102STATEMENT OF THE ISSUE
106At issue is whether Wesley Ivanovic, a minor, qualifies for
116coverage under the Florida Birth-Related Neurological Injury
123Compensation Plan (Plan).
126PRELIMINARY STATEMENT
128On July 17, 2006, Daniel Ivanovic and Lori Ivanovic, on
138behalf of and as parents and natural guardians of
147Wesley Ivanovic (Wesley), a minor, filed a petition (claim) with
157the Division of Administrative Hearings (DOAH) for compensation
165under the Plan.
168DOAH served the Florida Birth-Related Neurological Injury
175Compensation Association (NICA) with a copy of the claim on
185July 18, 2006, and on April 10, 2007, following a number of
197extensions of time within which to do so, NICA responded to the
209claim, and gave notice that it was of the view that Wesley did
222not suffer a "birth-related neurological injury," as defined by
231Section 766.302(2), Florida Statutes, and requested that a
239hearing be scheduled to resolve the issue. In the interim,
249David A. Marcantal, M.D., Celebration Obstetrics and Gynecology
257Associates, P.A., and Adventist Health System/Sunbelt, Inc.,
264d/b/a Florida Hospital Celebration Health, were accorded leave
272to intervene.
274Pursuant to notice, dated May 2, 2007, a hearing was
284scheduled for August 20, 2007, to resolve whether the claim was
295compensable. However, on August 9, 2007, the parties filed an
305Agreed Motion to Submit Cause Upon an Agreed Record of Counsel,
316in lieu of a hearing. The parties' motion was granted by Order
328of August 15, 2007, and the hearing scheduled for August 20,
3392007, was canceled.
342The parties filed their Agreed Record of Counsel on
351August 14, 2007, and Supplemental Stipulation of Counsel on
360August 20, 2007, and were accorded until August 27, 2007, to
371file proposed orders. No proposed orders were filed.
379FINDINGS OF FACT
382Stipulated facts
3841. Daniel Ivanovic and Lori Ivanovic are the parents and
394natural guardians of Wesley Ivanovic, a minor. Wesley was born a
405live infant on July 12, 2004, at Adventist Health System/Sunbelt,
415Inc., d/b/a Florida Hospital Celebration Health, Celebration,
422Florida, and his birth weight exceeded 2,500 grams.
4312. The physician providing obstetrical services during
438Wesley's birth was David A. Marcantel, M.D., who, at the time,
449was a "participating physician" in the Florida Birth-Related
457Neurological Injury Compensation Plan, as defined by Section
465766.302(7), Florida Statutes.
4683. Lori Ivanovic was provided notice as required by Section
478766.316, Florida Statutes.
4814. The Agreed Record demonstrates that Wesley did not
490suffer a "birth-related neurological injury," as defined by
498Section 766.302(2), Florida Statutes.
502Coverage under the Plan
5065. Pertinent to the case, coverage is afforded by the Plan
517for infants who suffer a "birth-related neurological injury,"
525defined as an "injury to the brain or spinal cord . . . caused by
540oxygen deprivation or mechanical injury occurring in the course
549of labor, delivery, or resuscitation in the immediate
557postdelivery period in a hospital, which renders the infant
566permanently and substantially mentally and physically impaired."
573§ 766.302(2), Fla. Stat.
5776. Here, the parties' stipulation that Wesley did not
586suffer a "birth-related neurological injury," as defined by the
595Plan, is consistent with the record, which demonstrates that
604Wesley's impairments are most likely developmentally based, as
612opposed to birth-related. Consequently, the record fails to
620support the conclusion that Wesley suffered a "birth-related
628neurological injury," as required for coverage under the Plan.
637CONCLUSIONS OF LAW
6407. The Division of Administrative Hearings has
647jurisdiction over the parties to, and the subject matter of,
657these proceedings. § 766.301, et seq. , Fla. Stat .
6668. The Florida Birth-Related Neurological Injury
672Compensation Plan was established by the Legislature "for the
681purpose of providing compensation, irrespective of fault, for
689birth-related neurological injury claims" relating to births
696occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7079. The injured infant, her or his personal representative,
716parents, dependents, and next of kin, may seek compensation
725under the Plan by filing a claim for compensation with the
736Division of Administrative Hearings. §§ 766.302(3), 766.303(2),
743and 766.305(1), Fla. Stat. The Florida Birth-Related
750Neurological Injury Compensation Association, which administers
756the Plan, has "45 days from the date of service of a complete
769claim . . . in which to file a response to the petition and to
784submit relevant written information relating to the issue of
793whether the injury is a birth-related neurological injury."
