98STATEMENT OF THE ISSUE
102The issue is whether the Department of Highway Safety and
112Mo tor Vehicles should approve the establ ishment of a proposed
123dealership by SunL Group, Inc., in Gulfport, Florida.
131PRELIMINARY STATEMENT
133T he Department of Highway Safety and Motor Vehicles
142(Department) published notice in th e December 22, 2006, volume
152of th e Florida Administrative Weekly that S unL Group, Inc.
163(SunL) , intend s to establish a dealership in Gulfport, Florida.
173The proposed dealer is XLILR8ING Enterprises, LLC d/b/a TRM
182Rides (TRM) , and the vehicles to be sold by the dealership are
194 China Qingqi (QING), Taizhou Chunal (CHUA), America n Lifan
204(CHOL), Shanghai Meitian (MEIT), Shanghai JMSTAR (JMST)
211motorcycles.
212On January 18, 2007, the Department received a letter from
222West Coast Motorcycles (West Coast) protesting the establishment
230of the proposed dealership. On January 23, 2007, the Department
240referred the matter to the Division of Administrative Hearings
249(DOAH) for a hearing.
253Only TRM appeared at the final hearing. TRM presented the
263testimony of Thomas R. Malin, III . No exhibits were offered
274into evidence.
276The hearing was transcrib ed by a court reporter, but n o
288transcript of the hearing was filed with DOAH . TRM waived the
300filing of a proposed recommended order .
307FINDINGS OF FACT
3101. TRM is in the business of selling motor scooters in
321Gulf p ort, which is in Pinellas County. TRM is o wned by
334Thomas R. Malin, III.
3382. TRM is currently an authorized dealer of scooters
347manufactured and/or imported by Carter Brothers and Tank Sports.
356Those scooters sell in the $2,000 to $3,000 price range.
3683. TRM is seeking through this proceeding to b ecome an
379authorized dealer of scooters imported by SunL. 1 Those scooters
389sell in the $1,4 50 to $1,995 price range.
4004. No evidence was presented at the hearing regarding the
410location o r products sold by West Coast, and there is no
422evidence that West Coas t sells SunL scooters.
4305. There are no dealers selling SunL scooters in the
440Pine llas County area, according to Mr. Malin.
4486. West Coast was provided due notice of the date, time,
459and location of the final hearing in this case .
4697. No representative of West Coast appeared at the final
479hearing.
480CONCLUSIONS OF LAW
4838. DOAH has jurisdiction over the parties to and subject
493matter of this proceeding pursuant to Sections 120.569,
501120.57 (1) , and 320.699, Florida Statutes (2006). 2
5099. West Coasts failure to ap pear at the final hearing
520c ould be considered a withdrawal of its protest , and the protest
532could be dismissed on that ground. Alternatively, as discussed
541below, the protest should be dismissed because West Coast failed
551to prove that i t has standing to pro test TRMs proposed
563dealership.
56410. West Coast has the burden of proof on the issue of its
577standing. See generally Dept. of Transportation v. J.W.C. Co.,
586Inc. , 396 So. 2d 778, 788 (Fla. 1st DCA 1981) (burden of proof
599is on the party asserting the affirma tive of the issue).
61011. Standing to protest the establishment of TRMs
618proposed dealership is governed by Section 320.642(3)(b),
625Florida Statutes. Pursuant to that statute, standing is limited
634to :
6361. Any existing motor vehicle dealer or
643dealers of th e same line - make have a
653licensed franchise location within a radius
659of 12.5 miles of the location of the
667proposed additional or relocated motor
672vehicle dealer; or
6752. Any existing motor vehicle dealer or
682dealers of the same line - make can establish
691that during any 12 - month period of the 36 -
702month period preceding the filing of the
709licensee's application for the proposed
714dealership, such dealer or its predecessor
720made 25 percent of its retail sales of new
729motor vehicles to persons whose registered
735household addresses were located within a
741radius of 12.5 miles of the location of the
750proposed additional or relocated motor
755vehicle dealer; provided such existing
760dealer is located in the same county or any
769county contiguous to the county where the
776additional or r elocated dealer is proposed
783to be located.
78612. Section 320.60(14), Florida Statutes, defines "[l]ine -
794make vehicles" to include those motor vehicles which are
803offered for sale, lease, or distribution under a common name,
813trademark, service mark, or bra nd name of the manufacturer of
824same.
82513. West Coast failed to prove its standing. There is no
836evidence that West Coast sells the same line - make vehicles as
848those at issue in this case and , to the contrary, Mr. Malin
860testified that there are no SunL scoo ter dealers in the Pinellas
872County area. Moreover, no evidence was presented regarding the
881location of West Coast in rela tion to TRMs proposed dealership
892or the percentage of sales made by West Coast in the relevant
904vicinity of TRMs proposed dealership .
910RECOMMENDATION
911Based upon the foregoing findings of fact and conclusions
920of law, it is
924RECOMMENDED that the Department issue a final order
932dismissing West Coast s protest and approving TRMs proposed
941SunL dealership in Gulf p ort.
