97STATEMENT OF THE ISSUE

101The issue is whether Respondent is entitled to the renewal

111of his license to operate an adult family - care home.

122PRELIMINARY STATEMENT

124By Notice of Intent to Deny dated September 21, 2006,

134Res pondent informed Petitioner that it had denied his

143application for renewal of his license to operate an adult

153family - care home. The cited reason is that Petitioner did not

165reside in the home.

169Petitioner timely requested a hearing.

174At the hearing, Petiti oner called two witnesses and offered

184into evidence four exhibits. Respondent called two witnesses

192and offered into evidence nine exhibits. All exhibits were

201admitted.

202The court reporter filed the Transcript on February 28,

2112007. Respondent filed a pro posed recommended order on

220March 12, 2007.

223FINDINGS OF FACT

2261. At all material times, Petitioner has operated an adult

236family - care home at 7128 North 50th Street in Tampa. Petitioner

248owns this home with his cousin.

2542. In anticipation of the expiration of his license on

264September 29, 2006, Petitioner filed with Respondent an

272application for renewal on May 23, 2006. Renewal applications

281prompt annual survey inspections, so, after the receipt of

290Petitioner's renewal application, one of Respondent's surveyors

297vis ited the home and performed an annual survey inspection. She

308noted items that required a follow - up inspection, so, on

319August 3, 2006, one of Respondent's surveyors returned for the

329follow - up inspection.

3333. Respondent's surveyor was met at the door by Sheri lle

344Guider, who stated that she was the caregiver. The surveyor

354asked to see Petitioner, but she told her that Petitioner did

365not live at the house, although she showed the surveyor the

376locked room that belonged to Petitioner. When asked to produce

386certa in routine documents, the caregiver replied that she did

396not have access to such documents, as they were in the locked

408room of Petitioner and the caregiver did not have a key.

4194. Petitioner appeared a short time after the surveyor's

428arrival and produced the r equested documents. There is some

438dispute as to whether he offered to show his room to the

450inspector, but his testimony is unrebutted that he kept a room,

461with clothes and toiletries, for his exclusive use at the home.

472He claimed that he resided at the h ome, although he admitted

484that did not spend every night there.

4915. Subsequent investigation revealed that Petitioner and

498his wife, from whom he has been separated for two years, claim a

511different residence within Hillsborough County as their

518homestead propert y. Also, Petitioner's driver license currently

526bears the address of the home, but, at the time of the incident,

539bore the address of his homestead property. The same appears to

550be true of the certificate of title to his motor vehicle.

5616. Petitioner testified that he originally planned to

569operate the home as his fulltime job, but was unable to generate

581enough money doing so. He has since found employment as a

592certified nursing assistant and often works the 11:00 p.m. to

6027:00 a.m. shift.

6057. Four or five months prior to the follow - up inspection,

617Petitioner had hired Ms. Guider to serve as a caregiver at the

629home. In return for her services as a caregiver, Petitioner

639rented a room in the home to her at reduced rent. Petitioner

651allowed her boyfriend also to move into a room, but required a

663background screening on him, as well as on Ms. Guider. After

674several delays, the boyfriend completed his form, and, after

683submitting it, Petitioner learned that the boyfriend had a

692criminal record.

6948. Petitioner demanded that th e boyfriend move out.

703Eventually, Petitioner had to summon law enforcement officers to

712eject the man. This episode preceded the follow - up inspection.

7239. Ms. Guider's hearsay statement to Respondent's surveyor

731appears to be the strongest evidence on which Respondent is

741relying in this case. However, for the reason noted above,

751Ms. Guider was unhappy with Petitioner. Even before her

760boyfriend had been ejected from the home, Ms. Guider had

770approached Petitioner's two residents with a plan for her to

780start h er own adult family - care home and for them to move into

795it. Ms. Guider's short period of employment with Petitioner

804terminated one day when, without notice, she asked a friend of

815Petitioner to drive her to the airport so she could fly home to

828Chicago. Sh e did and never returned. For all these reasons,

839Ms. Guider does not appear to be a reliable source of

850information as to Petitioner's place of residence.

85710. Petitioner testified that he resides at the home. A

867friend of 20 years, who also operates an adult family - care home,

880testified that she visits Petitioner's home regularly and knows

889that he resides there.

89311. Petitioner's claiming of homestead exemption at

900another address is less evidence of his primary residence and

910more evidence of his carelessness or fra ud in maintaining

920current information with the Hillsborough County property

927appraiser's office. The old addresses shown on the driver

936license and certificate of title are of little importance in

946determining Petitioner's residence, given the other evidence

953establishing the home as his residence and his subsequent

962updating of the addresses in these official records.

970CONCLUSIONS OF LAW

97312. The Division of Administrative Hearings has

980jurisdiction over the subject matter. §§ 120.569 and 120.57(1),

989Fla. Stat. (20 06).

99313. Section 429.67(2), Florida Statutes, requires that the

1001operator of an adult family - care home "reside" in the home.

101314. It is not clear which party bears the burden of proof.

1025Respondent claims that the burden of proof rests with

1034Petitioner. Case law s uggests that an agency cannot avoid

1044revoking a license by declining to renew a license. See , e.g. ,

1055Dubin v. Department of Business Regulation , 262 So. 2d 273 (Fla.

10661st DCA 1972). However, Respondent cites Section 429.63(4),

1074Florida Statutes, which provid es that adult family - care home

1085licensure is "a public trust and a privilege, and not an

1096entitlement" and requires that "the finder of fact or trier of

1107law at any administrative proceeding or circuit court action

1116initiated by the department to enforce this part" be "guide[d]"

1126by this principle. Section 492.63(4) raises a question as to

1136the applicability of the case law.

114215. However, imposing the burden of proof on Petitioner

1151does not alter the outcome in this case, so this order shall

1163assume that Petitioner be ars the burden of proof.

117216. Petitioner has proved that he resided in the adult

1182family - care home that he operates at 7128 North 50th Street in

1195Tampa. He is thus entitled to renewal of the license that

1206Respondent declined to renew.

1210RECOMMENDATION

1211It is

1213RE COMMENDED that the Agency for Health Care Administration

1222enter a final order granting Petitioner's application to renew

1231his adult family - care home license.
