29RECOMMENDED ORDER OF DISMISSAL
33On February 19, 2008, the Respondent, Riverside National
41Bank (Respondent), filed an Emergency Motion to Dismiss. That
50motion was denied by Order entered on February 21, 2008, but the
62Respondent was granted leave to renew the motion at hearing. The
73hearing in this cause was scheduled for February 27, 2008, in
84Fort Pierce, Florida. Written notice of the hearing was provided
94to the parties and telephone reminders (in an effort to confirm
105their attendance) were extended by telephone. Nevertheless, the
113Petitioner, Dawn M. Shook, did not appear for the hearing.
123No evidence was presented on the Petitioner's behalf.
131Further, having reviewed the record in this cause, it is
141concluded that the Petitioner has not complied with previous
150orders entered in this matter. Specifically, the Petitioner did
159not timely respond to discovery requests. In fact, on
168September 24, 2007, the Requests for Admission filed by the
178Respondent were deemed admitted. Further, while the Petitioner
186did not attempt to offer evidence into the record, had she done
198so, the Respondent may have sought to bar documentary evidence,
208as information had not been timely produced to the Respondent as
219directed by Orders to Show Cause entered in this cause. Also, it
231appears the Petitioner did not comply with the Order of Pre-
242Hearing Instruction entered on August 2, 2007. Finally, on March
25217, 2008, the Petitioner filed a letter dated February 25, 2008,
263that purports to voluntarily dismiss this case. By separate
272Notice of Ex-Parte Communication, the document, together with its
281attachments, has been provided to the Respondent and made a part
292of the docket.
295Having reviewed the matter fully, it is concluded that, as a
306matter of law, the Florida Commission on Human Relations should
316enter a Final Order dismissing this case.

345STATEMENT OF THE ISSUE
349Whether the Petitioner's claim should be dismissed.
356PRELIMINARY STATEMENT
358On July 10, 2007, the Florida Commission on Human Relations
368(Commission) forwarded a Petition for Relief from the Petitioner,
377Dawn Shook, naming the Respondent, Riverside Bank, as the party
387that had allegedly committed an unlawful employment practice.
395The Commission's determination in this case had indicated "no
404cause" for the claim.
408The Petitioner's claim alleged that the Respondent had
416unlawfully failed to hire the Petitioner due to her race, marital
427status, sex, age, religion, and disability. The Respondent has
436at all times denied the allegations of the complaint, timely
446requested an evidentiary hearing to dispute the factual
454allegations of the claim, and sought additional information from
463the Petitioner to fully address the allegations.
470CONCLUSIONS OF LAW
4731. The Division of Administrative Hearings has
480jurisdiction over the subject matter and the parties hereto
489pursuant to Sections 120.569 and 120.57(1), Florida Statutes
497(2007).
4982. Section 760.11, Florida Statutes (2007), provides
505administrative and civil remedies for alleged violations of
513Chapter 760.
5153. Specifically, Section 760.11(6), Florida Statutes
521(2007), provides, in pertinent part:
526(6) Any administrative hearing brought
531pursuant to paragraph (4)(b) shall be
537conducted under ss. 120.569 and 120.57. * * *
546If the administrative law judge, after the
553hearing, finds that a violation of the
560Florida Civil Rights Act of 1992 has
567occurred, the administrative law judge shall
573issue an appropriate recommended order in
579accordance with chapter 120 prohibiting the
585practice and providing affirmative relief
590from the effects of the practice, including
597back pay. Within 90 days of the date the
606recommended or proposed order is rendered,
612the commission shall issue a final order by
620adopting, rejecting, or modifying the
625recommended order as provided under ss.
631120.569 and 120.57. The 90-day period may
638be extended with the consent of all the
646parties. An administrative hearing pursuant
651to paragraph (4)(b) must be requested no
658later than 35 days after the date of
666determination of reasonable cause by the
672commission. In any action or proceeding
678under this subsection, the commission, in
684its discretion, may allow the prevailing
690party a reasonable attorney's fee as part of
698the costs. It is the intent of the
706Legislature that this provision for
711attorney's fees be interpreted in a manner
718consistent with federal case law involving a
725Title VII action.
7284. In this case,the Petitioner presented no evidence to
738support her claim. Additionally, as the Petitioner failed to
747comply with the directives entered in this case, future claims
757filed by this Petitioner should be considered in light of the
768provisions of Section 120.595, Florida Statutes (2007), that
776address proceedings when a party participates for an "improper
785purpose."
786RECOMMENDATION
787Based on the foregoing, it is RECOMMENDED that the
796Commission enter a Final Order dismissing this cause.
