44This cause came on to be heard before P. Michael Ruff,

55duly - designated Administrative Law Judge on January 29, 2007, in

96STATEMENT OF THE ISSUE

100The issue in this proceeding concerns a dispute as to

110whether the Petitione r successfully passed the State Officers

119Certification Examination , and specifically , a dispute involving

126the wording of certain examination questions.

132PRELIMINARY STATEMENT

134This cause arose upon notification to the Respondent Agency

143by the Petitione r , on August 31, 2006, that she was contesting a

156number of questions and the scoring on the Certified Corrections

166Officer State Examination. On August 14, 2006, the Petitioner

175had been notified by the Agency that her challenges or concerns

186regarding the S tate Officer Certification Examination had been

195reviewed and that no changes in credit or the overall results of

207her examination would be effected. The Petitioner consequently

215requested a hearing to contest that Agency initial decision.

224The case was, in d ue course transmitted to the Division of

236Administrative Hearings and the undersigned for proceeding.

243Th e case came on for hearing as noticed on January 29,

2552007. Upon convening the hearing the Petitioner failed to make

265an appearance. The Petitioner has t he burden of proof on the

277issues raised and referenced above. The Respondent entered its

286appearance in the person of Ms. Grace Jaye, Esquire, attorney

296for the Respondent. The Respondent was prepared with its

305evidence and witnesses to conduct the hearing.

312Upon waiting in excess of 40 minutes for the Petitioner to

323appear , and receiving comment on the record from persons in the

334hearing room , from the Respondent Agency , who had made a search

345for the Petitioner in the DeSoto Building ( the hearing site ),

357and in the immediate proximity of that building, it was apparent

368that the Petitioner was not present. Consequently, after

376waiting this extended period of time with no appearance by the

387Petitioner, and inasmuch as the Petition er was served with

397notice at her l ast - known address of record, Post Office Box

4101753, Lynn Haven, Florida 32444, it was determined that her case

421and burden of proof fail ed for lack of prosecution and the

433hearing was adjourned.

436CONCLUSIONS OF LAW

4391. The Division of Administrative Heari ngs has

447jurisdiction of the subject matter of and the parties to this

458proceeding. § § 120.569 and 120.57(1), Fla. Stat. (2006).

4672. The Petitioner contesting her score on the above -

477referenced examination bears the burden of proving that the

486credit al lowed and the scoring or scoring method for the grading

498on the examination , and the contested portions of the

507examination , was erroneous . The Petitioner , did not, however ,

516appear in this proceeding and thus presented no evidence in

526support of her position in this controversy. T he Petitioner was

537served with notice at the last - known address of record . Because

550she did not appear and because there has been no communication

561from the Petitioner to indicate that any difficulty in attending

571the noticed hearing h ad arisen, it must be concluded that the

583Petitioner's case and burden of proof fails for lack of

593prosecution. Consequently, it is determined that this case

601should be dismissed for lack of prosecution and for lack of

612evidence to support the Petitioner's Pe tition and her

621contentions regarding the scoring of her examination.

628RECOMMENDATION

629Having considered the foregoing Findings of Fact and

637Conclusions of Law, it is

642RECOMMENDED: That a final order be entered by the Florida

652Department of Law Enforcement, Cri minal Justice Standards and

661Training Commission, dismissing the Petition filed herein in its

670entirety for lack of prosecution and lack of evidence in support

681thereof.
