59On September 11, 2007, a lengthy Order on Requests for
69Sanctions was entered in this case. It granted some requested
79sanctions, denied others, and retained jurisdiction to allow the
88parties to "file their agreement as to the reasonable amount of
99attorney's fees and costs and sanctions to be awarded; . . .
111submit the matter for determination on affidavits; or . . .
122request the scheduling of a hearing for purposes of determining
132the matter." Subsequently, all matters regarding sanctions were
140resolved by agreement except for the amount of the sanction
150( i.e. , a reasonable attorney's fee) to be imposed for the part of
163paragraph 38 of Ms. Brown's Amended Petition alleging a failure
173to protect historic or cultural resources as to the Clara Avenue
184Future Land Use Map (FLUM) Amendment. Since Clara Avenue and
194Ms. Brown were not able to settle, agree as to the reasonable
206amount of attorney's fees and costs, or agree to submit the
217matter for determination on affidavits, the matter was scheduled
226for a final hearing.
230Initially, the matter was scheduled for a final hearing on
240April 2, 2008. However, at Ms. Brown's requests, it was first
251re-scheduled to February 7, 2008, and subsequently continued and
260re-scheduled to April 29, 2008, which is when the final hearing
271took place in Panama City.
276At the final hearing, Clara Avenue called its counsel of
286record, Michael Dickey, Esquire, as a fact and expert witness,
296and called Jeffrey P. Whitton, Esquire, as an expert witness.
306Clara Avenue also had its Exhibits 1 through 4 admitted in
317evidence. Exhibit 1 was a redacted version of the Summary and
328Detail Transaction File List of the Law Firm of Barron, Redding,
339Hughes, Fite, Sanborn, Kiehn & Dickey, P.A. Exhibit 2 was a Fee
351Calculation by Mr. Dickey. Exhibit 3 was a resume of
361Mr. Whitton's qualifications as an expert. Exhibit 4 was the
371transcript of the deposition of Michael Kamprath, former counsel
380of record for Clara Avenue and former associate of Mr. Dickey.
391No other evidence was presented at the hearing.
399After the presentation of evidence and oral closing
407statements, the parties' request to file proposed final orders by
417May 23, 2008, was granted. The timely proposed final orders have
428been considered in the preparation of this Order.
436In addition to proposed final orders, other post-hearing
444filings require rulings. On May 23, 2008, Ms. Brown filed a
455Motion for Official Recognition of a response filed in an
465unrelated circuit court case in which Mr. Dickey was seeking an
476award of attorney's fees and costs. This Motion for Official
486Recognition was opposed and is denied. On June 2, 2008,
496Ms. Brown filed Exceptions to Clara Avenue's proposed final order
506and another Motion for Official Recognition, this time for
515official recognition of Mr. Kamprath's deposition testimony,
522which already was in evidence. Clara Avenue did not oppose the
533Motion for Official Recognition but filed a Response to the
543Exceptions on June 4, 2008. On June 10, 2008, Ms. Brown moved to
556strike the Response. The next day she filed a Motion for
567Official Recognition of Supreme Court Orders Suspending David
575Russ from Practicing Law. The issues raised in those filings are
586addressed to the extent necessary in this Final Order on
596Sanctions.
597FINDINGS OF FACT
6001. Clara Avenue does not seek costs.
6072. Clara Avenue's attorneys charged an attorney's fee based
616on time spent at hourly rates of $200 for partners in the firm
629(primarily Mr. Dickey), $150 for associates (primarily
636Mr. Kamprath), and $65 for clerks and paralegals. These hourly
646rates are reasonable. While the hourly rates may have been
656somewhat conservative, there is no evidence that the fees charged
666to Clara Avenue were discounted.
6713. Counsel for Clara Avenue did not keep track of time by
683issue, and the law firm's time records do not show time spent
695specifically on the part of paragraph 38 of the Amended Petition
706alleging a failure of the Clara Avenue FLUM Amendment to protect
717historic or cultural resources. This was not unreasonable. It
726is not customary to keep time records on specific issues raised
737in a case, and the need for such records was not reasonably
749foreseeable.
7504. In lieu of calculating a reasonable attorney's fee from
760time spent specifically on the part of paragraph 38 of the
771Amended Petition alleging a failure of the Clara Avenue FLUM
781Amendment to protect historic or cultural resources, Clara Avenue
790seeks one-sixteenth of the total reasonable attorney's fee for
799counsel's entire representation on this matter, at least up to
809the entry of the Order on Requests for Sanctions on September 11,
8212007. Clara Avenue's rationale for using this ratio is that
831paragraph 38 of the Amended Petition was one of sixteen numbered
842paragraphs of the Amended Petition litigated by Ms. Brown in the
853underlying proceeding.
