102STATEMENT OF THE ISSUES
106The primary issue for determination in this case is whether
116Respondent, Bruce P. Boston, engaged in the unlicensed practice
125of electrical contracting in the State of Florida withou t being
136certified or registered in violation of Chapter 489, Part II of
147the Florida Statutes; and secondarily, if Respondent committed
155that violation, what penalty should be imposed?
162PRELIMINARY STATEMENT
164On June 7, 2006, Petitioner issued an Adminis trative
173Complaint alleging that Respondent engaged in the practice of
182contracting without being duly registered or certified to engage
191in that activity.
194Respondent disputed the allegations in the Administrative
201Complaint and requested a formal administrati ve hearing. The
210case was referred to the Division of Administrative Hearings on
220or about October 10, 2006. A formal hearing was set for
231January 9, 2007, in Gainesville, Florida.
237At hearing, Petitioner presented testimony of two witnesses
245and three exhi bits, which were admitted into evidence.
254Respondent did not appear and no appearance was made on his
265behalf.
266A one - volume transcript of the final hearing was filed on
278January 29, 2007. Petitioner filed a Proposed Recommended
286Order, which has been cons idered in the preparation of this
297Recommended Order.
299FINDINGS OF FACT
3021. The Department of Business and Professional Regulation
310(Petitioner) is a state agency charged with the duty and
320responsibility of regulating the practice of electr ical
328contracting in the State of Florida.
3342. Respondent's address is 18204 S outhwest 200 Street,
343Archer, Florida 32618.
3463. At no time material hereto was Respondent certified or
356registered in the State of Florida to engage in the practice of
368el ectrical contracting or to perform electrical contracting
376work .
3784. Mrs. Dawn Wingert is the owner of the residence located
389at what is currently designated as 16675 Southwest 143 rd Avenue,
400Archer, Florida. Mrs. Wingert, as lawful owner, had the
409autho rity to enter contracts regarding the residence. The
418Wingert residence was previously known as 110 Park Avenue,
427Archer, Florida, prior to the assignment of the current address.
4375. Wingert entered into a contract with Respondent to
446perform constr uction of a carport and perform electrical
455contracting work at Wingerts residence subsequent to assignment
463of the address of 110 Park Avenue, Archer, Florida.
4726. Respondent received compensation for the contracted
479work directly from Wingert via pe rsonal check, which Respondent
489then cashed.
4917. Terry Vargas, a licensed electrical contractor having
499been issued license number ER 13012448, was subsequently
507contacted by Respondent to perform the electrical contracting
515work at the Wingert residenc e.
5218. Vargas installed an electrical outlet on the back
530porch, put a flood light on the back porch, moved the switch
542board to a more convenient location, and put a security light in
554the front of Wingerts residence. All work required electrical
563fixt ures to be permanently affixed and become a permanent part
574of the structure of the Wingert residence.
5819. Although Vargas completed the electrical contracting
588work at the Wingert residence, Wingert paid the Respondent for
598the services because the work was contracted for through
607Respondent.
60810. At no time pertinent to this matter did Terry Vargas
619contract with Wingert to complete the electrical services
627enumerated above.
62911. After he completed the work at Wingerts residence ,
638Vargas invoic ed Respondent for the electrical contracting work.
647Respondent, however, refused to pay Vargas for the electrical
656contracting work performed, despite having received compensation
663for the work from Wingert.
668CONCLUSIONS OF LAW
67112. The Division of Admi nistrative Hearings has
679jurisdiction over the parties and subject matter in this case.
68913. Pursuant to Section 489.531(1)(a), Florida Statutes, a
697person may not practice contracting unless the person is
706certified or registered. Additionally, such action may subject
714one to criminal sanctions. § 489.531(3)(a), Fla. Stat.
72214. Section 489.505(9), Florida Statutes, states that:
729 [c]ontracting means, except where exempted
736in this part, engaging in business as a
744contractor or performing electrica l or alarm
751work for compensation and includes, but is
758not limited to, performance of any of the
766acts found in subsections (2) and (12),
773which define the services which a contractor
780is allowed to perform. The attempted sale
787of contracting services and the negotiation
793or bid for a contract on these services also
802constitutes contracting. If the services
807offered require licensure or agent
812qualification, the offering, negotiation for
817a bid, or attempted sale of these services
825requires corresponding licensure.
82815. Section 489.531(3), Florida Statutes, further states
835that the remedies set forth in this subsection are not exclusive
846and may be imposed in addition to the remedies set forth in
858Section 489.533(2).
86016. Section 489.533(2), Florida Statu tes, provides that
868when any applicant, contractor, or business organization is
876found guilty of any of the violations set forth above, a final
888order may be entered imposing one or more of the following
899penaltie s :
902( a) Denial of an application for
909certificat ion or registration.
913(b) Revocation or suspension of a
919certificate or registration.
922( c) Imposition of an administrative fine
929not to exceed $10,000 for each count or
938separate offense.
940(d) Issuance of a reprimand.
945(e) Placement of the contracto r on
952probation for a period of time and subject
960to such conditions as the board may specify,
968including requiring the contractor to attend
974continuing education courses or to work
980under the supervision of another contractor.
986(f) Restriction of the auth orized scope of
994practice by the contractor.
998(g) Require financial restitution to a
1004consumer.
100517. Petitioner has the burden of proving by clear and
1015convincing evidence the allegations against Respondent.
1021Department of Banking and Finance, Divis ion of Securities and
1031Investor Protection v. Osborne Stern and Company , 670 So. 2d 932
1042(Fla. 1996). Evans Packing , supra , 550 So. 2d 112, 116, fn. 5,
1054provides the following, pertinent to the clear and convincing
1063evidence standard:
1065That standard has been d escribed as follows:
1073[C]lear and convincing evidence requires
1078that the evidence must be found to be
1086credible; the facts to which the witnesses
1093testify must be distinctly remembered; the
1099evidence must be precise and explicit and
1106the witnesses must be lackin g in confusion
1114as to the facts in issue. The evidence must
1123be of such weight that it produces in the
1132mind of the trier of fact the firm belief of
1142[ sic ] conviction, without hesitancy, as to
1150the truth of the allegations sought to be
1158established. Slomowitz v . Walker , 429 So. 2d
1166797, 800 (Fla. 4th DCA 1983).
117218. In addition, the disciplinary action may only be based
1182upon the offenses specifically alleged in the Administrative
1190Complaint. See Sternberg v. Department of Professional
1197Regulation, Board of Medical Examiners , 465 So.2d 1324, 1325
1206(Fla. 1st DCA 1985); Kinney v. Department of State , 501 So. 2d
1218129, 133 (Fla. 5th DCA 1987); Hunter v. Department of
1228Professional Regulation , 458 So. 2d 842, 844 (Fla. 2d DCA 1984).
123919. Petitioner alleged with specificity allegations
1245constituting the uncertified or unregistered practice of
1252electrical contracting by Respondent Bruce P. Boston.
125920. Petitioner proved by clear and convincing evidence
1267that Respondent violated Section 489.531(1)(a), by perform ing
1275electrical contracting at Mrs. Wingerts residence without
1282certification or registration to practice electrical contracting
1289in the State of Florida.
1294RECOMMENDATION
1295Based upon the foregoing Findings of Fact and Conclusions
1304of Law set forth herein, it i s
1312RECOMMENDED that Petitioner enter a final order, in
1320accordance with Section 489.533(2)(c), Florida Statutes,
1326requiring that Respondent pay an administrative fine in the
1335amount of $5,000.00 to the Department of Business and
1345Professional Regulation.
