123STATEMENT OF THE ISSUE S
128The issue s are (1) the amount of attorneys fees and costs
140that Respondent must pay to Petitioner for the appeal in French
151v. Department of Children and Familie s , 920 So. 2d 671 (Fla. 5th
164DCA 2006), and (2) Petitioners entitlement to an award of
174attorneys fees and costs in the proceeding that gave rise to
185the appeal .
188PRELIMINARY STATEMENT
190In French , supra , the c ourt held that Petitioner is
200entitled to an award of appellate attorneys fees and costs
210against the Department of Children and Famil y Services ( DCF )
222pursuant to Section 120. 595(5), Florida Statutes. The c ourt
232remanded the case for the appointment of an Administrative Law
242Judge to determine the amount of the award and also to consider
254Petitioners request for an award of attorneys fees and costs
264pursuant to Section 120.595(1)(b), Flor ida Statu t es, for the
275underlying proceeding before the DCF hearing officer.
282On May 1, 2006, this case was referred to the Division of
294Administrative Hearings (DOAH) by the Agency for Persons with
303Disabilities (Agency). The Agency now administers the program
311at iss ue in the underlying proceeding, and pursuant to Section
32287(3) of Chapter 2004 - 267, L aws of Florida, the Agency w as
336substituted for DCF as the real party in interest. Petitioners
346motion to strike the Agencys appearance and change the caption
356of the case to designate D CF as the Respondent was denied
368through an Order entered May 12, 2006.
375Pursuant to the agreement o f the parties, as memorialized
385in the Supplemental Order of Pre - hearing Instructions entered
395May 12, 2006, Petitioner filed three separate motions for
404attorneys fees and costs on June 13, 2006. The first motion
415sought $177,298.00 in attorneys fees (to b e increased by a 2.5
428multiplier), $18,579.08 in costs, and interest, for the
437proceeding before the DCF hearing officer. The second motion
446sought $44,800.00 in attorneys fees (to be increased by a 2.5
458multiplier), $2,844.43 costs, and interest, for the ap peal . The
470third motion sought an award of attorneys fees and costs for
481this DOAH proceeding. The Agency filed responses to the motions
491on June 30 and July 3, 2006.
498On Au gust 31, 2006, the undersigned entered an Order on
509Petitioners Motion For Attorney s Fees and Costs Related to
519t his DOAH Proceeding, which concluded that Petitioner is not
529entitled to an award of attorneys fees for this DOAH
539proceeding , but that she may be entitled to an award of costs.
551On September 27, 2006, the Agency filed an amende d affidavit of
563its expert witness who opined that Petitioner was entitled to
573attorneys fees and costs of only $76,563 (with no multiplier)
584for the DCF hearing and only $38,170 (with no multiplier) for
596the appeal.
598The case was set for final hearing on Nove mber 15 - 16, 2006.
612However, o n October 25, 2006, the parties filed an Agreed Motion
624for Continuance in which they represented that the y had re ached
636an agreement to settle this case. On that same date, the
647undersigned entered an Order Canceling Hearing and Placing Case
656in Abeyance, which required the parties to file a status report
667no later than November 9, 2006.
673The Agency filed a status report on November 8, 2006, i n
685which it stated that the parties tentative settlement
693agreement fell through as a resu lt of another petition for
704attorneys fees filed by Petitioner. 1 Petitioner filed a status
714report on November 9, 2006, which stated that the parties had a
726binding settlement agreement that should be given effect.
734A telephonic case management conference wa s held on
743November 20, 2006 , at which t he undersigned determined that the
754parties had rea ched an agreement to settle this case . The
766purpose of this Final Order 2 is to memorialize that finding and
778close DOAHs file in this case.

7942006 version of the Florida Statutes.
800FINDINGS OF FACT
8031. This case concerns the amount of attorneys fees and
813costs that are due to Petitioner for the appeal in French ,
824supra , and Petitioners entitlement to attorneys fees and costs
833for the DCF hearing that gave rise to that appeal.
8432. The parties stipulated at the outset of the proceeding
853as to Petitioners entitlement to an award of attorneys fees
863and costs for the DCF hearing.
8693. On October 24, 2006, t he parties reac hed an agreement
881as to the amount of the attorneys fees and costs that
892Petitioner is due for the appeal and the underlying DCF hearing. 3
9044. There are no other disputed issues of material fact
914between the parties on the issues remanded by the appellate
924c ourt.
926CONCLUSIONS OF LAW
9295 . DOAH has jurisdiction over the parties to and subject
940matter of this proceeding pursuant to French , supra , and Section
950120.595, Florida Statutes .
9546 . Section 120.57(4), Florida Statutes, provides that
962 informal disposition ma y be made of any proceeding by
973stipulation, settlement, or consent order .
9797. DOAH does not have jurisdiction to enforce the parties
990settlement agreement. See , e.g. , Peck Plaza Condominium v.
998Division of Florida Land Sales & Condominiums , 371 So. 2d 15 2
1010(Fla. 1979) .
10138. However, based upon the stipulation between the parties
1022regarding Petitioners entitlement to attorneys fees and costs
1030for the DCF hearing and their settlement regarding the amount of
1041attorneys fees and costs due to Petitioner for the appeal an d
1053the underlying proceeding, there is no basis for DOAH to retain
1064jurisdiction over this case. Therefore, DOAHs file will be
1073closed pursuant to Section 120.57(4), Florida Statutes.
1080ORDER
1081Based upon the foregoing findings of fact and conclusions
1090of law, it is
1094ORDERED that t he file of the Division of Administrative
1104Hearings in this case is hereby closed.

1320including the amount ($129,595.00) and the scope of the
1330settlement (issues in this case o nly), were approved by their
1341respective clients; that the settlement was not conditioned on
1350any subsequent events or the negotiation of additional terms;
1359and that the terms of the agreement were memorialized in a
1370letter from Petitioners counsel to the Age ncys counsel dated
1380October 24, 2006. This is not the proper forum for the Agency
1392to "renege on" or attempt to rene gotiate the settlement
1402agreement. See Palm Springs General Hospital, Inc. v. Health
1411Care Cost Containment Board , 560 So. 2d 1348, 1349 (Fla . 3d DCA
14241990) (T he principles which favor the settlement of existing
1434controversies, and which require adherence to all enforceable
1442contracts both have particular application to an administrative
1450proceeding such as this. Indeed, it is no less than unseem ly,
1462perhaps even more than in the case of private litigants, for an
1474agency of our government . . . even to attempt to renounce an
1487agreement i nto which it has freely entered. (citations
1496omitted)).
