112STATEMENT OF THE ISSUES

116The issues are whether Respondent violated Section

123489.127(1)(f), Florida Statutes (2005), and if so, w hat penalty

133should be imposed.

136PRELIMINARY STATEMENT

138Petitioner Department of Business and Professional

144Regulation (Petitioner) issued an Administrative Complaint on

151February 28, 2006, against Domenick Spallina, d/b/a New Look

160Contracting, Inc. (Respon dent). The complaint alleged that

168Respondent had engaged in the business of contracting, acted in

178the capacity of a contractor, or advertised himself or a

188business organization as available to engage in contracting

196without being duly registered or certifi ed or having a

206certificate of authority.

209On March 20, 2006, Respondent requested an administrative

217hearing to contest the allegations in the complaint. Petitioner

226referred Respondent's request to the Division of Administrative

234Hearings on May 30, 2006.

239On June 7, 2006, the undersigned issued a Notice of

249Hearing. The notice scheduled the hearing for August 9, 2006.

259On July 31, 2006, Respondent filed an unopposed request for

269a continuance. On August 1, 2006, the undersigned issued an

279Order Granting Continuance and Re - scheduling Hearing for

288August 11, 2006.

291During the hearing, Petitioner presented the testimony of

299two witnesses. Petitioner offered seven exhibits, P1 - P7, which

309were admitted into evidence.

313Respondent testified on his own behalf and o ffered three

323exhibits, R1a, R1b, and R2, for admission into the record as

334evidence. The undersigned accepted R1a and R1B as evidence.

343Respondent's Exhibit R2 is hereby excluded as hearsay.

351A transcript of the proceeding was filed on August 30,

3612006. Petitioner filed its Proposed Recommended Order on

369September 8, 2006. As of the date that this Recommended Order

380was issued, Respondent had not file d a proposed order.

390FINDINGS OF FACT

3931. At all times material hereto, Respondent was not

402licensed to enga ge in construction contracting in the State of

413Florida.

4142. At all times material hereto, New Look Contracting,

423Inc. did not possess a certificate of authority to practice as a

435contractor qualified business.

4383. Respondent was a part owner/operator of New Look

447Contracting, Inc.

4494. On or about July 9, 2005, Respondent contracted with

459Lynnda Davis to, inter alia , raise the ceiling on the front

470porch and install French doors on Ms. Davis's office in Lake

481City, Florida, for $950.

4855. Ms. Davis paid Res pondent $1,275 for the construction

496project of which Respondent admits to receiving at least $475.

5066. Respondent broke tiles at Ms. Davis's office and took

516contractually unrelated materials from her property.

5227. All of the items listed in the contrac t between

533Respondent and Ms. Davis required a Lake City, Florida, building

543permit.

5448. The total investigative cost to Petitioner, excluding

552costs associated with any attorney's time, was $311.21.

560CONCLUSIONS OF LAW

5639. The Division of Administrative H earings has

571jurisdiction over the parties and the subject matter of this

581proceeding pursuant to Sections 120.569 and 120.57(1), Florida

589Statutes (2005).

59110. Petitioner is the state agency charged with regulating

600the practice of unlicensed construction contracting pursuant to

608Chapters 455 and 489, Florida Statutes (200 5 ).

61711. Petitioner has the burden of proving by clear and

627convincing evidence that Respondent has violated Section

634489.127(1), Florida Statutes (200 5 ). See Department of Banking

644and Fi nance v. Osborne Stern and Co. , 670 So. 2d 932 (Fla.

6571996).

65812. Section 489.105(3), Florida Statutes (200 5) , states as

667follows in pertinent part:

671(3) "Contractor" means the person who

677is qualified for, and shall only be

684responsible for, the pro ject contracted for

691and means, except as exempted in this part,

699the person who, for compensation, undertakes

705to, submits a bid to, or does himself or

714herself or by others construct, repair,

720alter, remodel, add to, demolish, subtract

726from, or improve any bu ilding structure,

733including related improvements to real

738estate, for others or for resale to others .

753(6) "Contracting" means, except as

758exempted in this part, engaging in business

765as a contractor and includes, but is not

773limited to, pe rformance of any of the acts

782as set forth in subsection (3) which define

790types of contractors. The attempted sale of

797contracting services and the negotiation or

803bid for a contract on these services also

811constitutes contracting. If the services

816offered re quire licensure or agent

822qualification, the offering, negotiation for

827a bid, or attempted sale of these services

835requires the corresponding licensure. . . .

84213. Section 489.113, Florida Statutes (200 5 ), states as

852follows in relevant part:

856(1) Any person who desires to engage

863in contracting on a statewide basis shall,

870as a prerequisite thereto, establish his or

877her competency and qualifications to be

883certified pursuant to this part. . . .

891(2) No person who is not certified or

899registered shal l engage in the business of

907contracting in this state. . . .

91414. Section 489.127(1)(f), Florida Statutes (200 5 ), states

923as follows in pertinent part:

928(1) No person shall:

932* * *

935(f) Engage in the business or act in

943the capacity of a contr actor or advertise

951himself or herself or a business

957organization as available to engage in the

964business or act in the capacity of a

972contractor without being duly registered or

978certified or having a certificate of

984authority;

98515. Under Florida Administrat ive Code Rule 61G4 - 12.011(2) ,

995construction activities that include work affecting access or

1003egress to a structure or any work for which a building permit is

1016required are not casual, minor, or inconsequential.

102316. Clear and convincing evidence indicates that

1030Respondent violated Section 489.127(1)(f), Florida Statutes

1036(200 5 ) , by acting in the capacity of a contractor without being

1049registered or certified. Respondent was not licensed as a

1058contractor when he contracted with Ms. Davis to perform repair

1068work for compensation that required a local building permit.

107717. Section 489.13(3), Florida Statutes (200 5 ), authorizes

1086Respondent to impose an administrative fine in an amount up to

1097$10,000 for any person guilty of unlicensed construction

1106contracting as w ell as the ability to assess reasonable

1116investigative and legal costs, excluding costs associated with

1124an attorney's time, for prosecution of the violation.

1132RECOMMENDATION

1133Based on the foregoing Findings of Fact and Conclusions of

1143Law, it is

1146RECOMMENDE D:

1148That Petitioner enter a final order finding Respondent

1156guilty of violating Section 489.127(1)(f), Florida Statutes

1163(200 5 ), imposing an administrative fine in the amount of

1174$10,000, and assessing costs in the amount of $311.21.
