117STATEMENT OF THE ISSUES
121The issues in this case are whether Respondent violated
130Subsection 458.331(1)(t), Florida Statutes (2004) , 1 and, if so,
139what discipline should be i mposed.
145PRELIMINARY STATEMENT
147On May 15, 2006, Petitioner, Department of Health, Board of
157Medicine (Department), filed an Administrative Complaint against
164Respondent, Ramesh i bhai P. Patel, M.D. (Dr. Patel), alleging
174that Dr. Patel violated Subsection 458.3 31(1)(t), Florida
182Statutes. Dr. Patel requested an administrative hearing, and
190the case was forwarded to the Division of Administrative
199Hearings on October 12, 2006, for assignment of an
208Administrative Law Judge.
211The final hearing was originally scheduled for December 15,
2202006. On November 30, 2006, Respondent filed Respondent's
228Unopposed Motion for Continuance, which was granted by O rder
238dated December 11, 2006. The final hearing was rescheduled for
248January 10, 2007.
251On December 6, 2006, Petitioner file d Petitioner's Motion
260for Official Recognition, requesting official recognition of
267Subsection 458.331(1)(t), Florida Statutes, and Florida
273Administrative Code Rule 64B8 - 8.001, which motion was granted by
284O rder dated December 13, 2006.
290On December 27, 2006, Petitioner filed Petitioner's Motion
298for Leave to Amend Administrative Complaint. The motion was
307granted by O rder dated January 4, 2007 , and the Amended
318Administrative Complaint was deemed filed on January 4, 2007.
327On January 2, 2007, the parties filed a Joint Pre - Hearing
339Stipulation, in which the parties agreed to certain facts
348contained in Section E of the Joint Pre - Hearing Stipulation. To
360the extent relevant those agreed facts are incorporated into
369this Recommended Order.
372At the final hearing, the De partment called S.A. and
382Armand H. Katz, M.D. as its witnesses. Petitioner's Exhibits 1
392through 6 were admitted in evidence. Dr. Patel testified on his
403own behalf and called Edward Meadors Copeland III, M.D. as his
414witness. Respondent Exhibits 1 throug h 4 were admitted in
424evidence.
425The one - volume Transcript of the final hearing was filed on
437January 29, 2007. The parties timely filed their Proposed
446Recommended Orders , which have been considered in rendering this
455Recommended Order.
457FINDINGS OF FACT
4601. T he Department is the state agency charged with
470regulating the practice of medicine pursuant to Section 20.43
479and Chapters 456 and 458, Florida Statutes.
4862. Dr. Patel is a licensed physician within the state of
497Florida, having been issued license number 54 617. He has been
508board certified in general surgery since 1990 and has been
518practicing medicine in Florida since 1989.
5243. For the past 20 years, S.A. has had yearly
534gynecological examinations and mammograms. In 1994, a mammogram
542revealed a lump in her l eft breast. She was referred to a
555specialist, who removed the lump. The biopsy revealed that the
565lump was a fibroadenoma, which is a common, benign tumor of the
577female breast with unknown etiology.
5824. In 2004, S.A. found a lump in her right breast durin g a
596self - examination. She consulted her gynecologist, Dr. Hae Soo
606Lim, who had been prescribing Clomid for S.A. Dr. Lim advised
617S.A. that the Clomid could be causing the lump. S.A.
627discontinued taking Clomid, but the lump did not dissipate. In
637August 2 004, Dr. Lim ordered a mammogram for S.A.
6475. The mammogram did not reveal an abnormality in the
657right breast. Because a lump could be felt on examination, S.A.
668was advised to have a supplemental bilateral breast sonography.
677A sonogram was performed on t he same date as the mammogram and
690revealed the following as it related to the right breast:
700In the area of palpable abnormality, there
707is a solid hyperechoic nodule that has a
715central cleft. It is more ethogenic than
722the adjacent breast parenchyma and cou ld
729therefore represent a focal fatty deposit or
736area of breast tissue fibrosis. This
742measures approximately 1.5 cm x 1.2 cm.
