141STATEMENT OF THE ISSUES
145The issues in this case are whether Respondent violated
154Subsection 464.018(1)(j), F lorida Statutes (2006), 1 and, if so,
164what discipline should be imposed.
169PRELIMINARY STATEMENT
171On March 20, 2007, Petitioner, the Department of Health
180(Department), filed an Administrative Complaint before the Board
188of Nursing, alleging that Respondent, B.J . Penansky, A.R.N.P.
197(advance registered nurse practitioner)(Ms. Penansky), violated
203Subsection 464.018(1)(j), Florida Statutes, by being unable to
211practice nursing with reasonable skill and safety by reason of
221illness or use of alcohol, drugs, narcotics, or chemicals or any
232other type of material or as a result of any mental or physical
245condition. Ms. Penansky requested an administrative hearing,
252and the case was forwarded to the Division of Administrative
262Hearings on May 1, 2007, for assignment of an A dministrative Law
274Judge to conduct the final hearing.
280The final hearing was scheduled for hearing on June 28,
2902007. On June 20, 2007, Petitioner filed a motion for
300continuance, which was granted. The final hearing was re -
310scheduled for July 25 and 26, 200 7.
318At the final hearing, the Department called the following
327witnesses: Martha E. Brown, M.D.; Subhakrarao Medidi, M.D.;
335Yolanda Guzman, R.N.; Carmen Laguerra; George Hammond; and Lynn
344Crill. Petitioners Exhibits 1 through 8 were admitted in
353evidence. Ms. Penansky testified in her own behalf and called
363the following witnesses: Raymond Johnson, M.D.; James Nunez;
371Brantz Roszel; and Susan Bingham, A.R.N.P. Ms. Penansky
379presented the testimony of Marie Massaro; Nicholas Anthony,
387Ph.D.; Steven Zweibach, M .D.; and Raymond Johnson, M.D., by
397deposition. Respondents Exhibits 1 through 9 and 12 through 21
407were admitted in evidence. Respondents Exhibits 10 and 11 were
417not admitted in evidence.
421Official recognition was taken of Section 20.43 and
429Subsection 46 4.018(1)(j), Florida Statutes, and Florida
436Administrative Code Rule 64B9 - 8.006.
442The three - volume Transcript was filed on August 15, 2007.
453A corrected portion of the Transcript was filed on August 20,
4642007. The parties filed their Proposed Recommended Ord ers on
474August 27, 2007. On August 30, 2007, Petitioner filed a Motion
485to Strike, requesting that a portion of Respondents Proposed
494Recommended Order be stric ken for exceeding 40 pages. On
504August 31, 2007, Respondent filed Respondents Motion to Strike

533Recommended Order. The motions were heard by telephonic
541conference call on September 7, 2007, and an order was entered
552on September 1 1, 2007, striking the pages of Respondents
562Proposed Recommended Order, which exceeded 40 pages. The
570parties ' P roposed R ecommended O rders have been considered in
582rendering this Recommended Order.
586On September 14, 2007, Respondent filed a Motion for
595Extens ion of Time to Allow Transcript of September 7, 2007
606Hearing to be Filed and Accepted as Part of the Record. The
618motion was granted.
621FINDINGS OF FACT
6241. At all times material to this proceeding, Ms. Penansky
634has been licensed as an A.R.N.P. in Florida, h aving been issued
646license number ARNP1302962 in 1982. From 1993 through
654August 2006, Ms. Penansky was employed as an A.R.N.P. at the
665Dover Clinic of Suncoast Community Health Centers, Inc.
673(Suncoast). She was the primary certified nurse midwi fe at the
684fa cility and saw the obstetric/gynecology patients.
6912. During 2004, Carmen Laguerra, who was the office
700manager at the Dover Clinic, smelled alcohol on Ms. Penanskys
710breath at work and observed Ms. Penanskys hands trembling. A
720couple of times, Ms. Laguer ra observed that Ms. Penansky was
731having trouble walking at work and would put her hand on the
743walls to support herself. Ms. Penansky came to work at times
754with bruises on her arms and face.
7613. In the fall of 2004, the coordinator of medical records
772at t he Dover Clinic asked Ms. Laguerra to observe Ms. Penansky
784in the medical records room. Ms. Laguerra observed Ms. Penansky
794murmuring to herself.
