86This cause came on for consideration upon Respondent NICA's

133FINDINGS OF FACT

1361. By an Order on Compensability and Notice entered May 4,

1472007, and an Order Correcting Scrivener Error entered May 8,

1572007, the ALJ determined that Petitioners ' claim against NICA

167was compensable and that appropriat e notice , pursuant to section

177766.316, Florida Statutes, had not been given by Wellington

186Regional Medical Center. On October 10, 2008, the ALJ's May 4,

1972007/ May 8, 2007, Order was per curiam affirmed by the First

209District Court of Appeal. On June 4, 200 9, the parties filed a

222fully - executed Stipulation for Entry of Award, and agreed, among

233other things, that

239. . . it is acknowledged that the

247Petitioners may pursue a State Court medical

254malpractice action against Wellington

258Regional Medical Center , Inc. . . . At such

267time as it is appropriate, the Petitioners

274may make an Election of Remedies, if

281required by law, which Petitioners dispute,

287within the State Court proceeding as to

294whether to accept payment of benefits under

301this Award, or recovery un der the State

3642. A Final Order Approving Stipulation for Entry of Award

374was entered on June 4, 200 9 .

3823. On November 29, 2011, Respondent NICA served and filed

392its Motion. By its M otion and the documentati on attached to the

405M otion , NICA demonstrated that Petitioners obtained state

413circuit court approval of a civil settlement with Wellington

422Medical Center, Inc., and alleg ed that , as a result of that

434state court settlement, Petitioners are barred from recove ry

443under the NICA Plan.

4474. Petitioners did not file a response to NICA's M otion,

458so in an abundance of caution, on December 19, 2011, an Order to

471Show Cause was entered , which provided , in part :

533Respondent NICA, by its foregoing

538pleading and attached exhibits, has

543established a prima facie case that

549Petitioners Janell Coble and David Coble,

555individually and on behalf of Jory Coble, a

563minor, (Petitioners and claimants before

568DOAH), have recovered some amount of money,

575either by settlement or final judgment, in a

583civil action arising from the labor,

589delivery, or immediate post - delivery

595resuscitation of Jory Coble in a hospital.

605Inasmuch as section 766.304, Florida

610Statutes, is clear that, " . . . An award

619may not be made or paid under ss. 766.301 -

629766.316 if the claimant recovers under a

636settlement or final judgment is entered in a

644civil action. . . ." RespondentÓs pending

651motion, seeking an order determining that

657NICA is not required to pay an award in this

667case appears well - taken.

672However, in an abundance of caution,

678Petitioners and Intervenors are granted to

684and until January 3, 2012, to show cause why

693the relief sought by Respondent should not

700be granted.

702Failure of all parties to timely show

709good cause will result in a final order

717finding that Petitioners have, in effect,

723already made an election against receiving

729NICA benefits by accepting a settlement from

736other entities (Wellington Regional Medical

741Center, Inc., a n Intervenor herein) and

748providing that, pursuant to section 766.304,

754NICA owes nothing to Petitioners, and shall

761pay nothing to Petitioners, as the result of

769the Final Order on Compensability and Notice

776entered May 4, 2007, as amended by that

784certain Orde r Correcting Scrivener Error

790entered May 8, 2007, which Order was

797subsequently per curiam affirmed by the

803First District Court of Appeal.

8085. No party has shown any ca use why the requested final

820order should not be entered , nor has any party shown reason to

832doubt NICA's allegation, with supporting documentation, that

839Petitioners have recovered some amount of money from a civil

849action arising from the labor, delivery, or resuscitation in the

859immediate postdelivery period associated with Jory Coble 's

867birth .

8696. Accordingly, it is determined that Petitioners have

877recovered an amount of money, either by settlement or final

887judgment in Janell Coble and David Coble, as Natural Parents and

898Guardians of Jory Coble, a Minor, Individually v. Wellington

907Regional Medic al Center, Inc. , Case No. 2006 CA 0003239AG , in

918the Circuit Court of the Fifteenth Judicial Circuit In and For

929Palm Beach County, Florida , from or against Wellington Medical

938Center, Inc., the hospital wherein Jory was born and an

948Intervenor herein .

9517. Pet itioners made a de facto election against receiving

961the NICA benefits provided - for in the Final Order entered on

973May 4, 2007, as amended by the Order Correcting Scrivener Error

984entered May 8, 2007, which was per curiam affirmed on appeal .

996CONCLUSIONS OF LA W

10008 . The Division of Administrative Hearings has

1008jurisdiction over the parties to, and the subject matter of,

1018these proceedings. §§ 766.301 - 766.316, Fla. Stat.

10269 . Section 766.304, Florida Statutes, in effect at the

1036time of Jory Coble's birth on Februar y 18, 2004, and at all

1049times thereafter to date, has provided, in pertinent part:

1058. . . An award may not be made or paid

1069under §§ 766.301 - 766.316 if the claimant

1077recovers under a settlement or a final

1084judgment is entered in a civil action. . . .

109410 . Peti tioners, having recovered in a circuit court

1104medical malpractice action against Intervenor Wellington

1110Regional Medical Center, are precluded from recovery of an award

1120against NICA .

112311. The d etermination of exclusivity and immunity are

1132reserved to the ci rcuit court. S ee Gugelmin v. Fla. Birth -

1145Related Neurological Injury Comp. Ass'n , 882 So. 2d 517 (Fla.

11554th DCA 2004); Romine v. Fla. Birth - Related Neurological Injury

1166Comp. Ass'n , 842 So. 2d 148 (Fla. 5th DCA 2003). The parties'

1178Stipulation for Entry of A n Award herein contemplated

1187Petitioners applying to the circuit court to address the

1196election issue. However, to date, no circuit court has made

1206this determination.

12081 2 . Petitioners were given an opportunity to show cause

1219why the relief now sought by NI CA should not be granted in this

1233forum , and Petitioners having failed to show cause why

1242Respondent's requested relief should not be granted in this

1251forum , the relief sought is granted.

1257CONCLUSION

1258Upon the foregoing Findings of Fact and Conclusions of Law,

1268it is ORDERED:

12711. Petitioners have made a de facto election against

1280receiving NICA benefits pursuant to sections 766.301 - 766.316,

1289Florida Statutes.

12912. NICA owes nothing and shall pay nothing to Petitioners

1301as a result of th e Final Order entered herein on May 4, 2007, as

1316amended by the Order Correcting Scrivener Error entered May 8,

13262007.

13273. This cause is dismissed with prejudice.
