112STATEMENT OF THE ISSUE

116The issue is whether Respondent should deny Petitioner's

124renewal application to operate a register ed family day care home

135on the grounds that her failure to properly supervise children

145at her registered family day care home demonstrates Petitioner's

154inability to ensure the safety of children under Petitioner's

163care.

164PRELIMINARY STATEMENT

166By letter dated July 26, 2006, Respondent notified

174Petitioner that Respondent intended to deny Petitioner's renewal

182application for a registered family day care home on the grounds

193that Petitioner failed to properly supervise children at her

202registered family day c are home, resulting in one child biting

213another so severely that the bitten child required emergency room

223treatment. Petitioner timely requested an administrative

229hearing.

230At the hearing, Petitioner testified on her own behalf and

240submitted no exhib its for admission into evidence.

248Respondent presented the testimony of Victor Kruppenbacher,

255the Department of Children and Family Services employee who

264conducted the investigation into the biting incident, and of

273Ivette Garcia, the Department's child c are licensing supervisor

282for the district encompassing Orlando. Respondent's Exhibits A

290through E were admitted into evidence. Respondent's Exhibit D

299was a composite exhibit consisting of 17 emergency room

308photographs of A.H., the biting victim. Respond ent's Exhibits A

318through D were received pursuant to the exemption set forth in

329Section 39.202(2)(j), Florida Statutes (2006), but have been

337admitted under seal to protect the rights of the children

347involved.

348Neither party requested a transcript of the he aring record.

358Neither party filed a Proposed Recommended Order.

365FINDINGS OF FACT

3681. Respondent is the state agency responsible for

376registering family day care homes in Florida. Petitioner

384operated a registered family day care in her home for at least

396one year prior to her May 5, 2006, renewal application to

407operate a registered family day care home. Respondent proposes

416to deny that application.

4202. By letter dated July 27, 2006, Respondent notified

429Petitioner that Respondent proposed to deny Petitioner's

436application to operate a registered family day care home (the

"446Notice of Denial"). The Notice of Denial provides that on

457April 7, 2006, Petitioner failed to properly supervise children

466at her registered family day care home, in violation of S ection

478402.301 et seq ., Florida Statutes (2005). The Notice of Denial

489states that, as a result of Petitioner's failure to properly

499supervise the children, one child bit another more than one

509time, and the child who was bitten had to be taken to the

522emerge ncy room, which led to investigations by both the police

533and Respondent's protective investigation unit.

5383. Respondent's protective investigation unit closed the

545case on June 5, 2006, with verified findings of neglect for the

557inadequate supervision that l ed to the injuries of the child who

569was bitten.

5714. The undisputed facts were that, on April 7, 2006,

581Petitioner was caring for at least two children at her

591registered family day care home. A.H. was an 11 - month - old male

605who had just begun staying at Petit ioner's home. Petitioner did

616not have a crib in the home. At the suggestion and with the

629consent of A.H.'s mother, A.H. was strapped into his car seat

640for his nap. The car seat was placed on the floor of a bedroom

654in Petitioner's house. The second chil d, identified at the

664hearing only as E., was an 18 - month - old male. E. was placed in

680a playpen for his nap, in the same bedroom as A.H. Petitioner

692knew that E. was capable of climbing out of the playpen. The

704bedroom door was closed while the children nap ped.

7135. While the children were sleeping, a female neighbor

722knocked at Petitioner's door and asked to use her telephone.

732The two women stood talking in the doorway for at least five

744minutes. The neighbor heard screams coming from the bedroom,

753and asked Petitioner if she shouldn't check on the situation.

763Both women walked into the bedroom and saw E. standing over the

775crying A.H., who was still strapped into his car seat.

785Petitioner called out to E. to stop biting A.H.

7946. Petitioner applied ice to A.H .'s swollen left eye. She

805testified that she attempted to phone A.H.'s mother, but could

815not reach her. When A.H.'s mother picked him up from

825Petitioner's home, she called the police and took the child to

836the emergency room at the Orlando Regional Medica l Center.

846A.H.'s left eye was swollen. There were scratches and small

856bite marks on the left side of his face and his left arm. All

870of his injuries were consistent with his having been bitten and

881scratched by E. There was no indication that A.H. had be en

893abused by an adult.

8977. Victor Kruppenbacher, Respondent's investigator,

902testified that his investigation revealed that Petitioner had

910been arrested for assault and battery in the 1980s, and that two

922prior abuse reports had been lodged against her.

930Mr. Kruppenbacher further testified that Petitioner lied to him

939about both the arrest and the abuse reports.

9478. Petitioner testified that she had already had problems

956with E.’s climbing out of the playpen, and that it was against

968her better judgment to plac e A.H. in the car seat for a nap.

982Petitioner nonetheless placed both children in the same room,

991behind a closed door, and did not herself notice A.H. crying

1002until her neighbor pointed it out to her.

10109. Respondent should not grant Petitioner's applicatio n to

1019operate a registered family day care home. Petitioner failed to

1029establish that she is able to ensure the safety of children to

1041the level necessary to operate a registered family day care

1051home.

1052CONCLUSIONS OF LAW

105510. DOAH has jurisdiction over t he parties and subject

1065matter of this case. §§ 120.569 and 120.57(1), Fla. Stat.

1075(2006). The parties received adequate notice of the

1083administrative hearing.

108511. Petitioner has the burden of proof in this proceeding.

1095Petitioner must show by a prepondera nce of the evidence that she

1107is able to ensure the safety of children to the level necessary

1119to operate a registered family day care home. Department of

1129Banking and Finance v. Osborne Stern and Co. , 670 So. 2d 932

1141(Fla. 1996); Florida Department of Transp ortation v. J.W.C.

1150Company, Inc. , 396 So. 2d 778 (Fla. 1st DCA 1981); Balino v.

1162Department of Health and Rehabilitative Services , 348 So. 2d 349

1172(Fla. 1st DCA 1977).

117612. Petitioner failed to satisfy her burden of proof to

1186establish that she is able to e nsure the safety of children in

1199her care to the level necessary to operate a registered day care

1211home.

1212RECOMMENDATION

1213Based upon the foregoing Findings of Fact and Conclusion of

1223Law, it is

1226RECOMMENDED that Respondent enter a Final Order denying

1234Pet itioner's renewal application to operate a registered family

1243day care home.
