137and 766.305(7), Florida Statutes, upon the Amended Stipulation

145and Joint Petition of the parties, filed June 26, 2007, and the

157amendment to paragraph 12. a) of the Amended Stipulation and

167Joint Petition, filed July 3, 2007.

173By the terms of their Amended Stipulation and amendment to

183paragraph 12. a) of the Amended Stipulation (hereinafter

"191Stipulation"), the parties have agreed that Petitioner,

199Berthenia Parker, is the parent and legal guardian of Marliyah

209Shadeja Parker (Marliyah), a deceased minor; that Marliyah was

218born a live infant on May 18, 2005, at Tampa General Hospital, a

231hospital located in Tampa, Florida; and that Marliyah's birth

240weight exceeded 2,500 grams. The parties have further agreed

250that the physician delivering obstetrical services at Marliyah's

258birth was Joan McCarthy, M.D., who, at all times material hereto,

269was a "participating physician" in the Florida Birth-Related

277Neurological Injury Compensation Plan, as defined by Section

285766.302(7), Florida Statutes. Finally, by their stipulation, the

293parties have agreed that Marliyah suffered a "birth-related

301neurological injury," as that term is defined by Section

310766.302(2), Florida Statutes.

313After due consideration of the interests of all parties, and

323being otherwise fully advised in the premises, it is

332ORDERED that:

3341. The Amended Stipulation and Joint Petition of the

343parties, filed June 26, 2007, and the amendment to paragraph

35312. a) of the Amended Stipulation and Joint Petition, filed

363July 3, 2007, are hereby approved, and the parties are directed

374to comply with the provisions thereof.

3802. Petitioner, Berthenia Parker, as the parent of Marliyah

389Shadeja Parker, a deceased minor, is awarded One hundred thousand

399dollars ($100,000.00), pursuant to Section 766.31(1)(b)1.,

406Florida Statutes, and a death benefit of Ten thousand dollars

416($10,000.00), pursuant to Section 766.31(1)(b)2., Florida

423Statutes, to be paid in lump sum.

4303. Upon payment of the award of One hundred thousand

440dollars ($100,000.00), a death benefit of Ten thousand dollars

450($10,000.00), and attorney's fees and other expenses of Ten

460thousand five hundred dollars ($10,500.00), the claims of

469Petitioner (claimant) shall be deemed fully satisfied and

477extinguished.

4784. The Division of Administrative Hearings retains

485jurisdiction over this matter to resolve any dispute as to the

496interpretation of any provision of the parties' stipulation, and

505to resolve any disputes, should they arise, regarding the

514parties' compliance with the terms of such stipulation and this

524Final Order.