749This is 5 mm beneath the skin surface and is
759readily palpable. This is 5 cm away from
767the nipple in the 12 o'clock position.
774Us ing color flow Doppler imaging, no
781vascular flow is demonstrated within the
787lesion. This would further support probable
793benign etiology. This does not have the
800appearance of a complicated cyst or of a
808typical fibroadenoma or malignancy.
812CONCLUSION: Hyp erechoic nodule accounting
817for palpable abnormality. This is not seen
824mammographically. This has indeterminate
828characteristics and most likely represents a
834focal fatty deposit and/or area of breast
841tissue fibrosis. A biopsy or excision would
848be needed t o establish pathology. It is
856noted that the patient states that this
863fluctuates in size during the course of her
871period.
8726. Dr. J.M. Swalchick, who prepared the report of the
882sonogram findings, recommended a surgical consultation for the
890palpable abnorm ality in the right breast. Dr. Swalchick noted
900in his report that he discussed his findings with S.A. at the
912time of the performance of the sonogram. His discussion was
922limited to telling S.A. that she should follow up with a
933surgical consultation and th at he would send the report to
944Dr. Lim.
9467. On or about August 12, 2005, S.A. presented to
956Dr. Patel for a surgical consultation and evaluation of the
966mammogram and breast ultrasound reports upon referral from
974Dr. Lim. Dr. Patel reviewed the mammogram, ultrasound, and the
984a ccompanying radiology reports.
9888. In his office notes, which were dictated within 24
998hours of S.A.'s visit, Dr. Patel made the following findings
1008during his examination of S.A.'s right breast:
1015Patient has a small palpable nodule in t he
1024right breast at 12:00 to 11:00 position and
1032appears to be right under the skin. Appears
1040to be more likely a simple fibroadenoma
1047without any skin dimpling or any nipple or
1055skin retraction. Patient did not have any
1062axillary adenopathy.
10649. Dr. Patel ma de the following notation of S.A.'s
1074August 12, 2004, office visit:
1079Patient was explained regarding her
1084mammogram, regarding her ultrasound exam and
1090also regarding various breast problems with
1096the help of the booklet on the breast
1104disorders and was advised that what appears
1111to be a palpable nodule seen on the
1119ultrasound is a fibroadenoma and she can be
1127followed clinically and will advise her to
1134be seen again in six months in follow up.
1143Patient explained that if she wants this to
1151be removed, it can be remov ed either in the
1161office or in outpatient surgery and the
1168patient is agreeable to have simple follow
1175up done and will be seen again in six
1184months.
118510. Dr. Patel does not have a specific recollection of
1195S.A.'s office visit on August 12, 2004, other than wh at he wrote
1208in the patient's chart. Dr. Patel's office notes comport with
1218S.A.'s testimony that he told her that she had a fibroadenoma.
1229He did not tell S.A. that the lump was indeterminate. Based on
1241Dr. Patel's representation that the lump was a fibroa denoma,
1251S.A. elected to wait and return to Dr. Patel in six months for a
1265follow - up visit.
126911. There is conflict between S.A.'s testimony and
1277Dr. Patel's office notes concerning whether he explained the
1286mammogram and ultrasound to her and whether he showe d her a
1298booklet on breast disorders. I credit Dr. Patel's office notes
1308in that he did discuss the mammogram and ultrasound tests with
1319S.A. and that he did go over a booklet with S.A. on various
1332breast disorders. Additionally, I credit Dr. Patel's notes t hat
1342he told her that he could re move the nodule in his office if she
1357desired. However, I credit S.A. 's testimony that Dr. Patel told
1368her that she had a benign fibroadenoma and had nothing to worry
1380about. Had Dr. Patel told her that the lump was indetermi nate,
1392S.A. could have made an informed decision concerning the removal
1402of the mass versus waiting six months to see what would happen.
141411. On February 22, 2005, S.A. returned to Dr. Patel's
1424office for a follow - up visit. The lump was still present.
