 community facility as defined in the
3839Comprehensive Plan: " Type 2 [C ommunity F acilities and Services]
3849are light inf rastructure facilities , including but not limited
3858to, water wells, water tanks, sewage pump stations, electrical
3867substations, and water and wastewater treatment plants with a
3876capacity of less than 500,000 gallons per day . " Type 2
3888community f acilities are allowed in all eleven of Putnam
3898County s Future Land Use categories.
390431 . As indicated, the smaller parcel of the S ite is zoned
3917as a PUD that allows the activities proposed. The easement for
3928the underground water pipes and electrical duct banks is zoned
3938for Agriculture zoning . As indicated, use of the easement for
3949the underground facilities has been approved by the County since
39591978.
396032 . U nrebutted testimony demonstrated that there will be
3970no physical changes to the pump house itself , but only
3980replac ement of the pump inside with a larger one with more
3992capacity, and that the additional underground wate r pipe and
4002duct bank will not be visible , as the land will be restored to
4015current conditions. Sierra Club offered no evidence
4022contradicting Putnam Count y s interpretation of its own
4031Comprehensive Plan land development regulation s ; offered no
4039evidence as to how the community c ould be adversely affected by
4051the continued use of the pump house, with larger pump, a nd the
4064addition of underground water pipes and duct bank in the
4074existing pipeline easement ; and offered no evidence that these
4083facilities for the pumping and conveyance of river water to the
4094plant site constitute industrial uses under the land use plans
4104and zoning regulations of Putnam County.
4110CO NCLUSIONS OF LAW
41143 3 . This proceeding was conducted in accordance with
4124Section 403.508(2), Florida Statutes. See also § 403.5065, Fla.
4133Stat. The Division of Administrative Hearings, therefore, has
4141jurisdiction of the parties to and the subject matter of this
4152proceeding.
415334 . In accordance with Chapter 403, Part II, Florida
4163Statutes, and Rule Chapter 62 - 17, proper p ublic notice was
4175accorded all persons, entities, and parties entitled to such
4184notice. All necessary and required governmental agencies, as
4192we ll as members of the public, either participated in or had the
4205opportunity to participate in the land use hearing.
421335 . The applicable land use plans and zoning ordinances
4223for SECI's Unit 3 Project and the Site are those adopted by
4235Putnam County. For pur poses of the land use hearing, under
4246Section 403.508(2), Florida Statutes, the applicable land use
4254plan is the Future Land Use Element of the Putnam County
4265Comprehensive Plan and the accompanying FLUM . The applicable
4274zoning ordinance for the Project and the Site is contained in
4285the Putnam County Land Development Code. The site - specific
4295amended PUD zoning ordinance for the Site, dated January 10,
43052006, also constitutes a zoning regulation of Putnam County that
4315is directly applicable to the Project and th e S ite.
432636 . The Siting Board has previously determined that the
4336Site for the Unit 3 Project is consistent and in compliance with
4348the land use plans and zoning ordinances of Putnam County. This
4359conclusion was reached in the Siting Boards March 21 , 1979
4369Order Relating to L and U se and Z oning.
437937 . In accordance with Section 403.508(2), Florida
4387Statutes (1977), the Siting Boards Order Relating to Land Use
4397and Zoning directed that the responsible zoning and planning
4406officials are ordered to refrain from he reafter changing such
4416land use plans and zoning ordinances so as to affect the
4427proposed site. As found, Putnam County has not taken any
4437subsequent land use or zoning actions which affect the continued
4447use of the S ite for electrical generating facilities.
445638 . Subsequent to the Siting Boards Final Order Relating
4466to Land Use and Zoning, Putnam County adopted a Comprehensive

4527the pump house and the pipeline easement, that are consistent
4537with the Siti ng Boards Order Relating to Land Use and Zoning
4549and do not affect the use of th o se properties for such use s .
456539 . In January 2006, the Putnam County Board of County
4576Commissioners a mended its existing PUD zoning ordinance for the
4586S ite to recognize the prop osed Unit 3 project, including the
4598proposed cooling water pipeline and duct bank . This action does
4609not affect the site in a manner contrary to the Siting Boards
4621Order Relating to Land Use and Zoning of March 21, 1979 .
463340 . Putnam Countys Land Developmen t Codes definition of
4643development exempts from that definition work by any utility
4652and other persons engaged in the distribution or transmission of
4662gas or water for the purpose of inspecting, repairing, renewing
4672or constructing on established rights - of - way any sewers, mains,
4684pipes, cables, utility tunnels, power lines, towers, poles,
4692tracks or the like. That definition applies to both the
4702Comprehensive Plan and the Countys Land Development Code.
4710Since the installation of the pipeline is not consider ed
4720development, it is not subject to the Countys Comprehensive
4730Plan or to the Countys Land Development Code, which includes
4740the Countys zoning regulations.
474441 . The Countys a mended PUD zoning for the site also
4756addresses the installation of the pipe line and duct bank within
4767that portion of the S ite. No evidence was offered that the
4779pipeline within the larger parcel of the site would be located
4790in the areas designated or zoned for a gricultur al uses. The
4802installation of the pipeline and duct bank in area s designated
4813and zoned for a gricultural uses would not be development
4825subject to regulation under the Countys Comprehensive Plan and
4834Land Development Code since the additional pipeline and duct
4843bank would be within an established utility right - of - wa y .
485742 . Even if the pipeline and duct bank were concluded to
4869be development subject to the Countys C omprehensive P lan and
4882Land Development Code, it would be a Type 2 community facility
4893under the Comprehensive Plan which is allowed in all future land
4904u se categories in Putnam County , including lands designated for
4914agricultural uses.
491643 . Competent substantial evidence received at the hearing
4925demonstrates that the Site and the Unit 3 Project , including the
4936pump house and additional underground water pip e and electrical
4946duct bank , are consistent and in compliance with Putnam Countys
4956land use plans and are consistent and in compliance with
4966applicable Putnam County zoning ordinances for the s ite,
4975including the amended PUD zoning ordinance for the site.
4984RE COMMENDATION
4986Based upon the foregoing Findings of Fact and Conclusions
4995of Law, it is
4999RECOMME NDED that the Siting Board find, pursuant to Section
5009403.508(2), Florida Statutes , that the site for SECI s Unit 3
5020and its related facilities , to be located in Pu tnam County
5031Florida, as described by the evidence presented at the hearing,
5041are consistent and in compliance with existing land use plans
5051and zoning ordinances and site - specific zoning approvals of
5061Putnam County.
