112STATEMENT OF THE ISSUE S

117Whether Respondent engaged in the business of contracting

125without being registered or certified , in violation of

133S ubs ection 4 89.127(1)(f), Florida Statutes (200 4 ) , 1 as charged in

147the Administrative Complaint; and, if so, what penalty should be

157imposed.

158PRELIMINARY STATEMENT

160On August 9, 2005, Petitioner filed an Administrative

168Complaint alleging Respondent had violated the laws regulating

176the practice of unlicensed construction contracting in the State

185of Florida. Respondent disputed the allegations and elected a

194formal administrative hearing. On August 25, 2006, the case was

204referred to the Division of Administrative Hearings, and the

213case was set for hearing.

218At the hearing, Petitioner offered the testimony of two

227witnesses, Diandria Mason and William Darner. Petitioner

234introduced seven e xhibits, which were accepted into evidence.

243Respondent testified on her own behalf, and offered ten

252e xhibits , seven e xhibits were accepted into evidence.

261The T ranscript of the hearing was filed on December 5,

2722006. Both parties timely filed P roposed R ecommended O rders ,

283and the pa rt ies proposals have been carefully considered in the

295preparati on of this Recommended Order.

301FINDINGS OF FACT

304Based on the evidence in this proceeding, the following

313facts are found:

3161. Petitioner is the state agency charged with the

325responsibility and duty to prosecute administrative complaints,

332pursuant to Section 20.165 and Chapters 120, 455, and 489,

342Florida Statutes. Petitioner is authorized to prosecute

349administrative complaints against unlicensed persons or business

356organization s , w ho engage in the business or act in the capacity

369of a contractor without being registered or certified.

3772 . At all times material hereto, Respondent , personally,

386was not licensed to engage in construction contracting in the

396State of Florida.

3993. At all times material hereto, Rentaman or Rentaman

408Construction/Remodeling did not posses s a certificate of

416authority to practice as a contractor qualified to do business

426in Florida.

4284 . At all times material hereto, Timothy Lee Allen was not

440licensed to engage in construction contracting in the State of

450Florida.

4515 . Beginning sometime in 2003 until September 30, 2005,

461Petitioner, doing business as Rentaman, operated as a sole

470proprietor under an occupation license in Seminole County.

4786. In October 2004, Timothy L. Allen entered into an

488agreement with Respondent to purchase her trailer, tools , and

497the right to use her business name in Polk County. Respondent

508was to receive a five percent commission on any job in which she

521assisted Allen, including bookkeeping, preparing invoices, and

528drafting contracts.

5307 . Allen set up a business in Polk Coun ty, using the name

544Rentaman Construction and Remodeling in October 2004.

5518 . In early November 2004, Allen negotiated with James and

562Diandria Mason to do repair/remodeling work on their home in

572Mulberry, Polk County, Florida. Respondent was contacted and

580brought in to negotiate the contract with the Masons.

5899 . On or about November 11 , 2004, Respondent, doing

599business as Rentaman Construction/Remodeling, contracted with

605James and Diandria Mason to, inter alia , frame the back door and

617replace the subfloorin g in the Mason's Mulberry, Florida , mobile

627home for $1,650.00.

6311 0 . The entire second page of the contract was handwritten

643by Respondent . T he first page included a handwritten

653workmanship warranty , written and initialed by Respondent. The

661contract includ ed the sentence: "I[the owners] have reviewed and

671accept the terms and conditions of Sale as presented to me by

683Debi Gold, an agent of Rentaman."

68911 . Mason paid Respondent $1,100 cash , as a deposit for

701the construction project.

7041 2 . Allen w as placed in ch arge of the work, but failed to

720complete the contract with the Masons.

7261 3 . The evidence is clear and convincing that Respondent

737engaged in the business or acted in the capacity of a contractor

749in November 2004, in Polk County, without being registered or

759certified .

7611 4 . The total investigative costs to Petitioner, excluding

771costs associated with any attorney's time, was $ 762.43.

780CONCLUSIONS OF LAW

78315 . The Division of Administrative Hearings has

791jurisdiction over the parties to and subject matter of this

801p roceeding, pursuant to Section 120.569 and Subsection

809120.57 (1) , Florida Statutes.

