106STATEMENT OF THE ISSUE

110The issue in the case is whether the application filed by

121Jerika Casado ( Petitioner ) for licensure to operate a Registered

132Family Day Care Home should be approved .

140PRELIMINARY STATEMENT

142On May 22, 2006, the Petitioner filed an application for

152licensure to operate a Registered Family Day Care Home. By

162certified letter , dated August 17, 2006 , the Department of

171Children and Family Services (Respondent) denied the

178application. The Petitioner f iled a request for formal hearing

188with the Respondent . The Respondent forwarded the request to

198the Divis ion of Administrative Hearings, which scheduled and

207conducted the proceeding.

210At the hearing, the Petitioner testified on her own behalf

220and had one exhibit admitted into evidence . The Respondent

230presented the testimony of one witness and had E xhibits

240numbered 1 through 9 admitted into evidence.

247No transcript of the hearing was filed. Neither party

256filed a p roposed r ecommended o rder .

265FINDINGS OF FACT

2681. On May 22, 2006, t he Petitioner filed an application

279for licensure to operate a Registered Family Day Care Home.

2892. The Respondent reviewed the application and conducted a

298background screening as required by statute.

3043. By certified letter , dated August 17, 2006, the

313Respondent denied the Petitioner's application. As identified

320in the letter, the grounds for the denial were as follows:

331District Screening Coordinator has notified

336us that you have been disqualified from

343working as a caretaker for children.

3494. The letter provided no further information specifying

357the reason for the disqualification.

3625. At the hearing, the Respondent's witness testified that

371an incident of felony theft by shoplifting was the disqualifying

381offense.

3826. Durin g the screening process, the Respondent obtained

391criminal records stating that the Petitioner had been arrested

400on April 17, 2003, and charged with a battery in Seminole

411County, Florida. The records also stated that the Respondent

420had been arrested on Nov ember 26, 2004 and charged with a third -

434degree count of felony grand theft in Orange County, Florida.

4447. The Petitioner was born on August 18, 1987. Petitioner

454was 15 years old at the time of the battery and 17 years old at

469the time of the theft.

4748. The Petitioner completed a pre - trial diversionary

483program and the battery charge was not prosecuted.

4919. According to the police report, which the Petitioner

500did not dispute at the hearing, the grand theft arrest was for

512shoplifting. The total retail v alue of the items shoplifted was

523$360.86, which constituted a third - degree felony pursuant to

533Subsection 812.014(2)(c)1., Florida Statutes.

53710. On June 6, 2005, the Petitioner was placed on

547probation for a period of six months for the theft, and

558superv isory responsibility was assigned to her mother, with whom

568the Petitioner resided.

57111. There is no evidence that the Petitioner did not

581comply with the terms of her probation.

588CONCLUSIONS OF LAW

59112. The Division of Administrative Hearings has

598jurisdi ction over the parties to and subject matter of this

609proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2006).

61713. Persons seeking licensure to operate a Registered

625Family Day Care Home, and persons working therein, are subject

635to applicable background s creening provisions. See

642§§ 402.313(1)(a)5. and 402.313(3), Fla. Stat . (2006).

65014. Subsection 402.305(2)(a), Florida Statutes (2006),

656states that minimum standards for child care personnel include

"665good moral character based upon screening" and directs that the

675screening be conducted according to "level 2 standards" as

684provided in Chapter 435, Florida Statutes.

69015. Section 435.04, Florida Statutes (2006), provides in

698relevant part as follows:

702(1) All employees in positions designated

708by law as posit ions of trust or

716responsibility shall be required to undergo

722security background investigations as a

727condition of employment and continued

732employment. For the purposes of this

738subsection, security background

741investigations shall include, but not be

747limite d to, fingerprinting for all purposes

754and checks in this subsection, statewide

760criminal and juvenile records checks through

766the Florida Department of Law Enforcement,

772and federal criminal records checks through

778the Federal Bureau of Investigation, and may

785include local criminal records checks

790through local law enforcement

794(2) The security background investigations

799under this section must ensure that no

806persons subject to the provisions of this

813section have been found guilty of,

819regardless of adjudication , or entered a

825plea of nolo contendere or guilty to, any

833offense prohibited under any of the

839following provisions of the Florida Statutes

845or under any similar statute of another

852jurisdiction:

853* * *

856( y) Chapter 812, relating to theft,

863robbery, and r elated crimes, if the offense

871is a felony.

87416. The Petitioner's shoplifting incident is a third -

883degree felony as defined at Subsection 812.014(2)(c)1., Florida

891Statutes (2006), and demonstrates a lack of good moral character

901pursuant to Subsection 402.30 5(2)(a), Florida Statutes. The

909evidence requires, absent any other mitigating information, that

917the pending application be denied.

92217. The Petitioner has not sought an exemption from the

932disqualification. Section 435.07, Florida Statutes (2006),

938provi des that an exemption from disqualification may be

947available u nder certain circumstances, and the Petitioner was so

957advised during the hearing.

961RECOMMENDATION

962Based on the foregoing Findings of Fact and Conclusions of

972Law, it is

975RECOMMENDED that the Petit ioner's application for licensure

983to operate a Registered Family Day Care Home be denied .