801§ 766.305(4), Fla. Stat.
80510. If NICA determines that the injury alleged in a claim
816is a compensable birth-related neurological injury, it may award
825compensation to the claimant, provided that the award is
834approved by the administrative law judge to whom the claim has
845been assigned. § 766.305(7), Fla. Stat. If, on the other hand,
856NICA disputes the claim, as it has in the instant case, the
868dispute must be resolved by the assigned administrative law
877judge in accordance with the provisions of Chapter 120, Florida
887Statutes. §§ 766.304, 766.309, and 766.31, Fla. Stat.
89511. In discharging this responsibility, the administrative
902law judge must make the following determination based upon the
912available evidence:
914(a) Whether the injury claimed is a
921birth-related neurological injury. If the
926claimant has demonstrated, to the
931satisfaction of the administrative law
936judge, that the infant has sustained a brain
944or spinal cord injury caused by oxygen
951deprivation or mechanical injury and that
957the infant was thereby rendered permanently
963and substantially mentally and physically
968impaired, a rebuttable presumption shall
973arise that the injury is a birth-related
980neurological injury as defined in s.
986766.303(2).
987(b) Whether obstetrical services were
992delivered by a participating physician in
998the course of labor, delivery, or
1004resuscitation in the immediate postdelivery
1009period in a hospital; or by a certified
1017nurse midwife in a teaching hospital
1023supervised by a participating physician in
1029the course of labor, delivery, or
1035resuscitation in the immediate postdelivery
1040period in a hospital.
1044§ 766.309(1), Fla. Stat. An award may be sustained only if the
1056administrative law judge concludes that the "infant has
1064sustained a birth-related neurological injury and that
1071obstetrical services were delivered by a participating physician
1079at birth." § 766.31(1), Fla. Stat.
108512. Pertinent to this case, "birth-related neurological
1092injury" is defined by Section 766.302(2), Florida Statutes,
1100to mean:
1102injury to the brain or spinal cord of a live
1112infant weighing at least 2,500 grams for a
1121single gestation or, in the case of a
1129multiple gestation, a live infant weighing
1135at least 2,000 grams at birth caused by
1144oxygen deprivation or mechanical injury
1149occurring in the course of labor, delivery,
1156or resuscitation in the immediate
1161postdelivery period in a hospital, which
1167renders the infant permanently and
1172substantially mentally and physically
1176impaired. This definition shall apply to
1182live births only and shall not include
1189disability or death caused by genetic or
1196congenital abnormality.
119813. Here, the proof failed to support the conclusion that,
1208more likely than not, Wesley's neurologic impairments were the
1217result of an injury to the brain or spinal cord caused by oxygen
1230deprivation or mechanical injury occurring in the course of
1239labor, delivery, or resuscitation in the immediate postdelivery
1247period in the hospital. Consequently, given the provisions of
1256Section 766.302(2), Florida Statutes, Wesley was not shown to
1265qualify for coverage under the Plan. See also §§ 766.309(1) and
1276766.31(1), Fla. Stat.; Humana of Florida, Inc. v. McKaughan , 652
1286So. 2d 852, 859 (Fla. 2d DCA 1995)("[B]ecause the Plan . . . is
1301a statutory substitute for common law rights and liabilities, it
1311should be strictly constructed to include only those subjects
1320clearly embraced within its terms."), approved , Florida Birth-
1329Related Neurological Injury Compensation Association v.
1335McKaughan , 668 So. 2d 974, 979 (Fla. 1996).
134314. Where, as here, the administrative law judge
1351determines that ". . . the injury alleged is not a birth-related
1363neurological injury . . . she or he [is required to] enter an
1376order [to such effect] and . . . cause a copy of such order to
1391be sent immediately to the parties by registered or certified
1401mail." § 766.309(2), Fla. Stat. Such an order constitutes
1410final agency action subject to appellate court review.
1418§ 766.311(1), Fla. Stat.
1422CONCLUSION
1423ORDERED the claim for compensation filed by Daniel Ivanovic
1432and Lori Ivanovic, on behalf of and as parents and natural
1443guardians of Wesley Ivanovic, a minor, is dismissed with
1452prejudice.