7974. Prior to 2004, Ms. Penansky had demonstrated a quiet
807demeanor. In 2004, Ms. La g uerra observed a change in
818Ms. Penanskys demeanor. Ms. Penansky became more outspoken and
827opinionated.
8285. In 2004, Yolanda Guzman, the supervisor of nurses at
838the Dover Clinic, noticed the smell of alcohol on Ms. Penanskys
849breath and body while at work. Ms. Guzman also notice d that
861Ms. Penanskys hands were trembling and that Ms. Penanskys
870speech was not clear. Ms. Guzman observed bruises on
879Ms. Penanskys arms and face. Ms. Guzman reported her
888observations to Ms. Laguerra and to S u bhakrarao Medidi, M.D.,
899who was the asso ciate medical director at the Dover Clinic.
9106. Dr. Medidi smelled alcohol on Ms. Penanskys breath one
920time in 2004. On multiple occasions, he observed Ms. Penanskys
930hands shaking. After receiving patient complaints, Dr. Medidi
938confronted Ms. Penansky about the smell of alcohol.
946Ms. Penansky denied the use of alcohol, claiming that the smell
957resulted from the use of mouthwash. Dr. Medidi also recalled
967one time, in particular, when Ms. Penansky came to work with
978bruises.
9797. George Hammond, the c hief ad ministrative o fficer at
990Suncoast , met with Ms. Penansky to discuss the observations of
1000employees at the Dover Clinic. Ms. Penansky denied the use of
1011alcohol at work. He directed Ms. Penansky to get a blood -
1023alcohol test. She did as directed, and the re sult of the test
1036was negative.
10388. Mr. Hammond directed Ms. Penansky to contact the
1047Intervention Project for Nurses (IPN), which is the impaired
1056practitioner program for the Board of Nursing. IPN is an
1066independent program that monitors the evaluation, ca re, and
1075treatment of impaired nurses. IPN oversees random drug screens
1084and provides for the exchange of information between treatment
1093providers, evaluators, and the Department.
10989. Ms. Penansky contacted IPN and was referred to
1107Martha E. Brown, M.D., for an evaluation. As part of the
1118evaluation, Ms. Penansky underwent a drug test, which was
1127negative for drugs and alcohol, but was considered dilute. When
1137a drug test is dilute, it usually means that the individual
1148tested consumed a significant amount of f luids prior to the
1159test.
116010. Ms. Penansky advised Dr. Brown that she averaged
1169drinking almost every day, but had stopped drinking about ten
1179days prior to the evaluation. As a result of abstinence,
1189Ms. Penansky told Dr. Brown that she felt better and was able to
1202stay up later and get up earlier. Ms. Penansky advised
1212Dr. Brown that her brother had a problem with alcohol and had
1224not had a drink in 20 years.
123111. In a report dated November 8, 2004, Dr. Brown opined
1242that there was suspicion for Ms. Penansky having a substance
1252abuse problem. She recommended that Ms. Penansky enter into an
1262abuse contract with IPN for two years with a one - year review.
127512. Ms. Penansky entered into an IPN contract in
1284December 2004. Her participation in the program included r andom
1294drug screening, joining a support group, attending Alcoholics
1302Anonymous meetings, and being evaluated by her supervisor.
1310During her participation in the program, she was tested for
1320alcohol 17 times, and each time the test was negative.
1330Ms. Penansk y completed the program in one year.
133913. While Ms. Penansky was participating in the IPN
1348program, employees at Suncoast observed positive changes in her.
1357Ms. Penanskys appearance and mood improved, and the tremors in
1367her hands disappeared.
137014. On July 31, 2006, Ms. Penansky was involved in an
1381automobile accident. As a result of the accident, she sustained
1391some bruises to her body, which were visible to employees at the
1403Dover Clinic.
140515. In August 2006, while Ms. Penansky was at work,
1415Ms. Guzman again smelled alcohol on Ms. Penansky s breath and
1426noticed Ms. Penanskys hands were shaky , and her speech was not
1437normal. Ms. Laguerra also smelled alcohol on Ms. Penansky while
1447Ms. Penansky was at work during the same time period. In
1458August 2006, Dr. Medid i noticed that Ms. Penanskys hands were
1469shaking again.