8555. Using the one-sixteenth ratio calculation, Clara Avenue
863seeks payment of $5,325.59 for attorney's fees through the entry
874of the Order on Requests for Sanctions on September 11, 2007,
885plus $337.04 of statutory interest through April 29, 2008, the
895date of the final hearing on the fee amount determination.
9056. Assuming the reasonableness under the circumstances of
913proving the amount of a reasonable attorney's fee to be imposed
924as a sanction for one of several claims by a pro rata share of
938the total reasonable attorney's fee, Clara Avenue's calculation
946had flaws and, in any event, resulted in the calculation of an
958excessive amount of attorney's fees to be imposed as a sanction
969in this case.
9727. First, while paragraph 38 of the Amended Petition may
982have been one-sixteenth of the claims raised by Ms. Brown in the
994Amended Petition, protection of historic and cultural resources
1002was only one of ten issues raised in that paragraph. For that
1014reason, using Clara Avenue's rationale, the more appropriate
1022ratio to use would be one-sixteenth times one-tenth, or 1/160.
10328. Applying that 1/160 ratio to the total reasonable
1041attorney's fee through the Final Order in the underlying
1050proceeding, which Clara Avenue calculated to be $71,000 on an
1061hourly rate basis, would result in the calculation of reasonable
1071attorney's fee in the amount of $443.75.
10789. However, even that amount would be excessive. First,
1087the evidence was that some, if a small amount, of the time
1099counted and figured in Clara Avenue's calculation of the $71,000
1110was spent on matters clearly unrelated to the underlying
1119proceeding. Second, other time counted and figured in
1127calculating the $71,000 clearly was spent on other specific
1137issues. This time should not have been included in a total of
1149time spent on the case in general to be divided by an appropriate
1162ratio. After making adjustments for the foregoing evidence, the
1171more appropriate calculation of a reasonable attorney's fee
1179through the Final Order in the underlying case would be reduced
1190to $389.53.
119210. Although $389 is a miniscule portion of the total
1202reasonable fee of $71,000, there are other reasons why it would
1214be a more reasonable attorney's fee than the $5,325.59 claimed by
1226Clara Avenue for litigating the part of paragraph 38 of the
1237Amended Petition alleging a failure to protect historic or
1246cultural resources. First, the time records of Clara Avenue's
1255attorney's did not indicate any time specifically devoted to the
1265issue. Moreover, counsel for Clara Avenue could not recall any
1275time being spent specifically on the issue. Clearly, the case
1285was mostly, if not entirely, about the other issues raised and
1296litigated, for which sanctions were not imposed.
130311. Mr. Whitton suggested that the higher fee requested by
1313Clara Avenue was justified because Ms. Brown benefited from
1322economy of scale. In other words, he testified that an even
1333higher fee would be justified if Ms. Brown's case had been tried
1345only on the one issue of protection of historic or cultural
1356resources. But it is very unlikely that the case would have been
1368tried through and beyond final hearing solely on that issue, in
1379light of its relative unimportance in the case.
138712. The evidence was that counsel for Clara Avenue recorded
1397a substantial amount of time spent on the case between the entry
1409of the Final Order in the underlying proceeding on April 3, 2007,
1421and the entry of the Order on Requests for Sanctions on
1432September 11, 2007, which resulted in another $14,209.50 of
1442attorney's fees at the firm's reasonable hourly rates. Clara
1451Avenue also seeks one-sixteenth of that amount-- i.e. , another
1460$888. However, at the 1/160 ratio, the claim would be reduced to
1472$88.80, for a total reasonable attorney's fee of $478.33. Based
1482on all the evidence, it is found that it is appropriate to round
1495this amount to $500.
149913. Clara Avenue also seeks approximately $5,500 in
1508attorney's fees for time spent litigating the amount of a
1518reasonable attorney's fee to be imposed as a sanction, after the
1529entry of the Order on Requests for Sanctions on September 11,
15402007, which established entitlement.