1436Based on Dr. Patel's office notes, he was still under the
1447impression that the lump was a benign fibroadenoma. He told her
1458that he would remove the lump in his office under local
1469anesthesia. Another office visit was scheduled to remove the
1478lump.
147912. On or ab out March 8, 2005, Dr. Patel excised the
1491breast mass in his office using local anesthesia. A biopsy of
1502the excised tissue revealed that S.A. had an infiltrating ducal
1512carcinoma (breast cancer).
151513. On or about March 14, 2005, Dr. Patel performed a
1526right partial mastectomy on S.A.
153114. Dr. Armand H. Katz testified as an expert for the
1542Department. Dr. Katz's testimony is credited that the standard
1551of care required that Dr. Patel tell S.A. that the lump was
1563indeterminate and could be cancerous.
1568CONCLUSIONS OF LAW
157115. The Division of Administrative Hearings has
1578jurisdiction over the parties to and the subject matter of this
1589proceeding. §§ 120.569 and 120.57, Fla. Stat. (2006).
159716. The Department bears the burden to establish the
1606allegations in the Amended Administrative Complaint by clear and
1615convincing evidence. Department of Banking and Finance v.
1623Osborne Stern and Company , 670 So. 2d 932 (Fla. 1996). In the
1635Amended Administrative Complaint, the Department alleges that
1642Dr. Patel violated Subsection 458. 331(1)(t), Florida Statutes,
1650which provides:
1652(1) The following acts constitute grounds
1658for denial or a license or disciplinary
1665action, as specified in s. 456.072(2):
1671* * *
1674(t) Gross or repeated malpractice or the
1681failure to practice medicine wi th that level
1689of care, skill, and treatment which is
1696recognized by a reasonably prudent similar
1702physician as being acceptable under similar
1708conditions and circumstances. . . . As used
1716in this paragraph, "gross malpractice" or
"1722the failure to practice medi cine with that
1730level of care, skill, and treatment which is
1738recognized by a reasonably prudent similar
1744physician as being acceptable under similar
1750conditions and circumstances," shall not be
1756construed so as to require more than one
1764instance, event, or act. Nothing in this
1771paragraph shall be construed to require that
1778a physician be incompetent to practice
1784medicine in order to be disciplined pursuant
1791to this paragraph. . . .
179717. The Department further alleges that Dr. Patel violated
1806Subsection 458.331(1)(t ), Florida Statutes, by the following
1814acts:
1815A . By failing to inform/explain to Patient
1823S.A. that the palpable mass/lesion on her
1830right breast's [sic] nature was
1835indeterminate;
1836B . By failing to adequately inform Patient
1844S.A. that the palpable mass/lesion on her
1851right breast was not a fibroadenoma, but an
1859indeterminate lesion.
186117. The Department has established by clear and convincing
1870evidence that Dr. Patel violated 458.331(1)(t), Florida
1877Statutes , by failing to tell S.A. that the lump in her breast
1889was indeterminate. He told her that the lump was a benign
1900fibroadenoma. Dr. Patel should have informed S.A. that the lump
1910was indeterminate and could be cancerous. Dr. Patel failed to
1920practice medicine with that level of skill, care, and treatment
1930which is recognized by a reasonably prudent similar physician as
1940being acceptable under similar conditions and circumstances.
194718. Florida Administrative Code Rule 64B8 - 8.001(2)(t)
1955provides that the range of penalties for a violation of
1965Subsection 458.331(1)(t), F lorida Statutes, is from two year's
1974probation to revocation and an administrative fine from $1,000
1984to $10,000.
1987RECOMMENDATION
1988Based on the foregoing Findings of Fact and Conclusions of
1998Law, it is
2001RECOMMENDED that :
2004A Final Order be entered finding that Dr. Ramesh i bhai P.
2016Patel violated Subsection 458.331(1)(t), Florida Statutes;
2022placing him on probation for one year with indirect supervision,
2032with the terms to be set by the Board of Medicine; requiring
2044completion of five hours of continuing medical education in risk
2054management; and imposing an administrative fine of $1,000.