8131 6 . Petitioner is the state agency charged with regulating

824the practice of unlicensed construction contracting , pursuant to

832Chapters 455 and 489, Florida Statutes.

8381 7 . Pur suant to Chapter 489, Florida Statutes, Respondent

849is empowered to impose administrative penalties upon any person

858who is found guilty of any of the grounds enumerated in

869S ubs ection 489.127(1), Florida Statutes.

8751 8 . Petitioner has the burden of proving , b y clear and

888convincing evidence , the allegations against Respondent.

894§ 120.57(1)(h), Fla . Stat . ; Department of Banking and Finance v.

906Osborne Stern and Co. , 670 So. 2d 932 (Fla. 1996) ; Ferris v.

918Turlington , 510 So. 2d 292 (Fla. 1987) .

92619 . Evans Packing Co . v. Department of Agriculture and

937Consumer Services , 550 So. 2d 112, 116, fn. 5 (Fla. 1st DCA

9491989) , provides the following guidance regarding the clear and

958convincing evidence standard:

961The standard has been described as follows:

968Clear and convincing ev idence requires that

975the evidence must be found to be credible;

983the facts to which the witnesses testify

990must be distinctly remembered; the evidence

996must be precise and explicit and the

1003witnesses must be lack ing in confusion as to

1012the facts in issue. The evidenc e must be of

1022such weight that it produces i n the mind of

1032the trier of fact the firm belief of (sic)

1041conviction, without hesitancy, as to the

1047truth of the allegations sought be

1053established. Slomowitz v. Walker , 429 So.

10592d 797, 800 (Fla. 4th DCA 1983 ).

10672 0 . The Administrative Complaint alleges Respondent is

1076guilty of having violated S ubs ection 489.127(1)(f), Florida

1085Statutes, which provides, in pertinent part, as follows:

1093(1) No person shall :

1098(f) Engage in the business or act in the

1107capacity of a contractor or advertise

1113himself or herself or a business

1119organization as available to engage in the

1126business or act in the capacity of a

1134contractor without being duly registered or

1140certified or having a certificate of

1146authority;

114721 . S ection 489.105, Flor ida Statutes, as used in this

1159part, defines a construction contractor as the following:

1167(3) "Contractor" means the person who is

1174qualified for, and shall only be responsible

1181for, the project contracted for and means,

1188except as exempted in this part, the p erson

1197who, for compensation, undertakes to,

1202submits a bid to, or does himself or herself

1211or by others construct, repair, alter,

1217remodel, add to, demolish, subtract from, or

1224improve any building or structure, including

1230related improvements to real estate, f or

1237others or for resale to others . . .

124622 . The attempted sale of construction contracting

1254services and the negotiation or bid for a contract on these

1265services also constitutes contracting. § 489.105(6), Fla . Stat.

12742 3 . Subsection 489.127(1)(i), Florida Statutes , states in

1283pertinent part:

1285. . . An occupational license certificate

1292issued under the authority of Chapter 2 0 5 is

1302not a license for purposes of this part.

131024 . Petitioner has proven by clear and convincing evidence

1320that Respondent violated S ubs e ction 489.127(1)(f), Florida

1329Statutes, by engaging in the business or acting in the capacity

1340of a contractor without being duly registered or certified.

1349Respondent engaged in unlicensed construction contracting when

1356she contracted to perform repair/remode ling work for

1364compen sation at the Mason's residence, even though she did not

1375perform the work herself.

137925 . Respondent is authorized to impose an administrative

1388fine in the amount of up to $10,000.00 , for any person guilty of

1402unlicensed construction contra cting. Respondent also has the

1410ability to assess reasonable investigative and legal costs for

1419prosecution of the violation against an unlicensed construction

1427contractor. § 489.13(3), Fl a. Stat .

1434RECOMMENDATION

1435Based on the foregoing F indings of F act and C onclusions of

1448L aw, it is

1452RECOMMENDED that a f inal o rder be rendered as follows:

14631 . Finding Respondent guilty of having violated S ubs ection

1474489.127(1)(f), Florida Statutes, as alleged in the

1481Administrative Complaint, and imposing as a penalty an

1489administra tive fine in the amount of $5,000.00.

14982 . Assessing costs of investigation and prosecution to

1507Respondent, excluding costs associated with an attorney's time,

1515in the amoun t of $762.43.