1544CONCLUSIONS OF LAW
154714. When it has been determined that sanctions should be
1557imposed under Section 57.105, Florida Statutes (2007), for only
1566one of several claims, and it is reasonable and customary not to
1578keep specific time records by issue, failure to keep such records
1589does not defeat the claim for sanctions. Cf. Hatcher v. Roberts ,
1600538 So. 2d 1300, 1301 (Fla. 1st DCA 1989)(complex nature of the
1612work on the case provided ample explanation for the lack of
1623specificity in the record of time spent on the various parts of
1635the case). Where an allegation sanctioned under Section 57.105,
1644Florida Statutes, is intertwined with other allegations not
1652sanctioned, a proportionate amount of fees attributed to the
1661sanctioned allegation is appropriate under some circumstances.
1668See Franzen v. Lacuna Golf Limited Partnership , 717 So. 2d 1090,
16791093 (Fla. 4th DCA 1998)(awarding fees proportionately against 64
1688individual plaintiffs, where time records were not broken out
1697among them). However, an award must be based on competent,
1707substantial evidence. See Yakavonis v. Dolphin Petroleum, Inc.,
1715934 So. 2d 615, 618 (Fla. 4th DCA 2006); Weatherby Associates,
1726Inc. v. Ballack , 783 So. 2d 1138, 1141 (Fla. 4th DCA 2001).
1738Moreover, the award cannot be excessive. See Florida Patient's
1747Compensation Fund v. Rowe , 472 So. 2d 1145, 1150-51 (Fla. 1985).
1758In this case, the attorney's fee requested by Clara Avenue was
1769excessive.
177015. A reasonable attorney's fee can be awarded for time
1780spent litigating entitlement to the award, but not for time spent
1791litigating the amount of the award. See Barron Chase Securities,
1801Inc. v. Moser , 794 So. 2d 649 (Fla. 2d DCA 2001). In this case,
1815that means a reasonable attorney's fee should be awarded only for
1826time spent through the entry of the Order on Requests for
1837Sanctions on September 11, 2007.
184216. Prejudgement interest accrues on attorney's fees from
1850the time entitlement is fixed through agreement, arbitration
1858award, or court determination, even though the amount of the
1868award has not yet been determined. See National Portland Cement
1878Company v. Goudie , 718 So. 2d 274, 276 (Fla. 2d DCA 1998). In
1891this case, prejudgment interest should be awarded on the $500 at
1902the statutory rate from the entry of the Order on Requests for
1914Sanctions on September 11, 2007.
191917. Under Section 55.03(1), Florida Statutes, each year
1927Florida's Chief Financial Officer sets the legal rate of interest
1937on judgments. For judgments entered in 2007 (and 2008), the
1947legal rate of interest on judgments is 11 percent per annum, or
19590.0003014 per day. See Chief Financial Officer's website:

196818. Ms. Brown points out that, under Section 57.105,
1977Florida Statutes, the sanction is to be imposed in equal parts
1988against her and her former attorney, Ralf Brookes. Clara Avenue
1998contends that the imposition of a sanction against Mr. Brookes is
2009not appropriate. However, the appropriateness of imposing
2016sanctions against Mr. Brookes was determined in the Order on
2026Requests for Sanctions on September 11, 2007, which was not
2036appealed by Mr. Brookes. On October 10, 2008, Mr. Brookes moved
2047to apportion, limit, or reduce the sanction to be assessed
2057against him, but he also gave notice of his settlement with Clara
2069Avenue, and later withdrew from further participation. In any
2078event, Ms. Brown is correct that only her equal part of the
2090sanction-- i.e. , $250--should be imposed against her.
209719. Ms. Brown also contends that, under Section 57.105,
2106Florida Statutes, sanctions should be imposed against David Russ,
2115an attorney now suspended from practicing law, who while still
2125licensed and authorized to practice law, acted as an expert land
2136use consultant and witness for Ms. Brown in the underlying
2146proceeding. However, Mr. Russ never acted as an attorney for
2156her, and the Order on Requests for Sanctions entered on
2166September 11, 2007, imposed no sanctions on Mr. Russ, and it
2177would be contrary to the statute to further reduce the sanction
2188imposed on Ms. Brown by shifting an equal part to Mr. Russ. (It
2201also would be a violation of due process to impose a sanction
2213against Mr. Russ in this Final Order on Sanctions.)
2222DISPOSITION
2223Based on the foregoing Findings of Fact and Conclusions of
2233Law, it is ORDERED that Diane Brown pay Clara Avenue $250 as a
2246reasonable attorney's fee to be imposed as a sanction under
2256Section 57.105, Florida Statutes, for litigating the part of
2265paragraph 38 of the Amended Petition alleging a failure of the
2276Clara Avenue FLUM Amendment to protect historic or cultural
2285resources, together with statutory interest on that amount from
2294September 11, 2007.