147116. Ms. Penansky denies that she had alcohol on her breath
1482at work in either 2004 or 2006. However, both Ms. Guzman and
1494Ms. Laguerra testified credibly that they smelled alcohol on
1503Ms. Penanskys b reath and that the smell was different from the
1515smell that would come from the use of mouthwash, which has a
1527medicinal smell. Additionally, Ms. Penansky testified that in
15352006 she was not using the mouthwash prior to going to work
1547because she felt that in 2004 her fellow employees had mistaken
1558the smell of the mouthwash for the smell of alcohol. Thus, the
1570smell could not have come from mouthwash in 2006 because
1580Ms. Penansky was not using it.
158617. Ms. Penansky commenced a change in her eating habits
1596in wh ich she had lost 50 pounds. In 2006, she was still losing
1610weight , but not at a very rapid pace. At the final hearing,
1622there were some allegations that the odor that Ms. Guzman and
1633Ms. Laguerra smelled was a result of a release of ketones due to
1646Ms. Penan skys diet. However, the smell caused by ketones is a
1658sweet smell, which is different from the smell of alcohol.
1669Another allegation at the final hearing was that the smell could
1680be a result of Ms. Penanskys periodontal disease, but the smell
1691that woul d result from a periodontal disease would be different
1702from the smell of alcohol.
170718. Neither Ms. Guzman nor Ms. Laguerra had any conflict
1717with Ms. Penansky that would cause them to make false
1727allegations against her. In fact, both Ms. Guzman and
1736Ms. La guerra were highly complementary of Ms. Penanskys work,
1746aside from the use of alcohol and the hand tremors.
175619. The evidence is clear and convincing that in 2004 and
1767in 2006, Ms. Penansky came to work at the Dover Clinic with
1779alcohol on her breath while she was practicing as the primary
1790midwife at the facility.
179420. In August 2006, the observations of Ms. Guzman and
1804Ms. Laguerra were made known to the management at Suncoast.
1814Suncoast elected not to require Ms. Penans k y to undergo a drug
1827screening to det ermine whether she had ingested alcohol. On
1837August 3, 2006, Ms. Penansky was terminated from her position
1847with Suncoast for her use of alcoh ol and directed to contact
1859IPN.
186021. After Ms. Penansky was terminated from Suncoast, she
1869went to work for a p rivate physician. Her employment was
1880uneventful, and she continued in his employ until the Department
1890suspended her license by emergency order.
189622. Ms. Penansky did not contact IPN, and Suncoast filed a
1907complaint with the Department. An investigation en sued. The
1916Department required Ms. Penansky to be evaluated. In
1924January 2007, Ms. Penansky was again evaluated by Dr. Brown.
193423. Ms. Penansky advised Dr. Brown that she had returned
1944to drinking occasionally after she completed her program with
1953IPN, but denied drinking on the job or drinking in large
1964amounts. A drug screen was performed on Ms. Penansky, and the
1975result was negative.
197824. Dr. Brown diagnosed Ms. Penansky with alcohol abuse,
" 1987rule out alcohol dependency. " Credibly, Dr. Brown opined that
1996Ms . Penansky appeared to be either in denial or minimizing the
2008impact alcohol has had on her life and the problems she has had
2021at work with others smelling alcohol on her breathe [sic]
2031multiple time [sic]. It was Dr. Browns opinion that in order
2042for Ms. Penansky to be able to practice with reasonable safety
2053and skill that she should minimally complete an intensive
2062outpatient program and have monitoring through IPN.
206925. Ms. Penansky was also evaluated by Raymond A. Johnson,
2079M.D., who came to the conclusio n that Ms. Penansky did not have
2092an addiction and alcohol problem. He felt that she was safe to
2104practice nursing without treatment or monitoring by IPN. In his
2114report dated January 22, 2007, he stated that Ms. Penansky used
2125mouthwash multiple times a day because of periodontal disease,
2134and he concluded that the use of the mouthwash was the reason
2146for the smell of alcohol on her breath. His argument loses
2157plausibility based on Ms. Penanskys testimony at final hearing
2166that she was not using the mouthwash in 2006 prior to going to
2179work so that people would not mistake the smell of mouthwash for
2191the smell of alcohol.
