110STATEMENT OF THE ISSUE
114Whether Vento North America, LLC (Vento) should be
122permitted to establish an additional dealership for the sale of
132Qianjiang motorcycles at 1333 Washington Avenue, Miami Beach,
140Florida, over Respondent's protest.
144PRELIMINARY STATEMENT
146On September 7, 2007, a notice was published in Florida
156Administrative Weekly that Vento intended "to allow the
164establishment of DK Cycle, Inc., as a dealership for the sale
175of . . . Qianjiang (QIAN) motorcycles at 1333 Washington
185Avenue, Miami Beach ([Miami-]Dade County), Florida
19133139 . . . ." 2 On September 28, 2007, Respondent filed with
204Department of Highway Safety and Motor Vehicles (Department) a
"213petition/complaint" protesting the establishment of this
219additional dealership. On October 3, 2007, the matter was
228referred to DOAH to "be heard by an Administrative Law Judge."
239The final hearing was scheduled for March 26, 2008.
248Petitioners and Respondent were provided with written notice of
257the scheduled hearing in accordance with Section 120.569(2)(b),
265Florida Statutes. Such notice was in the form of a Notice of
277Hearing by Video Teleconference mailed on October 30, 2007, to
287Respondent's counsel of record, Manuel Ramirez, Esquire, and to
296Petitioners' representatives.
298As noted above, the final hearing in this case was held, as
310scheduled, on March 26, 2008. Respondent appeared at the
319hearing through its counsel, Mr. Ramirez. Petitioners, on the
328other hand, made no appearance.
333One witness, Anabella Cabello, Respondent's president,
339testified at the hearing. In addition to Ms. Cabello's
348testimony, one exhibit (Respondent's Exhibit 1) was offered and
357received into evidence.
360At the conclusion of the evidentiary portion of the
369hearing, the undersigned inquired of Respondent's counsel,
376Mr. Ramirez, as to whether he would be submitting a proposed
387recommended order. Mr. Ramirez responded in the negative.
395FINDINGS OF FACT
398Based on the evidence adduced at hearing, and the record as
409a whole, the following findings of fact are made:
4181. Respondent is an existing franchised dealer of
426Qianjiang motorcycles.
4282. Its dealership is located at 7341 Collins Avenue in
438Miami Beach, Florida.
4413. The driving distance between Respondent's dealership
448and the location of the new dealership Vento proposes to
458establish is 5.6 miles.
462CONCLUSIONS OF LAW
4654. DOAH has jurisdiction over the subject matter of this
475proceeding and of the parties hereto pursuant to Chapter 120,
485Florida Statutes.
4875. Vento is seeking the Department's approval of a
496proposal to establish a new dealership for the sale of Qianjiang
507motorcycles at 1333 Washington Avenue in Miami-Beach, Florida.
515It is seeking such approval pursuant to Section 320.642, Florida
525Statutes.
5266. Subsection (2)(a) of Section 320.642, Florida Statutes,
534provides that such approval shall be denied if:
5421. A timely protest is filed by a presently
551existing franchised motor vehicle dealer
556with standing to protest as defined in
563subsection (3); and
5662. The licensee fails to show that the
574existing franchised dealer or dealers who
580register new motor vehicle retail sales or
587retail leases of the same line-make in the
595community or territory of the proposed
601dealership are not providing adequate
606representation of such line-make motor
611vehicles in such community or territory.
617The burden of proof in establishing
623inadequate representation shall be on the
629licensee.
6307. Pursuant to Subsection (3)(b)1. of Section 320.642,
638Florida Statutes, "if the proposed additional . . . motor
648vehicle dealer is to be located in a county with a population of
661more than 300,000," such as in the instant case, "[a]ny existing
673motor vehicle dealer or dealers of the same line-make hav[ing] a
684licensed franchise location within a radius of 12.5 miles of the
695location of the proposed additional . . . motor vehicle dealer"
706has standing to file a "protest," within the meaning of
716Subsection (2)(a)1. of the statute.
7218. With respect to the proposed new dealership in the
731instant case, Respondent is such an "existing motor vehicle
740dealer" who has standing to file a protest.
7489. By filing its protest and establishing (through its
757evidentiary presentation at hearing) its standing to do so,
766Respondent effectively imposed upon Vento, by operation of the
775provisions of Subsection (2)(a)2. of Section 320.642, Florida
783Statutes, the burden of proving there is "inadequate
791representation" in the community or territory of the proposed
800new dealership.
80210. Not having presented any evidence at the final
811hearing, Vento failed to meet this burden of proof.
82011. The approval that it is seeking in the instant case
831must therefore be denied.
835RECOMMENDATION
836Based upon the foregoing Findings of Fact and Conclusions
845of Law, it is hereby
850RECOMMENDED that the Department issue a Final Order denying
859Vento approval to establish a new Qianjiang motorcycle
867dealership at 1333 Washington Avenue, Miami Beach, Florida.
