94Petitioner, Crum Resources, opposed the motion and filed a
103response, to which Intervenor replied. A hearing was held on
113the Motion on January 17, 2007. P etitioner's Motions to
123Continue and to Abate were also considered. Respondent and
132Intervenor requested and received the right to file a written
142response to Petitioner's Motions, which was filed on January 18,
1522007. The undersigned has considered the vari ous motions, the
162responses thereto, and the oral arguments of the parties, and it
173is
174FOUND AND DETERMINED:
1771. This case arose by the filing of a Petition for
188reimbursement dispute resolution by Intervenor, West Florida
195Regional Medical Center, Inc. d/b/a West Florida Hospital (West
204Florida), on March 30, 2006, pursuant to Subsection
212440.13(7)(a), Florida Statutes (2006). 1 The Agency dismissed the
221petition without prejudice, and West Florida re - filed its
231Petition with a detailed bill attached.
2372. The Agen cy issued a Determination on the reimbursement
247request on August 30, 2006. The Agency determined that the
257Petition was properly served on the carrier (Crum Services,
266Inc.), pursuant to Subsection 440.13(7)(a), Florida Statutes,
273and that Petitioner's insur ance carrier did not respond to the
284Petition within ten days following receipt of the Petition.
293Therefore, the Agency determined that the carrier waived all
302objections to the Petition pursuant to Subsection 440.13(7)(b),
310Florida Statutes.
3123. Petitioner f iled a Petition for Administrative Hearing
321and an Amended Petition, seeking a formal hearing under Section
331120.569 and Subsection 120.57(1), Florida Statutes. The case
339was then referred to the Division of Administrative Hearings
348(DOAH) on or about October 17, 2006.
3554. During the motion hearing, Petitioner acknowledged that
363the carrier did not submit a response to the Petition within the
375ten - day period as required by Subsection 440.13(7)(b), Florida
385Statutes.
3865. Subsection 440.13(7), Florida Statutes, rea ds in
394pertinent part as follows:
398(7) Utilization and Reimbursement Disputes.
403(a) Any health care provider, carrier, or
410employer who elects to contest the
416disallowance or adjustment of payment by a
423carrier under subsection (6) must, within 30
430days after r eceipt of notice of disallowance
438or adjustment of payment, petition the
444agency to resolve the dispute. The
450petitioner must serve a copy of the petition
458on the carrier and all affected parties by
466certified mail. The petition must be
472accompanied by all doc uments and records
479that support the allegations contained in
485the petition. Failure of a petitioner to
492submit such documentation to the agency
498results in dismissal of the petition.
504(b) The carrier must submit to the agency
512within 10 days after receipt of the petition
520all documentation substantiating the
524carrier's disallowance or adjustment.
528Failure of the carrier to timely submit the
536requested documents to the agency within 10
543days constitutes a waiver of all objections
550to the petition. (Emphasis supplie d)
5566. The Agency cited, as authority orders issued in three
566cases recently before the DOAH: Fairpay Solutions, Technology
574Insurance Company, Inc., and Associated Industries Insurance
581Services, Inc., v. AHCA , Case Nos. 06 - 1261 and 06 - 1274 (DOAH
595Recommend ed Orders of Dismissal, August 7, 2006; Agency Final
605Order rendered on both cases, September 14, 2006, which adopted
615the Recommend Order in toto ), and Fairpay Solutions, Broadspire
625Services, Inc., and Crum Services v. AHCA , DOAH Case No. 06 - 1463
638(Order Clo sing File, July 18, 2006, Agency Final Order rendered
649on August 14, 2006).
6537. In each case, the provider filed and properly served a
664Petition in accordance with Subsection 440.13(7)(a), Florida
671Statutes, but no response was timely filed pursuant to
680Subsec tion 440.13(7)(b), Florida Statutes.
6858. Petitioner, in its reply, cited as authority Gopman v.
695Department of Education , 908 So. 2d 1118 (Fla. 1st DCA 2005).
706Gopman is factually distinguishable from the instant case in
715that the Agency did not refuse Petit ioner's request for an
726administrative hearing. This case was referred to the DOAH, at
736which a hearing took place concerning whether the Agency's
745preliminary finding, that Petitioner's claims are barred, was
753correct. In Petitioner's Motion to Abate, Petit ioner cites
762Mednet Connect, Inc., et al. v. Agency for Health Care
772Administration , Case No. 04 - 2978 (DOAH, August 9, 2006; Final
783Order rendered on January 4, 2007, which rejected the
792Recommended Order in its entirety). This case is on point.
8029. Fairplay Solutions, et al. v. Agency for Health Care
812Administration , DOAH Case No. 06 - 1463, is presently on appeal to
824the First District Court of Appeal, Case No. 1D06 - 4653, and
836Mednet Connect, Inc., et al. v. Agency for Health Care
846Administration , DOAH Case No. 04 - 2978, is also on appeal to the
859First District, Case No. 1D07 - 378.
86610. Although the undersigned Administrative Law Judge has
874read each of the orders in the above - cited cases and finds merit
888in each of them, it is not necessary, for the disposition of
900this matter, to agree or disagree with a specific position. The
911Agency has clearly taken the position that the failure of the
922carrier to respond to the Petition within ten days is a
933jurisdictional failure, in that the language of Subsection
941440.13(7)(b), Flor ida Statutes, is clear that it operates as a
952self - executing statute of non - claim. Further, the Final Orders
964entered on DOAH Case Nos. 06 - 1261 and 06 - 1264 were not appealed,
979and the time for filing an appeal has expired. Therefore, the
990Agency's position o n this issue is the law of this case.
1002Because this issue is dispositive of Intervenor's Motion,
1010it is not necessary to address the other grounds asserted in
1021Intervenor's Motion, nor in Petitioner's Motions to Continue and
1030to Abate. 2
1033Accordingly, it is
1036REC OMMENDED:
10381. That the Agency for Health Care Administration enter a
1048final order dismissing the Petition for failure to meet the
1058required timelines of Subsection 440.13(7)(b), Florida Statutes.
10652. The final hearing in this cause scheduled for
1074February 13 and 14, 2007, is hereby canceled.
10823. The file of the Division of Administrative Hearings in
1092the above - captioned matter is hereby closed.