219526. Dr. Johnson had a psychological evaluation performed
2203on Ms. Penansky by Nicholas Anthony, Ph.D. In his report,
2213Dr. Anthony stated that M s. Penansky told him that her brother
2225was no longer allowed to use alcohol because he had been
2236diagnosed with diabetes. Based on Ms. Penanskys
2243representations, he concluded that she did not have a family
2253history for addiction.
225627. Ms. Penanskys account of her brothers abstinence
2264differed when she related her family history to Dr. Brown. She
2275did not tell Dr. Brown that her brother had stopped drinking
2286because he was a diabetic. At the final hearing, she did not
2298mention that her brother refrained from drinking because of
2307diabetes. At the final hearing, Ms. Penansky testified:
2315Well, what he [her brother] told me, in
2323fact, what he told the whole family was, at
2332one point he said he just felt like he was
2342drinking too much and decided to stop. That
2350was it. He never said anything about being
2358an alcoholic. He never said he was
2365diagnosed by a physician. He made a
2372personal choice.
237428. Dr. Anthony tested Ms. Penansky using the Minnesota
2383Multiphasic Personality Inventory - II (MMPI), The Rorschach, and
2392the Mil lion Clinical Multiaxial Inventory - III (MCMI). The
2402Rorschach, otherwise known as the ink blot test, is not
2412commonly used in the field of addiction psychiatry to look at
2423substance abuse diagnoses.
242629. In the field of psychiatry, alcohol abuse and alcoho l
2437dependency are considered Axis I, or primary, diagnoses. The
2446MMPI and the MCMI are more accurate and effective in diagnosing
2457other Axis I disorders such as psychosis than in diagnosing
2467substance abuse or dependency. This is due to the fact that
2478individ uals with substance abuse or dependency problems often
2487attempt to present themselves in the best possible light when
2497answering the test questions. The test results themselves for
2506these individuals are often invalid because the test either
2515misses the subst ance abuse or dependency diagnosis or identifies
2525the individuals denial or minimization tendencies.
253130. The Adult Clinical Interpretive Report for Ms.
2539Penanskys MMPI test states:
2543[Ms. Penansky] approached the test items in
2550a somewhat defensive manner. Her
2555overcautious approach to the items suggests
2561that she is concerned with making a good
2569impression and is reluctant to disclose much
2576about her personal adjustment.
2580Interpretations of the clinical and content
2586scale profiles should allow for her possible
2593m inimization of problems.
259731. The Adult Clinical Interpretive Report for
2604Ms. Penanskys MCMI test states:
2609Unless this patient is a well - functioning
2617adult who is facing minor life stressors,
2624her responses suggest an effort to present a
2632socially acceptable appearance or a
2637resistance to admitting personal
2641shortcomings. Inclined to view
2645psychological problems as a sign of
2651emotional or moral weakness, the patient may
2658protectively deny any unseemly traits or
2664symptoms. This probably reflects either a
2670broad - base d concern about being appraised
2678unfavorably by others or an active suspicion
2685of the arcane motives of psychological
2691inquiry. Her MCMI - II scores have been
2699adjusted to compensate for her
2704defensiveness, but the overall profile may
2710remain partially distorted. An
2714interpretation based on standard
2718interpretive procedures is likely to be
2724reasonably valid but may fail to represent
2731certain features of either the patients
2737disorders or her character.
2741The BR scores reported for this individual
2748have been modified to account for the
2755defensiveness suggested by the prominence of
2761Personality Patterns Scale 7 (Compulsive).
276632. Dr. Anthony interpreted the results of Ms. Penanskys
2775test scores as being negative for a diagnosis of alcohol abuse
2786or dependency. Dr. Johnson r elied on Dr. Anthonys
2795interpretation of test results in forming his opinion that
2804Ms. Penansky was negative for a diagnosis of alcohol abuse or
2815dependency.
