95STATEMENT OF THE ISSUE
99The issue in this case is whether Petitioners are entitled
109to a motor vehicle dealership that is proposed to be located in
121Fort Walton Beach, Florida .
126PRELIMINARY STATEMENT
128On August 3, 2007, SunL Group, Inc. and Coastal Powersports
138(Petitioner s) published a Notice of Publication for a New Point
149Franchise Motor Vehicle Dealer in a County of Less than 300,000
161Population in the Florida Administrative Weekly. The proposed
169dealership was to be located in Fort Walton Beach, Florida. On
180August 13, 2 007, Wholesale Nation Automotive, Inc. (Respondent)
189filed a Petition of Complaint in letter form, protesting the
199establishment of the franchise at its proposed location. The
208case was forwarded to the Division of Administrative Hearings to
218conduct the fina l hearing in this matter.
226This cause came on for hearing as noticed. After waiting
236more than an hour, the Petitioners failed to appear to prosecute
247their claim. Respondent was present and prepared to go forward
257with the hearing. The hearing was cal led to order and
268Respondent presented evidence regarding their protest.
274FINDINGS OF FACT
2771. The evidence showed that the dealership proposed by
286Petitioners would sell the same line and make of motorcycles as
297those sold by Respondent. The proposed de alership would also
307compete in the Respondents territory since it would be located
317in the same county as Respondent and would be within 20 miles of
330Respondent. Respondent has standing to protest the
337establishment of the proposed dealership.
3422. On September 18, 2007, a Notice of Hearing setting the
353date, time and location of final hearing was issued in this
364case. The Notice of Hearing was mailed to the last known, valid
376addresses of the Petitioners, which were also the addresses
385provided in Petiti oners Notice of Publication. Neither Notice
394of Hearing was returned.
3983. T his cause came on for hearing as noticed. After
409waiting more than an hour, the Petitioners failed to appear to
420prosecute their claim. There has been no communication from t he
431Petitioners before, during, or since the hearing to indicate
440that they would not be attending the final hearing.
4494. Because of Petitioners failure to appear, there was no
459evidence to demonstrate that Petitioners are entitled to a
468franchise moto r vehicle dealership in Fort Walton Beach,
477Florida. Absent such evidence, the establishment of the
485proposed dealership should be denied.
490CONCLUSIONS OF LAW
4935. The Division of Administrative Hearings has
500jurisdiction of the subject matter of and the parties to this
511proceeding. §§ 120.569 and 120.57(1), Fla. Stat.
5186. The Department of Highway Safety and Motor Vehicles
527(Department) is the agency responsible for regulating the
535licensing and franchising of motor vehicle dealers. §§ 320.60 -
545320.70, F la. Stat.
5497. Section 320.642(1), Florida Statutes, requires a motor
557vehicle dealer who proposes to establish an additional motor
566vehicle dealership within an area already represented by the
575same line - make vehicle to give written notice to the Departm ent
588of its intent to establish a new franchise. The statute also
599provides that any affected dealership may protest the
607establishment of a new franchise in its territory.
6158. Section 320.642(2), Florida Statutes, establishes the
622standards of review to determine if establishment of a new,
632competing motor vehicle franchise should be granted. Section
640360.642 (2)(a), Florida Statutes, states in relevant part:
648An application for a motor vehicle dealer
655license in any community or territory shall
662be denied w hen:
666* * *
6692. The licensee fails to show that the
677existing franchised dealer . . . are not
685providing adequate representation of such
690line - make motor vehicles in such . . .
700territory. The burden of proof in
706establishing inadequate representation shall
710be on the licensee . (emphasis supplied)
7179. In this case, Petitioners, as the licensees, failed to
727appear at the hearing after proper Notice of the hearing was
738issued. Because Petitioners failed to appear, there was no
747evidence that Respondent was not adequately representing the
755territory in which the proposed dealership intends to locate was
765not presented. Absent such evidence, Petitioners have not
773carried their burden of proof in this matter and the
783establishment of the proposed franchise should be denied.
791RECOMMENDATION
792Accordingly, in consideration of the foregoing findings of
800fact and conclusions of law, it is
807RECOMMENDED that a final order be entered by the Florida
817Department of Highway Safety and Motor Vehicles denying the
826establi shment of Petitioners proposed franchise.