281633. Dr. Brown reviewed the Adult Clinical Interpretive
2824Reports of the MMPI and the MCMI performed on Ms. Penansky by
2836Dr. Anthony and opined that the tests are bordering on invalid
2847and that, given Ms. Penanskys defensiveness on the test in
2857answering questions, she would not use the test results as a
2868total basis for concluding that Ms. Penansky did not have a
2879problem with alcohol.
288234. Given Dr. Johnsons reliance on the use of mouthwash
2892as the explanation for the smell on alcohol on Ms. Penanskys
2903breath, the lack of credibility in Ms. Penanskys account of her
2914family history, and the defensive answers given by Ms. Penansky
2924on her psychological testing, Dr. Johnsons opinion concerning
2932Ms. Penanskys alcohol abuse lacks credibility.
293835. Current and former employees of Suncoast highly
2946regarded Ms. Penanskys work. Her evaluations were very good.
2955She wo rked very hard, and the quality of her work was excellent.
2968However, alcohol abuse can affect a nurses judgment and ability
2978to practice with reasonable skill and safety. Alcohol may slow
2988concentration and thinking and thereby cause a nurse to miss a
2999diag nosis or symptom while treating a patient. Alcohol abuse
3009may cause tremors, such as those experienced by Ms. Penansky.
3019Although Ms. Penanskys alcohol abuse may not have resulted in
3029patient harm, it does not mean that it will not result in harm
3042in the fu ture. It is not necessary to wait for a patient to be
3057harmed to determine whether a nurse can practice with reasonable
3067skill and safet y by reason of use of alcohol.
3077CONCLUSIONS OF LAW
308036. The Division of Administrative Hearings has
3087jurisdiction over the parties to and the subject matter of this
3098proceeding. §§ 120.569 and 120.57, Fla. Stat. (200 7 ).
310837. The Department has the burden to establish the
3117allegations in the Administrative Complaint by clear and
3125convincing evidence. Department of Banking and Fi nance v.
3134Osborne Stern and Company , 670 So. 2d 932 (Fla. 1996). What
3145constitutes clear and convincing evidence was described by the
3154court in Slomowitz v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA
31671989) as follows:
3170[C]lear and convincing evidence requires
3175that the evidence must be found to be
3183credible; the facts to which the witnesses
3190testify must be distinctly remembered; the
3196testimony must be precise and explicit and
3203the witnesses must be lacking in confusion
3210as to the facts in issue. The evidence must
3219b e of such weight that it produces in the
3229mind of the trier of fact a firm belief or
3239conviction, without hesitancy, as to the
3245truth of the allegat ions sought to be
3253established.
325438. The Department alleges that Ms. Penansky violated
3262Subsection 464.018(1)(j) , Florida Statutes, which provides that
3269the following act constitutes grounds for disciplinary action:
3277[b]eing unable to practice nursing with reasonable skill and
3286safety to patients by reason of illness or use of alcohol,
3297drugs, narcotics, or chemicals or any other type of material or
3308as a result of any mental or physical condition.
331739. The Department has established by clear and convincing
3326evidence that Ms. Penansky has violated Subsection
3333464.018(1)(j), Florida Statutes. She is unable to practice
3341nu rsing with reasonable skill and safety to patients by reason
3352of use of alcohol. The evidence established that Ms. Penansky
3362had alcohol on her breath while on duty in 2004 and 2006. She
3375experienced tremors in her hands, and her speech was un clear.
338640. Fl orida Administrative Code Rule 64B9 - 8.006(3)(r)
3395provides that the penalty for a first offense of being unable to
3407practice nursing with reasonable skill and safety to patients by
3417reason of use of alcohol ranges from a $250 fine, IPN
3428evaluation, and probatio n to a $500 fine, IPN evaluation, and
3439suspension to be followed by a term of probation or revocation.
3450RECOMMENDATION
3451Based on the foregoing Findings of Fact and Conclusions of
3461Law, it is RECOMMENDED that a final order be entered finding
3472that B.J. Penansky, A.R.N.P., violated Subsection 464.018(1)(j),
3479Florida Statutes; imposing an administrative fine of $250;
3487requiring her to undergo an IPN evaluation; suspending her
3496license until such time as she undergoes an IPN evaluation;
3506requiring compliance with all IP N recommendations, if any; and
3516placing her on probation for three years with direct
3525supervision.
